3. Decisão: O Tribunal, por unanimidade e nos termos do
voto da Relatora, julgou procedente o pedido formulado
na ação direta para dar interpretação conforme à
Constituição aos artigos 20 e 21 do Código Civil, sem
redução de texto, para, em consonância com os direitos
fundamentais à liberdade de pensamento e de sua
expressão, de criação artística, produção científica,
declarar inexigível o consentimento de pessoa biografada
relativamente a obras biográficas literárias ou audiovisuais,
sendo por igual desnecessária autorização de pessoas
retratadas como coadjuvantes (ou de seus familiares, em
caso de pessoas falecidas).

5. Código Civil
Art. 20. Salvo se autorizadas, ou se necessárias à administração da justiça
ou à manutenção da ordem pública, a divulgação de escritos, a
transmissão da palavra, ou a publicação, a exposição ou a utilização da
imagem de uma pessoa poderão ser proibidas, a seu requerimento e sem
prejuízo da indenização que couber, se lhe atingirem a honra, a boa fama
ou a respeitabilidade, ou se se destinarem a fins comerciais.
Parágrafo único. Em se tratando de morto ou de ausente, são partes
legítimas para requerer essa proteção o cônjuge, os ascendentes ou os
descendentes.
Art. 21. A vida privada da pessoa natural é inviolável, e o juiz, a
requerimento do interessado, adotará as providências necessárias para
impedir ou fazer cessar ato contrário a esta norma.

A Suprema Corte tende a reconhecer a liberdade de imprensa como
um bem maior
Teste de duas fases da expectativa de privacidade [Katz v. United

“[F]irst that a person have exhibited an actual (subjective) expectation
of privacy and, second, that the expectation to be one that society is

Tentativas de definição do direito:
- Calcutt Committee (Report of the Committee on Privacy and Related
Matters) (1990): "The right of the individual to be protected against
intrusion into his personal life or affairs, or those of his family, by direct
physical means or by publication of information.”
- Government Response to the National Heritage Select Committee,
Privacy and Media Intrusion (1995): "Every individual has a right to
privacy comprising: (a) a right to be free from harassment and
molestation; and (b) a right to privacy of personal information,
communications, and documents.“

“It is important to state at the outset that this case is
not concerned with so called "image rights". Whatever
may be the position elsewhere in the world, and how
ever much various celebrities may wish there were,
there is today in England no such thing as a free
standing general right by a famous person (or anyone
else) to control the reproduction of their image. There
is a developing law of privacy but no question of that
arises in this case. The taking of the photograph is not
suggested to have breached Rihanna's privacy. A
celebrity may control the distribution of particular
images in which they own the copyright but that right
is specific to the particular photographs in question.
Whether an image right can or should be developed is
not what this case is concerned with.”

“The mere sale by a trader of a t-shirt bearing an image of a famous person is not,
without more, an act of passing off. However the sale of this image of this person
on this garment by this shop in these circumstances is a different matter. I find that
Topshop's sale of this Rihanna t-shirt without her approval was an act of passing
off. I find for the claimants.”
15. Image Rights nos EUA
CELEBRITIES RIGHTS ACT (California 1985) - Assegura direitos após a morte de
celebridades para seus herdeiros:
- that personality had been "any natural person whose name, voice, signature,
photograph, or likeness has commercial value at the time of his or her death",
- any person using such personality's "name, voice, signature, photograph or likeness
on or in products, merchandise or goods" without prior consent was liable to be sued
for damages and profits arising from the unauthorized use, and
- such prior consent may only be given by persons to whom the personality had
transferred such power by contract or trust prior to his death, or by trust or will after
his death, or, where no such latter provision was made, his spouse, children, and/or
grandchildren, but
-"a play, book, magazine, newspaper, musical composition, audiovisual work, radio or
television program, single and original work of art, work of political or newsworthy
value, or an advertisement or commercial announcement for any of these works, shall
not be considered a product, article of merchandise, good, or service if it is fictional or
nonfictional entertainment, or a dramatic, literary, or musical work.“

Shaw Family Archives Ltd. v. CMG Worldwide, Inc., 486 F.Supp.2d 309
(S.D.N.Y., 2007)
Decisão proferida em maio de 2007 estabelecendo que, no que tange à Marilyn
Monroe, tendo em vista sua morte ter ocorrido antes da California's Celebrity
Rights Act, no ano de 1962, e o Estado de Nova York não reconhecer o direito de
personalidade após a morte do artista, seu nome, imagem e voz cairam em
domínio público nos Estados da Califórnia e de Nova York.
Em decorrência desta decisão, o Estado da Califórnia aprovou uma lei que cria
direitos sobre a personalidade até 70 anos após a morte, retroativa para
qualquer pessoa falecida depois de 1º de janeiro de 1938.
