Prezados,
Em virtude dos escândalos envolvendo o uso
indevido de dados pessoas e perfis de
comportamento de 87 milhões de usuários
conectados ao Facebook, disponibilizados à
empresa de consultoria Cambridge Analytica
para marketing e fins políticos, a Associação SOS
Consumidor ingressou, em abril de 2018, com
ação civil pública contra o site no Brasil, pela
violação de direitos difusos e coletivos, como o
direito à privacidade.
Dear Sirs.,
As a result of the scandals involving personal data
and behavioral profiles breaches regarding 87
million users connected to Facebook, disclosed to
the consulting firm Cambridge Analytica for
marketing and political purposes, the SOS Consumer
Association filed, in April, 2018 a public civil action
against the social media in Brazil, for the violation of
diffuse and collective rights, as the right to privacy.

Segundo a Associação, o Facebook seria
responsável pelo vazamento dos dados,
informações e perfis de comportamento de
443 mil usuários brasileiros. Ainda, em virtude
do impacto mundial das acusações contra o
site e das sabatinas já realizadas com o
fundador e representante legal da empresa,
Mark Zuckerberg já haveria admitido, frente ao
congresso norte-americano, a
responsabilidade pelo seu erro sobre o
vazamento das informações. Neste contexto,
Mark já haveria, inclusive, pedido desculpas
pelo episódio, se intitulando responsável por
não garantir a suficiente proteção dos dados
de seus usuários e pelos danos causados.
A autora traz também à pauta a aplicação do
Código de Defesa do Consumidor aos serviços
prestados por provedores de hospedagem
(como é o caso do Facebook), ainda que os
mesmos sejam gratuitos. Uma vez que a
remuneração acontece através da publicidade
no site e, segundo a ação, também através da
venda de dados pessoais e informações de
monitoramento comportamental, restaria
evidente o faturamento gerado em virtude de
seus usuários e aplicação do CDC.
Com a ação, que corre atualmente na 7ª vara
Cível do Foro Central da Capital de São Paulo, a
Associação espera obter o pagamento de
indenização por danos morais coletivos, cujo
valor deverá ser revertido ao Fundo de Defesa
de Direitos Difusos (“FDD”). Nesse sentido, o
montante solicitado é requerido como uma
medida corretiva, no intuito de punir a rede
social e constrangê-la em futuras práticas de
violação de dados pessoais, ou seja, como
função de desestímulo. O pedido é
corroborado no alto faturamento do Facebook,
atualmente em torno de 1,5 bilhões de reais.
Portanto, salienta a Associação que os valores
a serem arbitrados pelo juízo devem condizer
com o lucro real da empresa, para que de fato
a impacte e surta efeito.
According to the Association, Facebook would be
responsible for the breach of data, information
and behavioral profiles of 443 thousand Brazilian
users. Also, due to the worldwide impact of the
accusations against the site and the testimonies
already performed by the founder and legal
representative of the company, Mark Zuckerberg
had already admitted, before the US Congress, the
responsibility for his mistake about the disclosure
of information. In this scenario, Mark would have
apologized for the episode, claiming responsibility
for not ensuring sufficient protection to the data
of its users and to the damages caused.
The plaintiff also calls attention to the application
of the Consumer’ Protection Code to the services
offered by hosting providers (as is the case of
Facebook), even if they are free of charge directly
by the user. Once the compensation happens
through advertising on the website and, according
to the plaintiff, also through the sale of personal
data and behavioral monitoring information, it
would be evident the profit generated by virtue of
its users and, therefore, the application of the
Consumer’s Code.
With the lawsuit, currently in the 7th Civil Court of
the Central Forum of the Capital of São Paulo, the
Association expects to obtain payment of
compensation for collective moral damages, for
which the value should be reverted to the Fund for
the Defense of Diffuse Rights ("FDD"). In this
sense, the requested amount is required as a
corrective measure, in order to punish the social
network and constrain it in future practices of
personal data violation, that is, in the function of
discouragement. The request is also grounded in
the high income of Facebook, currently around 1.5
billion Reais. Therefore, the Association points out
that the values to be arbitrated by the court shall
correspond to the profit of the company, so that it
can actually impact the company and take any
effect.

Em abril de 2018, a 6ª Câmara de Direito Civil
do Tribunal de Justiça de Santa Catarina
determinou que o autor do vídeo humorístico
"Medonhamente" fosse indenizado após a
Google ter removido o vídeo do site
”YouTube”, em razão alegação de violação de
direitos autorais da canção apresentada pela
representante dos direitos autorais da música
original, “Malandramente”.

In April, 2018 the 6th Chamber of Civil Law of the
Santa Catarina Court of Appeals ruled that the
author of the humoristic video entitled
"Medonhamente" should be indemnified after
Google removed the video from the website
"YouTube", due to the allegation of copyright
infringement presented by the representatives of
the original song, "Malandramente".
O Facebook Brasil apresentou, em 25 de maio
de 2018, a sua contestação, na qual, entre
outros argumentos, salienta que não houve
invasão de sistemas ou quebra de sigilo de
dados, bem como foram obtidos a partir do
uso do aplicativo de um terceiro, no qual os
usuários tiveram a opção de consentir ou não
com a referida coleta de dados.
Em que pese argumentar que a transferência
indevida dos dados tenha sido realizada por
este terceiro à Cambridge Analytica, a ação
permanece aguardando a apreciação do juízo.

On May 25, 2018 Facebook Brasil presented its
defense, in which, among other arguments,
stresses that there was no system invasion or data
breach, as well as the data have been obtained
from the use of the application of a third party , in
which the users had the option to consent or not
to the mentioned data collection.
Despite arguing that the improper transfer of data
has been performed by this third party to
Cambridge Analytica, the action remains pending
consideration and ruling from the competent
judge.

Trata-se de controvérsia originada após a
paródia ter sido removida do YouTube pela
Google a pedido da ONErpm, representante
dos direitos autorais da canção original, após o
autor do vídeo ter se recusado a dividir a
receita auferida com o vídeo com a empresa.
Segundo o autor, a paródia possuía conteúdo
estritamente humorístico e não denigria a
imagem dos artistas ou da obra original, de
modo que inexistia qualquer violação aos
direitos autorais, tendo sua retirada do ar lhe
causado prejuízo patrimonial.
Em sua defesa, a Google alegou que atuou
estritamente de acordo com os Termos de
Serviço do YouTube e que, por ser apenas um
provedor de aplicações de internet, apenas
agiu de acordo com a notificação de denúncia
por violação de direitos autorais enviada pelos
representantes dos autores da canção original.
A segunda ré, ONErpm, sustentou às paródias
não é permitida a exploração econômica,
tendo em vista que o direito da obra seria do
autor da canção original.
Na decisão de 1ª instância, o juiz condenou as
rés ao pagamento de 30 mil reais a título de
indenização por danos morais e lucros
cessantes referentes ao período em que o
vídeo ficou indisponível, além de exigir que a
Google voltasse a disponibilizar os vídeos no
canal do artista no YouTube.
As rés recorreram da sentença, alegando os
mesmos argumentos aduzidos em suas
contestações e requerendo a reforma da
sentença ou a redução da indenização fixada a
título de danos morais.
The matter arose after the parody was taken down
by Google from the YouTube website at the request
of ONErpm, owner of the patrimonial rights of the
original song, after the author of the parody
refused to split the revenue earned from the video
with the company.
According to the author, the parody had a
humoristic content and did not denigrate the image
of the artists nor the original work and therefore
that there was no copyright violation. Moreover,
the withdrawal of the video would have caused
patrimonial losses to the author.
Google replied alleging that it acted strictly in
accordance to YouTube’s terms of service and that
as an internet application provider it only acted in
accordance with the copyright notice that was sent
by the authors of the original song.
The second defendant, ONErpm, sustained in
response that the economic exploitation of
parodies is not allowed, considering that the
patrimonial rights of the work belongs to the
author of the original song.
In the court decision, the first instance judge
sentenced the defendants to the payment of
30,000 Brazilian Reais as a compensation for moral
damages and lost profits related to the period in
which the video remained unavailable, and
required Google to make the video available on
YouTube.
The defendants appealed alleging the same
arguments that were brought forward in their
defenses and requesting the revision of the
sentence or the reduction of the amount of
compensation for moral damages.

No acórdão, o desembargador destacou que as
paródias são permitidas pelo artigo 47 da Lei
9.610/98 (Lei de Direitos Autorais),
constituindo exceção à violação de direito
autoral, desde que não reproduzam a obra
original ou lhe impliquem descrédito.
Assim, entendeu o desembargador que e
paródia “Medonhamente” cumpre os
requisitos da Lei de Direitos Autorais, na
medida em que possui caráter
predominantemente humorístico e que em
nada se confunde com a música
“Malandramente”, não acarretando
concorrência desleal, e tampouco a denigre.
Em relação à questão do lucro advindo da
paródia, o Desembargador destacou que a Lei
de Direitos Autorais não exige a vedação de
qualquer finalidade comercial da paródia para
que ela seja lícita, de modo que não há
qualquer impedimento na exploração
econômica do vídeo pelo autor, além de não
ser necessária qualquer compensação
financeira ao autor da obra original.
Com relação à Google, o acórdão destacou que
a remoção do conteúdo, ainda que previsto
nos termos de serviço do YouTube, é ilegal e
que a censura indevida constitui ato ilícito, na
medida em que desrespeita a liberdade de
expressão, em afronta à Constituição Federal e
ao Marco Civil da Internet (Lei nº 12.965/14).
O acórdão destacou, ainda, que ao contrário
do sistema adotado pelos Estados Unidos
(notice and takedown), o Marco Civil da
Internet pauta seu proceder na liberdade de
expressão, cabendo ao Judiciário, mediante
reclamação daqueles que alegam a violação ao
direito autoral, determinar a remoção dos
conteúdos ilícitos.

In the appellate decision, the appellate judge stated
that parodies are allowed by Article 47 of the
Brazilian Copyright Law (Law 9.610 of February 19,
1998), as an exception to copyright infringement,
provided they do not reproduce the original work
or imply discredit to it.
The judge also stated that the parody
"Medonhamente" meets the requirements of the
Brazilian Copyright Law, insofar as it has a
predominantly humoristic character and that it
can’t be confused with the song "Malandramente",
not constituting unfair competition, and does not
denigrate the original song.
With respect to the matter of the profit arising
from the parody, the Judge stressed that the
Brazilian Copyright Law does not require that the
parody doesn’t have commercial purpose for it to
be lawful. Therefore, the economic exploitation of
the video by its author is allowed. Also, no financial
compensation is required for the author of the
original work.
With regards to Google, the ruling emphasized that
the withdrawal of the content, even if in
accordance to YouTube's terms of service, is illegal
and that the improper censorship constitutes an
unlawful act, insofar as it violates the freedom of
expression, in violation to the Federal Constitution
and the Brazilian Internet Bill of Rights (Law No.
12.965 of April 23, 2014).
The appellate decision also emphasized that, unlike
the system adopted by the United States of
America (notice and takedown), the Brazilian
Internet Bill of Rights is based on the freedom of
expression, being up to the judicial system to
request the removal of the illegal content after the
complaint for copyright infringement.
