Conforme comprova o inquérito civil anexo, entre os anos de 2005 e 2010,
período durante o qual Orides Kormann exerceu o cargo de Prefeito Municipal de
Guabiruba, foram realizadas, de forma irregular, pelo Município de Guabiruba,
contratações diretas de pessoal, em desobediência à regra do concurso público.
Com efeito, conforme demonstra o quadro abaixo e a documentação anexa,
entre os meses de março e novembro de 2005, Zeni Fernandes foi seguidamente
contratado pela Municipalidade para "prestar serviços de pedreiro":

A contratação desses serviços foi realizada ao total arrepio da lei.
Em primeiro lugar, porque o Município de Guabiruba possuía, desde 1991, a
Lei nº 346/91, que criava os cargos de trabalhador braçal e pedreiro, bem como
estipulava que o preenchimento desses cargos deveria se dar por concurso público
(vide fls. 599/610), regra, aliás, que, de forma mais geral, já consta na Constituição
Federal (artigo 37, II, da Constituição Federal).
Em segundo lugar, porque também não há qualquer notícia de que, nos casos
acima relatados, tenha sido respeitada a Lei Municipal nº 593/97 (que prevê que o
recrutamento de pessoal para necessidades temporárias depende da prévia
realização de processo seletivo simplificado), até porque ela não se aplicaria ao
presente caso (já que, de acordo com o artigo 1º da mencionada Lei, a contratação

temporária só serviria para atender necessidades temporárias e excepcionais, nas
áreas de educação e saúde, para recuperação de obras e serviços públicos
danificados pela ocorrência de fenômenos meteorológicos, cuja extensão caracteriza
situação excepcional e para obra certa, cuja execução obedeça o regime de
administração direta.) (vide fls. 611/613).
Finalmente, porque, se de contratação direta se tratou (isto é, contratação sem
a prévia realização de concurso público ou processo seletivo simplificado), deveria,
no mínimo, o Prefeito Municipal ter lançado processo licitatório para a contratação
dos serviços, pois eram serviços continuados cujo custo, no todo, ultrapassava o
valor de R$ 8.000,00, estando, logo, afastada a dispensabilidade do certame (artigo
24, I, da Lei de Licitações).
Ou seja, o então Prefeito Municipal ignorou, em cascata: a) a regra de que as
contratações que os cargos, empregos e funções públicas são exclusivas de quem
presta concurso público; b) a regra de que o regime da contratação temporária não é
aplicável a qualquer cargo e que, mesmo que fosse, a contratação, na espécie,
dependeria da prévia realização de processo seletivo; c) finalmente, a regra de que
as contratações de serviços que ultrapassem o valor de R$ 8.000,00 devem ser
precedidas de licitação (inclusive quando ocorre a fragmentação do objeto do
contrato, como foi o caso).
O Tribunal de Contas do Estado, que também analisa o caso, apontou, da
mesma forma, que a conduta do então Prefeito Municipal foi irregular, como pode ser
conferido às fls. 487/489 e 584/585.
Ao ignorar o disposto na Constituição Federal, nas Leis Municipais nº 346/91

e nº 593/97, e na Lei de Licitações, o então Prefeito Municipal, que foi sempre o
ordenador das despesas, praticou ato de improbidade administrativa que atentou
contra os princípios da administração pública, conforme previsto no artigo 11, I, da Lei
nº 8.429/92, que assim averba:
Art. 11. Constitui ato de improbidade administrativa que atenta contra os
princípios da administração pública qualquer ação ou omissão que viole os
deveres de honestidade, imparcialidade, legalidade, e lealdade às
instituições, e notadamente: I. - praticar ato visando fim proibido em lei ou
regulamento ou diverso daquele previsto, na regra de competência; (...).
Deve, portanto, Orides Kormann ser responsabilizado pelos atos de
improbidade administrativa cometidos por ocasião das contratações irregulares. Os
beneficiados pelas contratações irregulares não foram demandados, pois eram
pessoas notadamente simples (basta ver o trabalho que exerciam) e, muito
provavelmente, nem mesmo tinham noção da ilegalidade que os beneficiava.
Do pedido
Em face de todo o exposto, requer o Ministério Público:
a) seja notificado o requerido para, querendo, oferecer manifestação por
escrito no prazo de 15 (quinze) dias (art. 17, § 7º, da Lei nº 8.429/92);
b) decorrido o prazo de resposta, com ou sem manifestação, seja a
petição inicial recebida, citando-se o requerido, para, querendo, apresentar contestação;
c) seja garantido ao Órgão Ministerial o direito de produzir todas as
provas permitidas em direito, em especial a documental;

d) seja o Município de Guabiruba citado, para, querendo, no prazo legal,
compor a lide na condição de litisconsorte (art. 17, § 3º da Lei de Improbidade
Administrativa);
e) seja reconhecido que o demandado praticou ato de improbidade
administrativa que atentou contra os princípios da administração pública, notadamente
através da realização de ato proibido em lei, o que deve acarretar a condenação dele
como incurso no artigo 11, I, da Lei nº 8.429/92, com a aplicação das sanções
pertinentes à espécie (ressarcimento integral do dano, perda da função pública,
suspensão dos direitos políticos de três a cinco anos, pagamento de multa civil de até
cem vezes o valor da remuneração percebida pelo agente e proibição de contratar com
o Poder Público ou receber benefícios ou incentivos fiscais ou creditícios, direta ou
indiretamente, ainda que por intermédio de pessoa jurídica da qual seja sócio
majoritário, pelo prazo de três anos);
f) seja também o demandado condenado, ao final, ao pagamento das
custas do processo e demais cominações de estilo.
Dá-se à causa, para fins meramente fiscais, o valor de R$ 10.000,00 (dez
mil reais).
