Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

Alterações laborais – Combate às formas modernas de trabalho forçado
A Lei n.º 28/2016, de 23 de agosto – que
entrou em vigor no passado dia 22 de setembro
de 2016 - visa, como resulta do seu preâmbulo, o
“combate às formas modernas de trabalho
forçado”, em especial, no que respeita às
empresas que recorrem ao trabalho temporário,
explorações agrícolas, obras e situações de
subcontratação.
Para tanto o legislador “reforçou”,
essencialmente, o regime da responsabilidade
civil e contraordenacional,
responsabilizando todos os
intervenientes pelo pagamento
de créditos do trabalhador, dos
encargos sociais
correspondentes e das
eventuais coimas aplicáveis
pela violação dos direitos,
deveres e obrigações da
relação laboral.
Como ponto prévio importa
desde logo clarificar, sucintamente, os dois
regimes de responsabilidade aqui em causa:
• A responsabilidade subsidiária que
consiste na faculdade, imposta pela lei, de o
credor exigir o pagamento do seu crédito, em
caso de inexistência ou insuficiência dos bens
do devedor originário, ao responsável
subsequente (subsidiário);
• A responsabilidade solidária que consiste
na faculdade legal de o credor reclamar o
pagamento do seu crédito a qualquer um dos
devedores ou inclusive a todos eles, sem que
nenhum se possa escusar do mesmo, já que a
obrigação é solidária, respondendo cada um
dos devedores pela prestação integral da
mesma e esta a todos libera.
Com a entrada em vigor da referida lei e
consequente alteração do artigo 174.º, n.º 2 do
Código do Trabalho, o legislador retira o limite
temporal até então existente quanto à
responsabilidade subsidiária do utilizador do
trabalho temporário [que
se circunscrevia aos
primeiros 12 meses da
prestação do trabalho
temporário] e alarga o
objeto e os responsáveis

RESPONSÁVEIS SUBSIDIÁRIOS - pelo pagamento
dos créditos do trabalhador, encargos sociais
correspondentes e respetivas coimas aplicáveis
– além do utilizador de trabalho temporário, a
empresa de trabalho temporário,
administradores ou diretores, assim como as
sociedades que com a empresa de trabalho
temporário ou com o utilizador se encontrem em
relação de participações recíprocas, de
domínio ou de grupo.

ALARGAR A RESPONSABILIDADE
CIVIL E CONTRAORDENACIONAL,

SUBSIDIÁRIA, A TODOS OS
INTERVENIENTES NAS SITUAÇÕES

Sujeitos que, por força do novo artigo 13.º, n.º
5 do Regime Jurídico do Exercício e
Licenciamento das Agências Privadas de
Colocação e das Empresas de Trabalho
Temporário, passam a ser RESPONSÁVEIS
SOLIDÁRIOS, quer pelos encargos e obrigações
legais, quer pelo pagamento de coimas,
decorrentes do incumprimento das obrigações
legais da empresa de trabalho temporário
perante a Segurança Social ou em matéria de
acidente de trabalho.
Alterou ainda a referida lei o regime
estabelecido no artigo 551.º, n.º 4 do Código do
Trabalho, quanto à responsabilidade
contraordenacional, com particular impacto nas
explorações agrícolas e nas empresas de
construção civil, que utilizam a subcontratação,
passando o contratante e o dono da obra,
empresa ou exploração agrícola, bem como os
respetivos gerentes, administradores ou diretores,
assim como as sociedades que com o
contratante, dono da obra, empresa ou
exploração agrícola se encontrem em relação
de participações recíprocas, de domínio ou de
grupo, a ser RESPONSÁVEIS SOLIDÁRIOS pela
violação de disposições legais –
independentemente da sua classificação como
leves, graves ou muito graves - por
subcontratante que execute todo ou parte do
contrato nas instalações daquele ou sob
responsabilidade do mesmo, assim como pelo
pagamento das respetivas coimas aplicáveis.
Por último e no que respeita particularmente
a situações de explorações agrícolas e de obras,
vem a referida lei, por via do artigo 16.º, n.º 5 do
Regime Jurídico da Promoção da Segurança e
Saúde no Trabalho, estatuir a RESPONSABILIDADE
SOLIDÁRIA do dono da obra, empresa ou
exploração agrícola e a empresa utilizadora ou
adjudicatária de obra ou serviço, bem como os
respetivos gerentes, administradores ou diretores,
assim como as sociedades que com o dono da
obra, empresa ou exploração agrícola, empresa
utilizadora ou adjudicatária de obra ou serviço
se encontrem em relação de participações
recíprocas, de domínio ou de grupo, pelas
violações das disposições legais relativas à
segurança e saúde dos trabalhadores
temporários, dos que lhe forem cedidos
ocasionalmente ou dos trabalhadores ao serviço
de empresas prestadoras de serviços, cometidas
durante o exercício da atividade nas suas
instalações, assim como pelo pagamento das
respetivas coimas.
CONSIDERAÇÕES FINAIS
A Lei n.º 28/2016, de 23 de agosto visa combater o trabalho forçado e clandestino em Portugal, em
especial no quadro de empresas que recorrem a trabalho temporário, explorações agrícolas, obras
e ao regime de subcontratação, através da ampliação da responsabilidade civil e
contraordenacional, de forma solidária ou subsidiária, a todos os intervenientes das operações.
No âmbito da prestação de trabalho temporário:
o São responsáveis, subsidiários ou solidários, o utilizador de trabalho temporário, a empresa de
trabalho temporário, os respetivos gerentes, administradores ou diretores, e as sociedades que
com a empresa de trabalho temporário ou com o utilizador se encontrem em relação de
participações recíprocas, de domínio ou de grupo.
o A responsabilidade subsidiária abrange o pagamento dos créditos do trabalhador, encargos
sociais correspondentes e respetivas coimas aplicáveis;

o A responsabilidade solidária abrange quer os encargos e obrigações legais, quer o pagamento
de coimas, decorrentes do incumprimento das obrigações legais da empresa de trabalho
temporário perante a Segurança Social ou em matéria de acidente de trabalho.
No âmbito das explorações agrícolas e nas empresas de construção civil, particularmente as que
utilizam a subcontratação:
o São responsáveis solidários pela violação de disposições legais (não se distinguindo entre
infrações leves, graves ou muito graves) por subcontratante que execute todo ou parte do
contrato nas instalações daquele ou sob responsabilidade do mesmo, assim como pelo
pagamento das respetivas coimas, o contratante e o dono da obra, empresa ou exploração
agrícola, bem como os respetivos gerentes, administradores ou diretores, e as sociedades que
com o contratante, dono da obra, empresa ou exploração agrícola se encontrem em relação
de participações recíprocas, de domínio ou de grupo.
o Nas situações em que várias empresas, estabelecimentos ou serviços desenvolvam,
simultaneamente, atividades com os seus trabalhadores no mesmo local de trabalho, são
responsáveis solidários, pelas violações das disposições legais relativas à segurança e saúde dos
trabalhadores temporários, dos que lhe forem cedidos ocasionalmente ou dos trabalhadores ao
serviço de empresas prestadoras de serviços, cometidas durante o exercício da atividade nas
suas instalações, assim como pelo pagamento das respetivas coimas, o dono da obra, empresa
ou exploração agrícola e a empresa utilizadora ou adjudicatária de obra ou serviço, bem como
os respetivos gerentes, administradores ou diretores, e as sociedades que com o dono da obra,
empresa ou exploração agrícola, empresa utilizadora ou adjudicatária de obra ou serviço se
encontrem em relação de participações recíprocas, de domínio ou de grupo.
