Doctrine of Fair Use

§ 107: Fair Use “various purposes for
which the reproduction of a particular
work may be considered fair, such as
criticism, comment, news reporting,
teaching, scholarship, and research”

    “Copyright protects the
  particular way authors have
 expressed themselves. It does
    not extend to any ideas,
systems, or factual information
     conveyed in a work.”

Open content, “is licensed in a
 manner that provides users
 with the right to make more
   kinds of uses than those
normally permitted under the
 law- at no cost to the user”.

      This code of best practices, that
         consists of 5 principles was
       created to assist educator’s in
           K–12 education, higher

    and students of accredited,
nonprofit educational institutions
  to transmit performances and
displays of copyrighted works as
     part of a course if certain
        conditions are met.

  • 5. What is copyright? “copyright is a form of protection grounded in the U.S. Constitution and granted by law for original works of authorship fixed in a tangible medium of expression.   • 12. Doctrine of Fair Use § 107: Fair Use “various purposes for which the reproduction of a particular work may be considered fair, such as criticism, comment, news reporting, teaching, scholarship, and research” - -Section 107 Copyright Act of 1976
  • 13. Doctrine of Fair Use cont. “Copyright protects the particular way authors have expressed themselves. It does not extend to any ideas, systems, or factual information conveyed in a work.”
