Resident Bill Of Rights #1 A patient or resident will not be denied appropriate care on the basis of race, religion, color, national origin, sex, age handicap, marital status, sexual preference or source of payment.
Resident Bill Of Rights #2 An individual who is or has been a patient or resident, or a person authorized in writing by such an individual, is entitled to inspect or receive a copy, if any of his or her personal and /or medical record upon request in accordance with the Medical Record Access Act, 2004 PA 47, MCL 33.26261 to 33.26271. Except as otherwise permitted or required under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, or regulations promulgated under that Act, 45 CFR parts 160 and 164, a third party shall not be given a copy of the patient’s/resident’s medical record without prior authorization of the patient or resident. Fees for providing copies are governed by the Medical Records Access Act.
Resident Bill Of Rights #3 A resident is entitled to confidential treatment of personal and medical records, and the resident may refuse to release their medical records to a person outside the health facility except as required because of a transfer to another health care facility as required by law or third party payment contract, or as permitted or required under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191 or regulations promulgated under that Act, 45 CFR parts 160 and 164. With the permission of the nursing home representative the State Long Term Care Ombudsman my examine the patient’s medical record.
Resident Bill Of Rights #4 A resident is entitled to privacy, to the extent feasible, in medical treatment and in caring for personal needs with consideration, respect and full recognition of his or her dignity and individuality.
Resident Bill Of Rights #5 A resident is entitled to receive adequate and appropriate care. A home for the aged resident is entitled to receive from the appropriate individual within the facility information about his or her medical condition, proposed course of treatment, and prospects for recovery, in terms that the resident can understand, unless medically contraindicated as documented by the attending physician in the medical record.  A nursing home patient shall be fully informed in language he or she can understand of his or her total health status, including but not limited to, his or her medical condition, proposed course of treatment, and prospects for recovery.
Resident Bill Of Rights #6 The resident (or his or her authorized representative) is entitled to participate in planning his or her care and medical treatment.  A nursing home patient is entitled to information in advance about care and treatment and of any changes in that care and treatment that may affect the patient’s well-being. The nursing home resident is entitled to participate in determining changes in care and medical treatment, unless adjudicated in competent or otherwise found to be incapable under state law.
Resident Bill Of Rights #7 A resident is entitled to refuse treatment to the extent provided by law and be informed of the consequences of that refusal.
Resident Bill Of Rights #8 A resident (or his or her authorized representative) is entitled to information concerning an experimental procedure proposed as a part of his or her care and shall have the right to refuse to participate in the experiment without jeopardizing his or her continuing care.                           
Resident Bill Of Rights #9 A nursing home resident (or his/her authorized representative) is entitled to choose a personal attending physician and shall be informed of the name specialty and way of contacting the physician responsible for his or her care.
Resident Bill Of Rights #10 A resident (or his/her authorized representative) is entitled to know who is responsible for and who is providing his or her direct care, is entitled to receive information concerning his or her continuing health needs and alternatives for meeting those needs, and to be involved in his or her discharge planning, if appropriate.
Resident Bill Of Rights #11 Each nursing home patient shall be afforded the opportunity to discharge himself or herself from the nursing home.
Resident Bill Of Rights #12 A patient or resident (or his/her authorized representative) is entitled to receive and examine an explanation of his or her bill regardless of the source of payment and to receive, upon request, information relating to financial assistance available through the facility.
Resident Bill Of Rights #13 A resident (or his/her authorized representative) is entitled to exercise his or her rights as a resident and as a citizen, and to this end may present grievances or recommend changes in policies and services on behalf of himself or herself or others to the facility staff, to governmental officials, or to another person of his or her choice within or outside the facility, free from restraint interference, coercion, discrimination of reprisal.
Resident Bill Of Rights #14 A resident is entitled to associate and have private communications and consultation with his or her physician, attorney, visitors, family or resident groups or any other person of his or her choice. The resident may also choose to deny or withdraw consent at any time.
Resident Bill Of Rights #15 Each nursing home patient has the right to receive representatives of organizations as provided in the Michigan Public Health Code, A resident may receive information from agencies acting as client advocates and be afforded the opportunity for contacting these agencies.
Resident Bill Of Rights 16. A nursing home resident has the right to send and receive personal mail unopened on the same day it is received at the facility and is entitled access to stationery, postage and writing instruments at his or her own expense.  17. A resident is entitled to reasonable access to private use of a telephone where calls can be made without being overheard.  18. A resident's civil and religious liberties, including the right to independent personal decisions and the right to knowledge of available choices, shall not be infringed upon.
Residents Bill Of Rights 19. A resident is entitled to be free from mental, verbal, sexual or physical abuse, including corporal punishment or involuntary seclusion.  20. A resident is entitled to be free from physical and chemical restraints, except those restraints ordered in writing by the attending physician for a specified and limited time.  21. A nursing home resident has the right to self-administer drugs if the interdisciplinary team determines the practice is safe.
Residents Bill Of Rights 22. A resident is entitled to be free from performing services for the facility that are not included for therapeutic purposes in the plan of care.  23. A patient or resident (or his/her authorized representative) is entitled to information about their rights, the health facility rules and regulations affection resident care and conduct.  24. A nursing home resident has the right to receive a written notice prepared by the state of the rights and obligations of Medicaid patients, including the rights of the spouses of Medicaid patients.
Residents Bill Of Rights 25. A nursing home patient may be involuntarily transferred or discharged only as provided in Michigan Public Health Code or as provided by Medicare or Medicaid regulations.  26. The nursing home resident and resident representative or family member shall be promptly notified before there is a change in room or roommate assignment.  27. A resident (or his/her authorized representative) is entitled to be fully informed before or at the time of admission and periodically during his or her stay of items and services available in the facility and of related changes.
Residents Bill Of Rights 28. A resident (or his/her authorized representative) is entitled to manage his/her own financial affairs, or to have at least a quarterly accounting of personal financial transactions undertaken on his or her behalf by the facility during a period of time when the resident (or his/her authorized representative) has delegated those responsibilities to the facility.  29. If a husband and wife are residents in the same nursing home, the married couple is entitled to same a room, if both spouses consent.
Residents Bill Of Rights 30. A nursing home resident (or his/authorized representative) is entitled and encouraged to retain and use personal, appropriate clothing and possessions as space permits unless to do so would infringe upon the rights or health or safety of other patients. 31. Each resident shall be provided  with appetizing meals that meet the recommended dietary allowance for his or her age and sex that may be modified according to special dietary needs or ability to chew.  32. Resident smoking shall be in designated smoking areas only and in accordance with the facility’s smoking policy.
Residents Bill Of Rights 33. A nursing home patient has the right to examine the most recent survey of the facility conducted by federal or state surveyors and any plan of correction in effect with respect to the facility 34. Through public posting in the facility, a nursing home patient shall be provided with the names, addresses and telephone numbers of all pertinent state client advocacy groups.  35. A nursing home must consult with the patient immediately and notify the patient’s physician and, if known, the patient’s legal representative or interested family member when there is an accident, significant change, or a need to alter treatment significantly or a decision to transfer or discharge resident from the facility.
Residents Bill Of Rights 36. A nursing home, its owner, administrator, employee or representative shall not discharge, harass, retaliate or discriminate against a patient because the patient has exercised a right protected by Michigan Public Health.  37. A resident is entitled to adequate and appropriate pain and symptom management as a basic and essential element of his or her medical treatment.
Residents Bill Of Rights 38. A nursing home resident is entitled to be fully informed orally and in writing in language that he or she understands, as evidenced by his or her written acknowledgement before or at the time of admission and during his or her stay of the residents policy set forth in the Michigan Public Health Code and Social Security Act.  39. At the time of admission or at any time thereafter, a patient or resident shall have the right to designate a representative to act on his or her behalf.  40. A nursing home resident’s rights may be exercised by the patient’s representative within the scope of the designation.

  • 5. Resident Bill Of Rights #1 A patient or resident will not be denied appropriate care on the basis of race, religion, color, national origin, sex, age handicap, marital status, sexual preference or source of payment.
  • 6. Resident Bill Of Rights #2 An individual who is or has been a patient or resident, or a person authorized in writing by such an individual, is entitled to inspect or receive a copy, if any of his or her personal and /or medical record upon request in accordance with the Medical Record Access Act, 2004 PA 47, MCL 33.26261 to 33.26271. Except as otherwise permitted or required under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, or regulations promulgated under that Act, 45 CFR parts 160 and 164, a third party shall not be given a copy of the patient’s/resident’s medical record without prior authorization of the patient or resident. Fees for providing copies are governed by the Medical Records Access Act.

Resident Bill Of Rights #3 A resident is entitled to confidential treatment of personal and medical records, and the resident may refuse to release their medical records to a person outside the health facility except as required because of a transfer to another health care facility as required by law or third party payment contract, or as permitted or required under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191 or regulations promulgated under that Act, 45 CFR parts 160 and 164. With the permission of the nursing home representative the State Long Term Care Ombudsman my examine the patient’s medical record.
  • 8. Resident Bill Of Rights #4 A resident is entitled to privacy, to the extent feasible, in medical treatment and in caring for personal needs with consideration, respect and full recognition of his or her dignity and individuality.
  • 9. Resident Bill Of Rights #5 A resident is entitled to receive adequate and appropriate care. A home for the aged resident is entitled to receive from the appropriate individual within the facility information about his or her medical condition, proposed course of treatment, and prospects for recovery, in terms that the resident can understand, unless medically contraindicated as documented by the attending physician in the medical record. A nursing home patient shall be fully informed in language he or she can understand of his or her total health status, including but not limited to, his or her medical condition, proposed course of treatment, and prospects for recovery.
  • 10. Resident Bill Of Rights #6 The resident (or his or her authorized representative) is entitled to participate in planning his or her care and medical treatment. A nursing home patient is entitled to information in advance about care and treatment and of any changes in that care and treatment that may affect the patient’s well-being. The nursing home resident is entitled to participate in determining changes in care and medical treatment, unless adjudicated in competent or otherwise found to be incapable under state law.
  • 11. Resident Bill Of Rights #7 A resident is entitled to refuse treatment to the extent provided by law and be informed of the consequences of that refusal.
  • 12. Resident Bill Of Rights #8 A resident (or his or her authorized representative) is entitled to information concerning an experimental procedure proposed as a part of his or her care and shall have the right to refuse to participate in the experiment without jeopardizing his or her continuing care.                       
  • 13. Resident Bill Of Rights #9 A nursing home resident (or his/her authorized representative) is entitled to choose a personal attending physician and shall be informed of the name specialty and way of contacting the physician responsible for his or her care.
  • 14. Resident Bill Of Rights #10 A resident (or his/her authorized representative) is entitled to know who is responsible for and who is providing his or her direct care, is entitled to receive information concerning his or her continuing health needs and alternatives for meeting those needs, and to be involved in his or her discharge planning, if appropriate.
  • 15. Resident Bill Of Rights #11 Each nursing home patient shall be afforded the opportunity to discharge himself or herself from the nursing home.
  • 16. Resident Bill Of Rights #12 A patient or resident (or his/her authorized representative) is entitled to receive and examine an explanation of his or her bill regardless of the source of payment and to receive, upon request, information relating to financial assistance available through the facility.
  • 17. Resident Bill Of Rights #13 A resident (or his/her authorized representative) is entitled to exercise his or her rights as a resident and as a citizen, and to this end may present grievances or recommend changes in policies and services on behalf of himself or herself or others to the facility staff, to governmental officials, or to another person of his or her choice within or outside the facility, free from restraint interference, coercion, discrimination of reprisal.
  • 18. Resident Bill Of Rights #14 A resident is entitled to associate and have private communications and consultation with his or her physician, attorney, visitors, family or resident groups or any other person of his or her choice. The resident may also choose to deny or withdraw consent at any time.
  • 19. Resident Bill Of Rights #15 Each nursing home patient has the right to receive representatives of organizations as provided in the Michigan Public Health Code, A resident may receive information from agencies acting as client advocates and be afforded the opportunity for contacting these agencies.
  • 20. Resident Bill Of Rights 16. A nursing home resident has the right to send and receive personal mail unopened on the same day it is received at the facility and is entitled access to stationery, postage and writing instruments at his or her own expense. 17. A resident is entitled to reasonable access to private use of a telephone where calls can be made without being overheard. 18. A resident's civil and religious liberties, including the right to independent personal decisions and the right to knowledge of available choices, shall not be infringed upon.
  • 21. Residents Bill Of Rights 19. A resident is entitled to be free from mental, verbal, sexual or physical abuse, including corporal punishment or involuntary seclusion. 20. A resident is entitled to be free from physical and chemical restraints, except those restraints ordered in writing by the attending physician for a specified and limited time. 21. A nursing home resident has the right to self-administer drugs if the interdisciplinary team determines the practice is safe.
  • 22. Residents Bill Of Rights 22. A resident is entitled to be free from performing services for the facility that are not included for therapeutic purposes in the plan of care. 23. A patient or resident (or his/her authorized representative) is entitled to information about their rights, the health facility rules and regulations affection resident care and conduct. 24. A nursing home resident has the right to receive a written notice prepared by the state of the rights and obligations of Medicaid patients, including the rights of the spouses of Medicaid patients.
  • 23. Residents Bill Of Rights 25. A nursing home patient may be involuntarily transferred or discharged only as provided in Michigan Public Health Code or as provided by Medicare or Medicaid regulations. 26. The nursing home resident and resident representative or family member shall be promptly notified before there is a change in room or roommate assignment. 27. A resident (or his/her authorized representative) is entitled to be fully informed before or at the time of admission and periodically during his or her stay of items and services available in the facility and of related changes.
  • 24. Residents Bill Of Rights 28. A resident (or his/her authorized representative) is entitled to manage his/her own financial affairs, or to have at least a quarterly accounting of personal financial transactions undertaken on his or her behalf by the facility during a period of time when the resident (or his/her authorized representative) has delegated those responsibilities to the facility. 29. If a husband and wife are residents in the same nursing home, the married couple is entitled to same a room, if both spouses consent.
  • 25. Residents Bill Of Rights 30. A nursing home resident (or his/authorized representative) is entitled and encouraged to retain and use personal, appropriate clothing and possessions as space permits unless to do so would infringe upon the rights or health or safety of other patients. 31. Each resident shall be provided with appetizing meals that meet the recommended dietary allowance for his or her age and sex that may be modified according to special dietary needs or ability to chew. 32. Resident smoking shall be in designated smoking areas only and in accordance with the facility’s smoking policy.
  • 26. Residents Bill Of Rights 33. A nursing home patient has the right to examine the most recent survey of the facility conducted by federal or state surveyors and any plan of correction in effect with respect to the facility 34. Through public posting in the facility, a nursing home patient shall be provided with the names, addresses and telephone numbers of all pertinent state client advocacy groups. 35. A nursing home must consult with the patient immediately and notify the patient’s physician and, if known, the patient’s legal representative or interested family member when there is an accident, significant change, or a need to alter treatment significantly or a decision to transfer or discharge resident from the facility.
  • 27. Residents Bill Of Rights 36. A nursing home, its owner, administrator, employee or representative shall not discharge, harass, retaliate or discriminate against a patient because the patient has exercised a right protected by Michigan Public Health. 37. A resident is entitled to adequate and appropriate pain and symptom management as a basic and essential element of his or her medical treatment.

A nursing home resident is entitled to be fully informed orally and in writing in language that he or she understands, as evidenced by his or her written acknowledgement before or at the time of admission and during his or her stay of the residents policy set forth in the Michigan Public Health Code and Social Security Act. 39. At the time of admission or at any time thereafter, a patient or resident shall have the right to designate a representative to act on his or her behalf. 40. A nursing home resident’s rights may be exercised by the patient’s representative within the scope of the designation.
