2. Incident Mark was playing 5-aside-footballl at the leisure centre when he fell over a bench that was left out. He badly fell on his right arm causing it to break, he also had small cut above his eye and his shin was heavily bruised.

4. Arguement For Getting Compensation His Solicitor said he should claim for damages against the leisure centre. His case would be on a ‘no win, no fee’ basis, if his case did not succeed he would not have to pay his fee’s but would most probably have to pay the other side’s fee’s. His solicitor would have to prove that the leisure centre had ignored there responsibility to make the sport’s hall a safe place and this is what caused his injuries.
5. Against His Case The Local Authority lawyer defends the side being sued, there aim is to stop there client being sued.
6. Verdict I believe that he shouldn’t receive compensation because he saw the bench and ignored that fact that it could cause someone an injury.
