Dear Mr President,
The European Union is strongly supporting Ukraine's efforts to reform its energy markets,
including strengthening the independence and authority of the National Energy and Utilities
Regulation Commission (NEURC). Therefore, we have very much welcomed the adoption of the
Law on the Energy Regulator, which was one of the measures allowing the EU to provide
another €600 million of macro-financial assistance to Ukraine.
It is, therefore, now important that the implementation of this important law starts without
any further delay. The controversies about recent decisions of the Energy Regulator, notably on
the methodologies for setting coal prices and for calculating access fees to the electricity grid,
show how important not only the independence but also the professionalism and credibility of
the Energy Regulator is for ensuring urgently needed investments for Ukraine's economy.
The EU has offered support and expertise to the Energy Regulator, which has so far been barely
used. An analysis of these recent decisions by EU experts has shown that unfortunately the
methodologies used do not fully correspond to best European practice.
As a concrete step to reinforce trust in the Energy Regulator, I hope you will ensure the
implementation of the Law on the Energy Regulator by establishing the Competition
Commission foreseen in article 8 and to nominate the two members under your quota at the
earliest possible moment. I am confident that the Cabinet of Ministers and the Parliament will
follow suit with their nominations.
Let me once again assure you my strong support to Ukrainian reforms and I am looking forward
to continuing our close co-operation to ensure the success of Ukraine's energy reforms.
