Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

destruindo,danificandooudesarranjando,total ouparcialmente,

desastre ferroviárioe nãoo desastre emsi mesmo,umavezque o §
1ºdeste artigojá contemplatal modalidade criminosa.A açãodo
agente,obviamente,deve acarretarapossibilidadeconcretade dano
a um númeroindeterminadode pessoase coisas,poisestamosdiante
de um crime de perigocomum.Desse modo,ofato deve revestir-se
de certa extensãoe gravidade3.Ausente operigoconcretode dano,o
fatotípico não se configura4.

Trata-se de crime comum. Qualquerpessoapode praticá-lo.

É a coletividade emgeral.

É o dolo,consubstanciadonavontade livre e conscientede

desastre.Odolo,portanto,é de perigoe não de dano, poiso agente

perigode desastre.Emque instante se pode dizerque asituaçãode
perigofoi criada?AfirmaHungria:“DizJachinoque ele ocorre

por meiode umadas ações previstasnotipopenal,cientede que
causa perigode desastre.Contudo,taisaçõesacabampor provocaro
eventodanoso(desastre),resultadomaisgrave que é imputadoao
agente a títulode culpa,uma vezque o efetivodanoeraprevisível.
Trata-se,portanto,de eventoimputadoaoagente atítulode
preterdolo.
Consumação e tentativa. Consuma-se ocrime como efetivo
desastre doqual resulte operigocomum.A tentativaé impossível,
poisestamosdiante de umdelitopreterdoloso.
6.3. Culposa
Prevê o§ 2º: “Nocaso de culpa,ocorrendodesastre:Pena —
detenção,de seismesesadoisanos”.Pune-se somenteodesastre

6.3. Majorada. Prática do crime com fim de lucro
Está previstano§ 2º: “Aplica-se,também, apenade multa,se o
agente praticao crime com intuitode obtervantagemeconômica,
para si oupara outrem”.Paraa incidênciadessamajorante
prescinde-se daefetivaobtençãode vantagemporparte doagente.
6.4. Culposa
Prevê o§ 2º: “Nocaso de culpa,se ocorre o sinistro:Pena —
detenção,de seismesesadoisanos”.Admite-se somentea
modalidade culposaquandoefetivamente ocorrerosinistroe não
quandoapenashouveroperigode sinistro.

exemplo,ônibus,embarcaçõeslacustresetc.Deve otransporte ser
necessariamente coletivo,aindaque pertencente aparticular.

Trata-se de crime comum. Qualquerpessoapode praticá-lo,
inclusive oproprietáriodotransporte público.

É a coletividade emgeral.

Essa modalidade estáprevistano§ 1º: “Se do fatoresulta
desastre,apenaé de reclusão,de doisa cincoanos”. Trata-se de
modalidade preterdolosa.Oagente quercausarumasituaçãode
perigo,noentantoacaba por provocaro resultadomaisgrave
(desastre),oqual lhe é imputadoatítulode culpa.
6.3. Culposa
Prevê o§ 2º: “Nocaso de culpa,se ocorre desastre:Pena —
detenção,de trêsmesesaum ano”.Admite-se somente a
modalidade culposaquandoefetivamente ocorrerodesastre e não
quandoapenashouveroperigode desastre.
6.4. Q ualificada peloresultado
Prevê oart. 263: “Se de qualquerdoscrimesprevistosnosarts.
260 a 262, no caso de desastre ousinistro,resultalesãocorporal ou

3.1. Ação nuclear
A condutatípica consiste em arremessar, istoé,lançar,atirar,de
formaviolenta,projétil.Este consiste nocorpocontundente que,ao
serlançado,é apto a causar perigode danoa pessoasoucoisas.Não
se consideracomotal o lançamentode ovoou tomate8,porexemplo.
SegundoHungria,háos projéteisespecificamente considerados

acidentalmente (pedras,paus,pedaçosde metal etc.).De acordo
com o mesmoautor,aos projéteistambémse equiparamoslíquidos

destinadoatransporte públicoe que estejaemmovimento,pois
nessascircunstânciasodanopode ser muitomaior.

Trata-se de crime de perigoabstrato,istoé,presumido.
Consuma-se comoarremessodoprojétil,nãosendonecessárioque
este atinjao veículo.A tentativaé inadmissível,poisocrime é
unissubsistente.

Determinaoparágrafoúnico:“Se do fatoresultalesãocorporal,
a penaé de detenção,de seismesesadoisanos;se resultamorte,a

crime preterdoloso.

a) Se o agente,mediante oempregode armade fogo,disparar
projéteiscontraveículode transporte coletivoque se encontraemvia
pública,ofato poderáenquadrar-se noart.15 da Lei n. 10.826/2003,
cujoteor é o seguinte:“Disparararma de fogoou acionarmunição
emlocal habitadoou emsuas adjacências,emviapúblicaouem
direçãoa ela,desde que essacondutanãotenhacomo finalidadea
prática de outro crime”.Trata-se tambémde crime de perigo
coletivo,cujapenaé maisgrave:de 2 a 4 anos de reclusãoe multa.
b) Se o agente realizaroarremessode projétil comaintenção
de matar ou lesionarpessoadeterminadadentrode transporte
coletivo,ocrime seráoutro:arts. 121 ou 129 do CP.

3. ELEMENTOS DO TIPO
3.1. Ação nuclear
A condutaconsiste em atentarcontraa segurançaou o
funcionamentodosserviçospúblicos(serviçode água,luz,forçaou
calor,gás, limpeza).Oagente,comsuaconduta,colocaem riscoa
prestaçãodo serviçopúblico.Oatentado,afirmaNoronha,“quandoé
contra a segurança,torna incertae inseguraarealizaçãodoserviço;
quandovisaao funcionamento,objetivaasuacessação;em ambas
as hipóteseshavendoperigo”10.Exemplo:danificarreservatóriode
água ou postesde luz.Se o agente empregarfogoouexplosivo,o
crime será outro:arts. 250 ou 251 do CódigoPenal.
3.2. Sujeitoativo
Trata-se de crime comum. Qualquerpessoapode praticá-lo.
3.3. Sujeitopassivo
É a coletividade emgeral.
4. ELEMENTO SUBJETIVO

Apesarde nemsempre a interrupçãoouperturbaçãode serviço
telegráficooutelefônicocausarperigocomum, oCódigoPenal ainda
assimoptoupor tutelar“o interesse coletivonaregularidadee
normalidade dosserviçosde telecomunicações,cujainterrupçãoou
perturbaçãopode causar perigocomum”11.

Consubstancia-senosverbos:a) interromper(paralisar,fazer

não os expressamenteelencadosnotipopenal.Nãose admite,
portanto,a analogia.SegundoHungria,“telégrafo é todainstalação
que possibilitaacomunicaçãodopensamentoouda palavra
mediante transmissãoàdistânciade sinaisconvencionais.
Compreende otelégrafoelétrico(terrestreousubmarino) ou
semafórico.Radiotelégrafo é otelégrafosemfio,funcionandopor
meiode ondaseletromagnéticasou‘ondasdirigidas’.Telefoneé a
instalaçãoque permite reproduziràdistânciaapalavra faladaou
outro som”12.
É imprescindívelque apráticadas ações típicas(interromper,
perturbar,impedir,dificultar) possaviracausar perigoa todoo
sistemade telecomunicação,poisse tratade crime de perigo
comum. Caso hajao impedimentode comunicaçãoouconversação
entre duaspessoas,ocrime será doart. 151, § 1º, III,do Código
Penal.

Trata-se de crime comum. Qualquerpessoapode praticá-lo.
