July 2010 Introduction In India, the last quarter of the 20th century has been witness to a growing recognition of the place and relevance of human rights due to pressure from various social movements. It is axiomatic that this interest in human rights is rooted in the denial of life and liberty that was a pervasive aspect of the Emergency (1975-77). The mass arrests of the leaders of the opposition and the targeted apprehension of those who could present a challenge to an authoritarian state are one of the dominant images that have survived. The involuntary disappearance of Rajan in Kerala is more than a symbol of the excesses of unbridled power. Forced evictions carried out in Delhi in what is known as ‘Turkman Gate’ conjures up visions of large scale razing of dwellings of those without economic clout, and of their displacement into what were the outlying areas of the city. The catastrophic programme of barbaric mass sterilisation is an indelible part of emergency memory. The civil liberties movement was a product of the emergency. Arbitrary detention, custodial violence, prisons and the use of the judicial process were on the agenda of the civil liberties movement. For past 3 decades, Peasant movements, tribal movements, dalit movements, backward caste movements, women's movements, working class movements, students' movements, middle class movements and environmental movements have highlighted human rights concerns (Shah, 2004).

Gujjar Tribals constitute the prime share of tribal population of union territory of Jammu and Kashmir. Gujjar being the most populous tribe constitutes the 69.1% of total Scheduled Population of Jammu and Kashmir. The Gujjar Tribals have been accorded tribal status under ‘Constitution (Scheduled Tribes) Order (Amendment) Act, 1991’. They are living a pathetic life and are socially-economically backward as compared to the general population of Jammu and Kashmir. The prevalence of discrimination and exclusion of the marginalized communities since the historical times remained the debatable issue to remedy it. Accordingly, Constitution of Independent India has enabled the nation to focus on the protection of distinctive way of life of ST’s and protect them from social injustices and all forms of exploitation and discrimination. The governments at central and state level have also made bold attempts to bring the inclusion of this backward community in the mainstream. Accordingly, various inclusive policies in terms of education, health, employment were put in place to bring the stop of their marginalization. The present paper intends to explore the various policies and to gauge their impact on the tribal population of Jammu and Kashmir in general and Gujjar Tribals in particular. The nature of the study is qualitative and secondary sources of data including census 2011 report and reports of Ministry of Tribal Affairs is the main stay of this study.

The Hindu centre for Politics and Public Policy is an offshoot of the Hindu publications group. It aims at promoting research and debates on public institutions delivery and policy frameworks. The report describes the processes – and the politics – that led to the creation of ‘Other Traditional Forest Dwellers’ (OTFDs), which includes forest-dwelling Dalits. The report explores the limitations of the Act, which precludes forest-dwelling Dalit communities from accessing their rights and forest resources. The report also documents movements of resistance by Dalit forest dwellers and Adivasis in Chitrakoot and Sonbhadra districts of Uttar Pradesh, and Kandhamal district of Odisha. At times, there were conflicts between Dalits and the scheduled tribes (STs); at other times, they came together to fight for their rights. The report suggests amendments to the Forest Rights Act and caste-sensitive strategies that recognise the rights of these communities.
