Introducing Historic Environment Scotland (HES) and discussing how changes in attitude towards derived data through the Exemption process (and Presumption to Publish) have enabled HES data to be provided as Open Data from the Canmore and PastMap websites.

• Concerns over OS terms and conditions

which we reasonably believe may have accessed such IPR from your End User Licensing,

pursuing and/or remedying any such infringement or breach, including, in particular,
identifying relevant Internet Protocol addresses, details of what Licensed Data
has been supplied, dates of supply…
• Help deliver our core business - to understand, protect and value the Historic Environment
o Widen digital access to information on Scotland’s places
o Part of an interactive and an integral part of the world-wide network of cultural heritage data.
o Achieve further efficiency, effectiveness and sustainability in the use of government resources
• To publish INSPIRE related datasets as WMS and WFS
• Existing contractor and end user licenses limited what could be done with data
• Exempted data should remove the need for user registration

supports the Government's transparency agenda and will
allow members of the public sector agreements to publish
more of their derived data on Open Data terms.
You do not need to keep records when you are making your
derived data available on Open Data terms.
You just need to have notified us about the derived data you
are making available in that manner.
There are some circumstances when records will be
required, such as when you are providing Licensed Data to
others by other routes

The new download function for CANMORE data, in GIS-
ready formats, has made developing thematic mapping or
illustrating specific aspects of the historic environment a
much more rapid and relatively painless task. In
combination with other open access geographic and
geological resources it is a valuable tool and facilitates
education and dissemination of complex cultural heritage
datasets to specialists, students and members of the
public alike.
