Tristan’s location at the time of the shooting (#1) is undisputed, and is also substantiated by the video of the shooting’s aftermath. According to the case file, two relevant Border Police crews were deployed in Ni’ilin at the time of the shooting – one behind the mosque, very close to the center of the village (#2) and one about 150 meters away from where Tristan was standing.
The case file states that at the time of the shooting clashes took place at a location called the “Antenna Hill”, where the 2nd Border Police crew was located. The civilian eyewitnesses corroborate the fact that clashes did occur in the vicinity of the “Antenna Hill” and the presence of a Border Police crew there, but place Tristan’s shooters elsewhere, where the 1st Border Police crew was positioned.
According to the civilian eyewitnesses, the shooter stood roughly 30 to 60 meters from Tristan, on a hill, and had a direct line of fire.

This picture was taken from where Tristan was standing at the time he was shot, and shows that the shooters had a clear line of fire.

The investigation file has two conflicting sets of testimonies - those of Border Police officers that the police identified as the shooters, and those of the civilian eyewitnesses - Palestinians and internationals. While Red Crescent notes from that date record three injuries, the questioned Border Police officers only attested seeing two people injured.
This picture was taken from exact location where Tristan was shot in. While the civilian eye witnesses place the shooters here (circled), the Border Police officers placed themselves in a place they referred to as the “Antenna Hill”, indicated by the arrow.
As this picture, which was taken from the “Antenna Hill”, shows – there is absolutely no line of sight between the two locations, and therefore no line of fire.
