For more than three decades, Jeffrey Feyko has worked as an administrative hearing officer, solicitor, and attorney in Fairfield County, Ohio. Jeffrey Feyko concentrates his practice in estate law, probate, and will execution. Individuals can choose to disinherit certain family members by leaving the person out of their will. However, Ohio law has special rules in place to prevent this from happening to surviving spouses. If the testator explicitly leaves the spouse out of their will or leaves a smaller portion than expected, the spouse has the right to take legal action against the will. Generally, spouses are entitled to half of their spouse's estate. The only exception is if the testator has two or more children or direct descendants like grandchildren. However, the spouse is still entitled to at least a third of the remaining estate. Spouses can also remain in the primary residence a year after their spouse’s passing. In many cases, the spouse also has the right to inherit the home and up to two automobiles, under certain conditions. Surviving spouses can also receive a support allowance, which is capped at $40,000. Spouses who want to contest the will must file with the probate court within a specific time frame - otherwise, these rights are no longer valid.

One of the primary objectives of the HWLS Human Rights Law Clinic is to help the general public to understand how the law works and how it can protect average person. In our first "Know The Law" video, we explain the basics of how a divorce can be obtained in Trinidad and Tobago. The law on this area is set-out in the Matrimonial Proceedings and Property Act Chap 45:51. A divorce petition cannot be presented until one year of marriage has passed, unless there are extreme circumstances. This information is not intended to give legal advice. In April 2013, the Senate ‘Gang of Eight’ released its proposal for overhauling our nation’s immigration system. Call the Border Security, Economic Opportunity, and Immigration Modernization Act of 2013 (s.744), this bill proposes to eliminate the current immigration backlog, create new visa categories for high-skilled and skilled workers, overhaul our green card application system, and address the statuses of approximately 11 million undocumented workers in the United States. Although only a bill at this point, this is the first serious effort by a bi-partisan group to address the immigration program in quite some time. In this informative webinar, attorneys Murali Bashyam and Ame Coats will educate the public on the bill and what they can expect if it, or something similar, is ultimately passed by Congress and signed by the President.

The New Senate Immigration Reform Bill

Effective March 4, 2013, the Department of Homeland Security will begin a new process for adjudication of these waiver applications. Under the new process, certain foreign spouses delay returning to their home country until a “provisional waiver” is approved in the U.S. The new process will drastically reduce the amount of time that the foreign spouse has to remain in his or her home country. Hopefully, the new process will also provide some measure of confidence that the foreign spouse will indeed return to the US.
