The dangers of police work were evident in a tragic incident involving a 21-year old
student of Hofstra University who was fatally shot by a police officer while he was
aiming at the person holding the student at gunpoint in May, 2013. After a thorough
investigation, New York’s Nassau County District Attorney’s office declared the officer
to be innocent of any malicious intentions and also that he had acted in a manner
appropriate to situations involving danger to the victim and himself.
Strangest of Strange Cases
Andrea Rebello of Hofstra University was staying with her twin sister and two others in
an independent home. The suspect, 30-year old Delton Smith, was wearing a ski mask
and hoodie when he intruded into their home demanding that they pay up the dues they
owed to someone. Four people in the house, including Rebello, were forced to the upper
floor. There, Smith demanded they hand over their valuables and some electronic devices
while he sent one of Rebello’s roommates to fetch cash from an ATM. This roommate
took the opportunity to call 911.
Officer Nikolas Budimlic was one of the four officers to respond first. Only Budimlic
entered the home though, when Smith got hold of Rebello and held her at gunpoint.
Though Officer Budimlic kept commanding Smith to drop the gun, the latter refused
threatening to shoot at Rebello and Budimlic, pointing the gun at both intermittently.
Finally when Rebello turned, Smith’s body was more exposed leading Budilmic to fire a
succession of two shots. One of those, however, struck Rebello on the head behind the
right ear which was the fatal shot. Rebello was, by this time, released by Smith who
received six more shots from Budilmic and died.
Was the Officer Trigger-happy?
Though the incident appears to seem like the result of ruthlessness and carelessness on
the part of Budilmic, the District Attorney’s office has cleared him stating that he acted in
the way he did as a result of “threats of deadly force” made against him, Rebello and
others. That does not, however, take away the tragedy of the situation since, though
Rebello died as a result of the intrusion and threatening of Delton Smith, the direct cause
of her death was the shot fired by a law enforcement officer who was supposed to protect
her.
