There are no exceptions!
3. In 1996, the Health Insurance Portability and
Accountability Act or the HIPAA was endorsed by the U.S.
Congress. The HIPAA Privacy Rule, also called the
Standards for Privacy of Individually Identifiable Health
Information, provided the first nationally-recognizable
regulations for the use/disclosure of an individual's health
information.
Gives patients control over the use of their health
information
Strictly investigates compliance-related issues and holds
violators accountable with civil or criminal penalties for
violating the privacy of an individual's PHI
4. $100 for each violation; or $25,000 for identical
violations during a calendar year
For a violation in which the covered entity did not
know:$100 or more than $50,000 for each violation or
$1,500,000 for identical violations during a calendar
year. For repeat offenders the fines are severe and you
could be imprisoned for up to 10 years.
It can lead up to and include termination from your job.
Remember patient privacy is a right!
5. The Health Information Technology for Economic and
Clinical Health (HITECH) Act, was designed to modernize
the health care system by promoting and expanding the
adoption of health information technology (HIT). HITECH
supports the rapid adoption of health information
technology by hospitals and clinicians of the Electronic
Health Record (EHR).
Gives incentives to offset cost of integration as well as
offer technical assistance to providers.
You are no longer protected by the organization.
You violate the law you can also be fined and face jail time.
6. Civil penalties for willful neglect (violations of patient
privacy) are increased under the HITECH Act. These
penalties can extend up to $250,000, with
repeat/uncorrected violations extending up to $1.5
million
Furthermore, under certain conditions HIPAA's civil
and criminal penalties now extend to business
associates. This means you!
Remember no matter who the patient is, if you don’t
require access to the record then don’t access it!
