2. www.epsiplatform.com After 5.5 years of activity of implementing the EU PSI Re-use Directive 2003/98/EC (November 2003 to May 2009) Europe is still under achieving with respect to Re-using Public Sector Information! (whether that be for profit or not for profit) SO WHAT CAN WE ALL DO TO TURN THIS AROUND? (June 2009 to June 2012) PSI Leadership – The role of Member States

3. One of the reasons given as to why the opportunity offered by the PSI Re-use framework has not been maximised is lack of awareness. So let us consider how this can be addressed and what the role of the Member States should be in this context! (Based on the accumulated knowledge gained so far in implementing the PSI Re-use Directive) This issue is not unique to the PSI Re-use Directive 2003/98/EC The same issue applies to other data & information related Directives such as: the Data Protection Directive 95/46/EC The recent European Conference 20 May 2009 titled: “ Personal data – more use, more protection?” So what good practices can we pick from the Data Protection domain? 4. www.epsiplatform.com PSI Leadership – The role of Member States Public Sector PSI Re-users The Actors Their role To facilitate the opportunity To grasp the opportunity and to innovate Supply side Demand side A large number of public bodies Many are large A large number of employees But They are quantifiable And many are similar A very large number of PSI re-users Many are micro or small But They are not quantifiable And they are not similar What do we Know about Each side? So what is the Solution? To focus on the Supply side as it is a known entity over the next 3 years To pull through by example It is too early to focus on the demand side!

So the evidence so far indicates that the ideal solution is as shown www.epsiplatform.com If all Member States adopted the above approach there are spin off benefits at the pan European level PSI Leadership – The role of Member States Supply side Demand side Public Sector PSI Re-users A single lead body – policy lead - oversees Information policy, handles complaints amongst other activities An active national PSI information Portal Regulators Information Commissioner & Competition Regulator (a member of the ECN) (The Regulators have powers of enforcement on both the supply and demand sides)

8. Pan European benefits – a European PSI Re-use portal www.epsiplatform.com The evidence shows that within the EU27 Member States the above is partly built. Dynamic portals on PSI Re-use : The Commission, and Member States Belgium, France, Slovenia, Spain, UK Static portals on PSI Re-use : Austria, Germany, Ireland To mention just a few that are active and present to some degree. The Commission funded European PSI Platform is active and present. The above is similar to the European Competition Network The above is similar to the European Network of National Data Protection Commissioners There are similarities with the requirement within the INSPIRE Directive 2007/2/EC that came into force in all EU27 Member States on 15 th May 2009!
