We provide FREE advice regarding debt counselling and Debt Consolidation
Kim Armfield is our in-house attorney and Julie Duminy is our head
Counsellor. Kim started her career in 1989 in an attorneys debt collection
department and Julie was a pioneer in employment projects with the Land
Bank for many years.
Libertine Consultancy is a highly professional and effective company
regarding not only all types of personal debt but has expertise concerning
the affairs of the entire estate of the consumer. We are registered with the

Credit ClearanceCredit Clearance
This is the clearing of court Judgments in order to rehabilitate your credit
record or having adverse listings lifted from your account. A judgment is a
court order that is granted (in your absence) after summons has been
served on you and where you have not defended the action or made
suitable arrangements. As it is a court order that has been granted by a
court, it has to be set aside by the same court in order for it to be removed
from the record of the credit bureau.
The first step to a credit clearance is to do this report to see what must be
done to clear your record. Sometimes all that must be done to improve
your credit rating is to ensure that payments are made each month on
time.

Debt Management TeamDebt Management Team
Julie Duminy is the head consultant and has invaluable experience in
counselling, budgeting, seminars and all matters pertaining to debt.
Catherine De Boucherville is Julie’s assistant and often seems to have eight
capable hands and four mouthpieces. Kim Armfield is our in-house attorney
who jumps in when matters get legal, and Quintina Williams is her fiesty legal
assistant who has an answer to just about everything.

Business Rescue & TurnaroundBusiness Rescue & Turnaround
Business rescue was introduced by Chapter 6 of the Companies Act, 71 of
2008, as an alternative to judicial management and liquidation of a company.
It is a measure that should be adopted before the close corporation or
company is factually insolvent, as any proposed business plan must in
practice envisage the rescue and turnaround of the business.
As it can be a costly exercise to rescue a business, it is more ideally suited
for a company as opposed to a close corporation. It is furthermore our
experience that in many cases, the owner of a business simply needs an
objective viewpoint on how to re-assess the current business practices,
expenses and employment contracts.

Debt Review (Debt Counselling)Debt Review (Debt Counselling)
Debt counselling [debt review] is a form of debt consolidation in that one
payment is made for all creditors, but it is not a loan. It is a process that
has been created by the National Credit Act of 1995 and the process entails
the following:-
A Consumer who is struggling to maintain all his monthly payments will
apply to a Debt Counsellor on a prescribed form [called a Form 16];
Once the Consumer applies for debt review, the Debt Counsellor must
inform all the Creditors of this by means of a form called a Form 17.1, and
the notifies the National Credit Regulator ["N.C.R."] of the application.

Administration of EstatesAdministration of Estates
Administration of Estates is an alternative to debt review in that it is also a
formal process, but it offers far better protection against creditors claims. An
administration does not include the claims of secured creditors, i.e. a house
and car, and provision for these expenses forms part of your monthly budget.
A main difference between debt review and administration is that
administration is limited in the amount of debt that can go under
administration. Excluding your house and car payments, your total debt
cannot exceed R50,000.00 (with certain legal exceptions when "garnishee's"
are put under administration.

There are many ways to consolidate your debts In most cases you can
consolidate your debt into one lower affordable monthly payment by means
of a Debt Review, Voluntary Distribution (or Voluntary Mediation), and
Administration.
The only debt consolidation product that we do not offer is loans and we
campaign against making the unscrupulous micro-lenders rich at your
expense and from your hard earned money.
