Dear Admiral Locklear:
The entry of the uninvited electronic surveillance ship into the RIMPAC
Exercise is of concern to Admiral Harry B. Harris, Jr., Commander, U.S. Pacific
Fleet and United States Representative J. Randy Forbes, member of the United
States House Armed Services Committee and Chairman of the United States
House of Representatives Armed Services Subcommittee on Seapower and
Projection Forces. Reportedly, officials were monitoring the situation based on
the unavailability of legal precedent to turn away the uninvited warship.
The Uniform Interpretation of Rules of International Law Governing
Innocent Passage accompanying the Joint Statement by representatives of the
United States and the Union of Soviet Socialist Republics signed at Jackson Hole,
Wyoming on 23 September 1989 may be of application. Paragraph 7 states,
“If a warship engages in conduct which violates
such laws or regulations or renders its passage
not innocent and does not take corrective action
upon request, the coastal State may require it to
leave the territorial sea, as set forth in Article 30
of the Convention of 1982. In such case the
warship shall do so immediately.”

If as reported that the warship was operating beyond the territorial sea (12
miles, Presidential Proclamation No. 5928, December 27, 1988) the matter is one
of diplomacy.
While RIMPAC, underway, is far from the Asian Continent there is a
commonality to discussions being held by Secretary John Kerry and Secretary
Chuck Hagel with government officials and foreign ministers in China and
Japan. This incident, if not addressed, will become precedent in our foreign
relations policy with these nations.
The fact that this situation did not rise to an international incident is
attributable to the intuitive actions by Admiral Harris, the staff of U.S. Pacific
Fleet, the staff of U.S. Pacific Command and you.
