SUBJECT: A Resolution granting a two (2) year contract extension to TxTow Corp. dba
Texas Towing for vehicle towing and storage service

BACKGROUND INFORMATION
The City of Alamo Heights originally entered into a three (3) year contract on July 23,
2018 with TxTow Corp. dba Texas Towing for vehicle towing and storage service. A
provision to that contract allowed for a two (2) year extension provided performance
reviews indicated “satisfactory contract performance”. Resolution 2018R-101 also
provides for a two (2) year extension for such services upon approval of the City Council.
The City of Alamo Heights has enjoyed an exceptional relationship since 2013 with
TxTow Corp. dba Texas Towing who has fulfilled all the provisions of the contract.
Scheduled inspections of the storage facility as well as the required insurance policies
and required licenses for the storage facility, tow truck operators and storage facility
personnel have been conducted by the Deputy Chief Cindy Pruitt after twelve (12)
months and as recent as May 3, 2021. These inspections confirm TxTow Corp. dba Texas
Towing meets or exceeds all requirements of the existing contract in force and oversight
regulatory agencies, to include the Texas Transportation Code, Texas Occupations Code,
Texas Towing Act, Texas Department of Transportation, and the Texas Department of
Licensing and Regulation.
The Chief of Police has not received any complaints regarding service or loss during the
term of the existing contract. All revenues due to the City as stipulated in the contract
have been paid monthly as required.
Staff is seeking approval of the proposed Resolution authorizing the City Manager to
execute a two (2) year contract extension with TxTow Corp. dba Texas Towing for
vehicle towing and storage services.
POLICY ANALYSIS
The proposed action is consistent with the City’s efforts to remediate accident scenes and
remove vehicles from roadways to prevent the obstruction of traffic and traffic hazards as
well as to provide for the safe storage of vehicles coming under our control until they are
claimed per the terms of the contract agreement.
2. FISCAL IMPACT
TxTow Corp. dba Texas Towing has accomplished 1,248 vehicle tows during the period
of July 2018 and March 2021. The agreed percentage paid to the City of Alamo Heights
during this period is $65,345.50.
TxTow Corp. dba Texas Towing is not proposing an increase in the 2018 fee schedule
charges for their services.
COORDINATION
The City Attorney has reviewed and approved the proposed Resolution.

RESOLUTION NO. 2021R-131
A RESOLUTION AWARDING A TWO-YEAR EXTENSION OF A
CONTRACT TO TXTOW CORP. DBA TEXAS TOWING FOR
VEHICLE TOWING AND STORAGE SERVICE AND AUTHORIZING
THE CITY MANAGER TO EXECUTE SAID AMENDMENT.
WHEREAS, in 2018 the City of Alamo Heights (“City”) advertised for proposals from
qualified towing companies to provide vehicle towing and storage services and in July 2018,
the City determined that TxTow Corp. dba Texas Towing was the best qualified to provide
vehicle towing and storage services for the City of Alamo Heights and awarded Texas
Towing a three (3) year contract; and
WHEREAS, Section III of the Contract allowed for a two (2) year extension provided
performance reviews indicated satisfactory contract performance by Texas Towing; and
WHEREAS, the City has enjoyed an exceptional relationship since 2018 with Texas Towing
who has fulfilled all the provisions of the Contract and the scheduled inspections of the storage
facility has confirmed Texas Towing meets or exceeds all requirements of the existing contract
in force and oversight regulatory agencies, to include the Texas Transportation Code, Texas
Occupations Code, Texas Towing Act, Texas Department of Transportation, and the Texas
Department of Licensing and Regulation; and

NOW BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALAMO
HEIGHTS, TEXAS:
SECTION 1. AUTHORIZATION. The City Council authorizes the City Manager to execute
an amendment to extend the original contract with TxTow Corp. dba Texas Towing for
two (2) years, expiring on July 30, 2023 to provide towing services in the City in order
to remediate accident scenes and remove vehicles from roadways to prevent the obstruction of
traffic and traffic hazards.
SECTION 2. PUBLIC PURPOSE. The City Council finds the Resolution is in the public
interest and is necessary for the good governance of the City and to protect the health, safety and
good order of its citizens.
SECTION 3. INCORPORATING RECITALS. The City Council finds the recitals contained
in the preamble to this ordinance are true and correct and incorporates them as findings of fact.

SECTION 4. SEVERABILITY. If any section, subsection, sentence, clause or phrase of this
Resolution is for any reason held to be unconstitutional or illegal, such decision shall not affect
the validity of the remaining sections of this Resolution.
SECTION 5. EFFECTIVE DATE. This Resolution shall be effective upon approval by the City
Council.
