Consideration of an amendment to the contract with Vortex Services in the amount of $57,215.00
for change orders related to the sewer rehabilitation project for Ogden to near Olmos Basin Dam.
BACKGROUND INFORMATION
In the FY 2021-22 Budget, the City Council appropriated funding in the amount of $535,000 for
the purpose of rehabilitating a sewer main along Ogden, west through the Jack Judson Nature
Trails, and ending just before the San Antonio Water System (SAWS) outfall below the Olmos
Basin dam. The sewer rehabilitation would utilize a sewer pipebursting technique, where the
existing sewer pipe would be demolished underground and simultaneously replaced with new
sewer pipe.
The City’s engineering firm, Freese and Nichols, Inc. (FNI), was tasked with project design at a
cost of $39,900. Staff elected to utilize the Texas BuyBoard Cooperative (BuyBoard) in securing
competitive bids to perform the work. Freese and Nichols solicited bid requests to five BuyBoard
contractors offering sewer pipe bursting services. Two contractors responded with bids matching
bid specifications, and Council authorized a contract with Vortex Services on March 14, 2022 for
an amount of $373,215, plus a 5% contingency for a total of $391,825.
After the construction to replace the 0.4 miles of sanitary sewer was completed, post-construction
video footage and analysis identified a number of deficiencies in the rehabilitated sewer line,
namely areas where the pipe slope did not meet Texas Commission on Environmental Quality
(TCEQ) requirements and minimized the effectiveness of the sanitary sewer pipe. The proposed
change order includes point repairs in prioritized deficient areas via excavation at the surface.
Repairs will then be remedied and backfilled, returning the surface to its original condition.
The proposed change order to Vortex Services is $57,125, for an amended project amount of
$448,950. If the change order is authorized, the City Manager would authorize $10,000 to Freese
and Nichols for engineering for the change order construction, for an amended project amount of
$49,900. The total amended project cost of $498,850 remains within the original amount budgeted
for the project.
2. With approval of the change order, substantial completion of the improvements is anticipated by
the end of February 2023, with final completion by March 31, 2023.
POLICY ANALYSIS
After consultation with the city engineer (FNI), city attorney, city manager, and Vortex Services,
Council consideration is requested to amend the contract with Vortex to correct the deficiencies
identified in the replacement sewer main. Despite a larger size pipe, the deficiencies hinder the
pipe’s flow performance. The City’s engineer has concluded that the recommended repairs in the
proposed change order will be able to meet the TCEQ requirements, reduce the need for more
intensive and frequent maintenance of the sewer main throughout the useful life of the pipe, and
reduce the risk of odors being released in the project vicinity.
FISCAL IMPACT
The amendment to the contract with Vortex Services is in the amount of $57,125.00 for change
orders related to the sewer rehabilitation project to Ogden to near Olmos Basin Dam. If the
amendment is authorized, the City Manager will amend the contract with Freese and Nichols for
engineering services related to the change order repairs in an amount of $10,000.00. The total costs
associated with the change order and engineering support is $67,215.00. City Council appropriated
funding in the amount of $535,000.00 for a sewer main rehabilitation in the FY 2021-22 Budget.
Funding for the proposed change order and associated engineering expenses will use the project’s
unspent budgeted funds, the remainder of which will be carried forward into FY 2022-23.
The amounts for the original contract, the proposed amendment, and the total amended contract
amount for the sewer rehabilitation project are in the table below.

CONTRACTOR OBLIGATIONS: Contractor will perform the scope of work attached as Exhibit “A” and incorporated
herein by reference for all purposes (hereinafter referred to for all purposes in this Change Order as “Repair”).
The corrected pipe slopes within the Repair shall meet TCEQ requirements being max slope of 4.88% and min
slope of 0.20%. Contractor will leave the surface equal to (or better) than existing, including repairs or replacing
any streets, roads, curbs, paths, utilities, or landscaping damaged in conformance with City Ordinances and
construction standards. Contractor will perform the repair in conformance with the narrative attached as Exhibit
“B” attached hereto and incorporated herein by reference for all purposes (hereinafter referred to for all purposes
in this Change Order as the “Narrative”); however, in the event of a conflict between the Narrative and Repair or
this Change Order, the requirement stated in the Repair, Change Order and Contract will prevail. The Contractor
and City agree and acknowledge that the Repair is intended to be a complete, safe and operational project, and
Contractor will provide all materials, services and equipment expressly or implicitly included in the Repair and
Narrative to complete the Work for the compensation stated in this Change Order. Contractor will maintain bonds
and insurance during Repair per the Contract. All terms and provisions of the Contract Documents remain in effect

For corrections to pipe slopes, the corrected slopes must be uniform and comply with TCEQ Ch. 217
requirements for 12-inch pipe, which requires a minimum of 0.20% and a maximum of 4.88%.
Contractor shall meet all embedment and backfill requirements as specified in SAWS Standard
Specification Item No. 804. Contractor will also measure the corrected pipe slopes in accordance with
SAWS Standard Specification Item No. 848 and notify the Owner and Engineer of all recorded
measurements prior to backfill.
Contractor shall be responsible for restoring any above-grade disturbances in accordance with the
Contract Documents, including damages to the Judson Nature Trail. Any repairs to the Judson Nature
Trail will be in accordance with Specification 32 15 43 “Stalok® Paving Material Waterless Natural
Pavement for Pathways and Patios”.
Post-Construction Requirements:
Upon completion of all corrections, Contractor shall test and inspect the rehabilitated sanitary sewer
main in accordance with SAWS Standard Specification Item No. 849 and Item No. 866. The post-
construction televising shall include an inclination survey to verify all pipe slopes meet TCEQ Ch. 217
requirements. All other closeout procedures for the Project shall be in accordance with Specification 01
70 00 and Contract Documents.

The overall process will include evaluating information from your RFP#1 dated 10/25/22 to clearly define the areas to
address the critical sags. Our team will use a push camera inserted into the lines to visually verify the sags identified. All
proposed areas for correction areas will be communicated to Owner and Engineer for approval prior to start of work.
Any deviations to correction areas that differ from what’s specified in RFP #1 will be pointed out for approval. We will
excavate down on those areas to expose the pipe and then use survey equipment to improve the grade at those areas.
We will keep the push camera in the line to again visually verify those sags are being addressed. It is important to
clarify, this will help improve the flow characteristics of those sections of pipe but it will not completely realign the
entire length of the pipe as only open-cutting and relaying the entire line section would achieve this. There may be
areas where we will have to cut into the pipe and insert the push camera given the limiting constraints of the cable
available for push cameras but those areas will be reconnected using a full-circle stainless repair clamp identical to how
we joined sections of pipe during the pipe bursting process at entry and exit pit locations. Any cutting into the pipe will
be communicated to the Engineer and Owner for approval prior to work commencing.
In areas where we need to lift the pipe to remove sags, we will use crushed rock to bed the pipe and ensure the
alignment will not move. In areas where the pipe needs to be lowered, we will dig out under the pipe and again bed
with crushed rock to secure the alignment. Once we have improved the grade, we will measure the exposed pipe slope
using a grading rod and a level gauge. After confirmation of appropriate pipe slope, we will then begin backfilling with
native material in lifts to ensure proper compaction. Upon completion of this, we will do another post television
inspection w/ inclinometer to verify all areas identified have been sufficiently addressed.
It will be critical to have some field time decisions including inspections, engineering, and our crew management when
we encounter obstacles above the pipe the City of Alamo Heights may not want disturbed. This includes but may not be
limited to large trees, Staloc walking path material, and impacts to roadways.

This letter outlines Freese and Nichols, Inc. (FNI) construction review of the City of Alamo
Heights Ogden Lane Sanitary Sewer Rehabilitation Project (Project). The data sources used for
the review are summarized in Table 1-1.
The construction deficiencies for the rehabilitated sanitary sewer line are described in the
following sections. Photo evidence of these deficiencies are provided in Attachment A and are
sourced from Cleanview Resources LLC post-construction CCTV footage.
A post-construction inclination survey was provided by CUES, Inc. and is included as
Attachment B. The inclination survey includes notes from FNI highlighting the deficiency areas
based on post-construction CCTV footage.
