The core problems around cloud, telco and other providers who need to transfer data across borders are how to ensure compliance with an alphabet soup of general and sector-specific laws and regulations, and codes of practice, and legal judgements, and legal and procedural uncertainties, that differ in their details across so many jurisdictions.

8. (1) Ministry/Agency Mission Creep
• Ministry of Communications/ Information
/ Informatics / IT
• Department/Agency of Information
Technology
• Used to develop/regulate verticals and/or
sectors; now finding themselves in a
horizontal, agency-spanning role (“I am in
every single meeting where people
mention ICT”)
(4) Need for more interaction with stakeholders –
users/citizens, business community
• Selection, trust-building, engagement – time-consuming
and tiring – yet must be done in the face
of time-pressures
Increasingly complex environment
for policymaking in IT and
technologies like cloud computing
(2) Need for Inter-Agency Cooperation Busts
Established Institutional Silos
• Cybersecurity = Ministry of Defence, National
Security Agencies both domestic (inward) and
international (outward), Ministries in charge of
CII, Ministry of Comms/IT etc
• Very uncomfortable adjustment for
bureaucracies
(3) In many cases, may extend to intra-agency alignment

Cloud Data Regulations – Contribution on Reducing the Cost of
Compliance of Cross-Border Data Transfers (2014)
Policymakers
> Increase productivity of workforce
increase cloud adoption
> Create privacy policies for citizens
Citizens/SMEs
> (Potential) cloud computing users
Cloud/Telco Businesses
> Increase cloud adoption

SMEs/Businesses
Qns around liability and compliance: Who are the “data controllers”? Businesses who use data services, the
data vendor, the data protection officer? What is “sensitive data”? Who “owns” the data? V expensive to
comply across jurisdictions
13. ACCA’s
recommendations
for better cross-border
data flow
and trade policy
Recommendation 1: To align DPP frameworks
(across the region) – SG/Asia could lead this effort
– eg through presentation via APEC, WEF, WTO,
ASEAN etc
Recommendation 2: Call for classification for
different types od data – eg non-strategic data,
non-security-sensitive – while still recognising that
there is national security data that should be
protected
Recommendation 3: Bonded warehousing of data
model could be considered; “quarantine zone”

14. Managing Cloud:
A New
Multidisciplinary
Paradigm for
Policymakers
Multidisciplinary nature - consideration for technology as platform for
development and not just sectoral development
Well-rounded policy is a group goal, not just government policymakers – all
must play a part in the dialogue – businesses and government
Government policymakers must make a concerted and sustained effort to
engage and include interaction with stakeholders – such as representatives
from business community
“Pay attention to details, with ears on the ground; partner diverse players for superior
outcomes; partner Sectoral Leaders for better implementation” –Peter Ong, Head of the
Singapore Civil Service, 26 Mar 2014
Business community members should look for platforms to have their
views heard, such as via focus group discussions, or industry organisations
– such as the ACCA.
