RIGHTS OF BAILOR
• Right to claim damages (sec-151)
Bailor can recover damages from bailee if it is occur
due to negligence of bailee
E.G: A bailed some goods to B and it was stolen due to
negligence of B.A can recover loss to B
• Right to demand return of goods (sec-159)
The bailor can demand the return of good bailed as
soon as the purpose of bailment is accomplished
E.G: A give a car to B on rent for 5 days A can
demand to return of car after 5 days. If B does not
return car after5 days, A can claim damages
RIGHT TO CLAIM INCREASE (SEC-163)
The bailor is entitled to claim any increase or profit which may have
accrued from the goods bailed
E.G A bailed a cow to b fro safe custody cow give birth to calf. A can
demand cow along with calf
• Right to terminate the bailment (sec-153)
Bailor can terminate the bailment if bailee do not act according to
contract
E.G: A give the horse to B for his own riding B drive horse in carriage .A
can terminate the contract
• Right to sue (sec-180)
Bailor can sue the bailee if goods are not return as directed. Bailor can
take action for bailee negligence when bailee is guilty
E.G: A give piece of wood to B to make table due to negligence of B fire
broke out and destroy the wood. A can sue B for loss
TERMINATION OF BAILMENT
Expiry of time
If the contract of bailment is made for specific period of time. It
expire after the specified time period
E.G: A stores B’s oranges for 1 month after 1 month the bailment
terminates
Accomplished of purpose:
Bailment terminates as soon as the purpose is accomplished
E.G: a give his car to B for repair. B repair and give back to A
bailment is over
