following:
I. LACK OF JURISDICTION - reiterating and incorporating by reference said defense(s) as
set forth in Newsome’s pleadings in this instant Bankruptcy action:
There is authority that dismissal of a bankruptcy case does not
mandate dismissal of all pending adversary proceedings.
However, if an entity joined as a party in an adversary
proceeding raised the defense that the court lacks jurisdiction
over the subject matter and that defense is sustained, the court
must dismiss such entity from the adversary proceeding.
Fed.R.Bankr.P. 7019(1).
Mississippi Case: Rice v. McMullen, 43 So.2d 195 (Miss. 1949)
- A court must have jurisdiction of the subject matter and of the
person of the parties, to give validity to its final judgments,
orders and decrees, and legislature cannot under the Constitution
dispense with notice, actual or constructive.
Illinois Cent. R. Co. v. Mississippi Public Service Commission,
135 F.Supp. 304 (S.D.Miss.Jackson.Div.,1955) - “Judicial
power” is the legal right, ability and authority to hear and decide
a justifiable issue or controversy, and such power is ordinarily
vested in a court of justice.
U.S. Supreme Court Case: U.S. v. O'Grady, 89 U.S. 641(1874)
- “Jurisdiction” is the power to hear and determine a cause.
In re N.L.R.B., 58 S.Ct. 1001 (1938) - “Jurisdiction” means, in
one sense, the power to hear and determine the controversy
presented, but a court has “jurisdiction,” in another sense, to
determine whether such power is conferred upon it in the
circumstances disclosed, and if it finds such power is not
granted, it lacks “jurisdiction” of the subject matter and must
refrain from an adjudication of rights in connection therewith.
Other Court Cases: In re Jahelka, 2010 WL 5558990 (Bankr.,
2010) - Subject matter jurisdiction is threshold question in every
case.
In re AE Liquidation, Inc., 435 B.R. 894 (2010) - A motion to
dismiss for lack of subject matter jurisdiction challenges the
power of the federal court to hear a claim or case. Fed.Rules
Civ.Proc.Rule 12(b)(1), 28 U.S.C.A.
Issue of court's subject matter jurisdiction can be raised
in any manner, including on motion of one of the parties or by

1. Newsome DOES NOT waive her defense to the jurisdictional issue which arises
in this matter. Therefore, Newsome does not submit to the jurisdiction of this
Court. While the laws are clear that Newsome cannot waive jurisdictional rights,
she believes it is necessary to provide information regarding decisions of court(s)
on said issue(s):
In re Kirkland, 600 F.3d 310 (4th
Cir. 2010) - Subject matter
jurisdiction cannot be forfeited or waived, and can be raised by
party, or by court sua sponte, at any time prior to final judgment.
2. This instant pleading is submitted in good faith and has not been submitted for
purposes of delay, harassment, hindering proceedings, embarrassment,
obstructing the administration of justice, vexatious litigation, increasing the cost
of litigation, etc. and is filed to protect and preserve the rights of Newsome
secured/guaranteed under the United States Constitution and other laws of
the United States.
3. For the purposes of expedition, saving of time and minimize costs associated
with litigation, Newsome consolidate her motions/pleadings herein pursuant to
FRCP Rule 12(G) which states:

with any other motion allowed by this rule.
I. NOTIFICATION OF CONFLICT REGARDING JULY 23, 2015
HEARING - - REQUEST TO RESET
4. NOTIFICATION is hereby being served to advised this Court of Newsome’s
CONFLICT with the Date (July 23, 2015) and Time (1:30 p.m.) set by this Court
and her INABILITY to attend said hearing based on conflict.
5. Prior to this Court’s setting of hearing for July 23, 2015, Newsome already
having set engagement from July 17, 2015 thru August 1, 2015, and therefore,
will NOT be able to attend the July 23, 2015 Hearing set by this Court.
6. Due to the CRIMINAL/CIVIL violations in the setting of the first alleged June
10, 2015, which is in good faith QUESTIONED, said Hearing and DATE/TIME
is NOT to be considered and/or counted as being PROPER – i.e. this instant
request of Newsome is to be taken as the FIRST request for rescheduling as it
relates to be issues to be addressed at the Hearing(s).
7. This Court alleges to have NOTIFIED Newsome of a Hearing on June 10, 2015;
however, from the receipt of information regarding that hearing AFTER this
Court’s being NOTIFIED of her NON-RECEIPT of said hearing, a reasonable
mind may conclude that this Court FAILED to follow legal protocol in notifying
Newsome and may be engaging in FURTHER CONSPIRACY practices as well
as CRIMINAL/CIVIL violations for purposes of fulfilling its roles in
CONSPIRACIES leveled AGAINST Newsome.

8. The record evidence will support Newsome’s NOTIFYING of conspiracies
leveled AGAINST her as well as mentioning CONCERNS in the ANNA
LOUISE INN SCANDAL. In fact, AFTER seeing this Court’s OBSTRUCTION
OF JUSTICE and COMPROMISING of mail/FALSIFYING and PADDING
Docket in the ABUSE of the Judicial Process. . . , etc., Newsome decided to see
for herself what may be taking place with the ANNA LOUISE INN to see if
there is a CONNECTION with the JUNE 10, 2015 FALSE date asserted by this
Court alleged to have been set for a Hearing. Oh, what is this, a GRAND
OPENING of a NEW LOCATION for the Anna Louise Inn reported in the
News on or about June 9, 2015 – ONE DAY PRIOR to United States
Bankruptcy Court – Southern District of Mississippi’s Hearing in the Bankruptcy
Case for Debtor Ladye M Townsend!

Such FOOLISHNESS and IGNORANCE in the handling of this matter.
Moreover, information Newsome believes to be PERTINENT and RELEVANT
in that it WEIGHS on the INTEGRITY of this Court and its INABILITY to remain
IMPARTIAL in the handling of this Bankruptcy matter in its efforts to provide
DEBTOR Ladye M. Townsend, her Legal Counsel (Robert Re McRaney Jr. and
his Law Firm) and those with whom they CONSPIRE with an
UNDUE/UNLAWFUL and ILLEGAL advantage THROUGH SPECIAL FAVORS
that are ADVERSE to Newsome in the handling of this Bankruptcy matter.
9. Then on or about JUNE 22, 2015, here comes a Court (Hamilton County Court
Of Common Pleas) also ENGAGING in CRIMINAL/CIVIL violations for
purposes of providing the Law Firm of Baker Donelson Bearman Caldwell &
Berkowitz and its CLIENTS such as United States of America President Barack
Obama, Messina Staffing/Messina Management Systems, The Garretson Firm
Resolution Group and the FRONTING Law Firm being used to SHIELD Baker
Donelson’s ROLES in the ATTACKS on Newsome submitting a “NOTICE OF
LIEN” in their QUEST to keep the PUBLIC/WORLD in the DARK regarding
their RACIST and TERRORIST attacks on Newsome as well as the
PUBLIC/WORLD – i.e. Nations of Color; moreover, ON those who are
CHRISTIANS and/or MUSLIMS!
The June 22, 2015 DATE is also SIGNIFICANT to Newsome in that said date

U.S. v. Jimenez Recio, 123 S.Ct. 819 (2003) -
Essence of a conspiracy is an agreement to commit
an unlawful act.
Agreement to commit an unlawful act,
which constitutes the essence of a conspiracy, is a
distinct evil that may exist and be punished whether
or not the substantive crime ensues. Id.
Conspiracy poses a threat tothe public over
