5Causes of rejection
1) Lack of school or academic qualifications 
The foreign worker must have at least nine years of schooling, not forgetting the 
skilled labor whose practice involves specific academic education.
2) Lack of work experience 
The foreign worker must possess professional experience in similar functions. 
Depending on the situation, the required experience lenght may vary from 1 to 3 
years. There are, however, some exceptions and circumstances of exemption.
3) Lack of justification for hiring 
Brazilian law explicitly admits the purpose of protecting the domestic worker, so 
hiring a foreign worker must be justified in order to be shown that you are not 
neglecting a possible Brazilian candidate with equivalent profile.
4) Lack of brazilian employees 
The Brazilian labor law establishes the rule of proportionality between Brazilian and 
foreign workers, according to which, except for special cases and exceptions, for 
each foreign employee must have two Brazilians in the same company or 
establishment.
5) Low wage 
In the wake of the protection of the domestic labor force, the Ministry of Labor and 
Employment believes that the low wage to be paid to the foreign worker configures 
a situation of Brazilian manpower replacement.
