Dear Mr. MacIntosh,
Our office represents Mrs. Lauren Turner in the above referenced case. Mrs. Turner has
retained this office in regards to your efforts to collect payments for her automobile loan. Your
efforts of collection are in violation of the Collections Act, and we demand that they cease
immediately.
On May 10, 2011, Mrs. Turner signed a loan with your company to pay for the purchase
of an automobile. From the date of the loan until two months ago, she has paid, on time and in
full, every installment on the loan. For the past two months, due to the illness of her youngest
child, Mrs. Turner has been able to pay only one-half of the required monthly payment. She
contacted your office on the third of last month and informed the loan officer that for the next
three months she would be making reduced payments. She was informed that she should be
making full payments.
For the past three weeks, your collections department has telephoned Mrs. Turner after 7
p.m. six nights a week demanding full payment. In each instance, Mrs. Turner politely informed
the caller that she was paying all she can and requested that the calls cease. The calls have not
ceased.
The Collections Act provides that efforts to collect debts shall be made in a reasonable
manner. The state supreme court, in the case of Irons v. Collections, Inc., ruled that telephone
calls to a debtor’s residence after 7 p.m. or more frequently than three times a week are
unreasonable and violate the act if the debtor objects to the calls. Your office has contacted Mrs.
Turner after 7 p.m. six nights a week for the past three weeks. The calls have continued despite
Mrs. Turner’s objections and requests that they cease.
Your calls to Mrs. Turner are unreasonable and in violation of the Collections Act and
must cease immediately. If the calls do not cease, we will take the appropriate steps necessary to
obtain the relief provided in the act.
