Chapter 54
DIRECTORATE OF CIVIL RIGHTS ENFORCEMENT
INTRODUCTION
2089 The Civil Rights Enforcement Cell was created in Karnataka during the year 1974 with a
Superintendent of Police heading the same. Later in view of the importance of the Cell, the post
of a Deputy Inspector General of Police was created in order No.SWL 355 SSC 77 dated 4th
February, 1978 to head the Cell for the effective implementation of the provisions of the PCR Act
and also to achieve better overall control over the Superintendents of Police of the districts.
2090 The Cell was again expanded in G.O. No.SWC 154 SSC 79, dated 16th October 1980 by
creating Regional C.R.E. Cells at Bangalore, Mysore, Gulbarga and Belgaum for each of the four
Revenue Divisions. Subsequently, in G.O.No. HD 297 PEG 88 dated 4.1.1989 the Government
created the post of Inspector General of Police, C.R.E. Cell.
2091 Later the post of the Inspector General of Police was upgraded to the rank of Additional
Director General of Police and further during the year 1992 in Government Notification No. DPAR
175 SPS 92 dated 18-8-92 the post was further upgraded to the rank of Director General of
Police and the CRE Cell was redesignated as the Directorate of Civil Rights Enforcement. However
the post was reverted subsequently and currently this Unit is headed by an Officer of the rank of
Additional Director General of Police. (Appendix - XLIII)
After reorganisation the Directorate comprises of six regions each region being placed under the
charge of a Superintendent of Police.
FUNCTIONS
2092 The object behind the creation of this Unit originally was to bring about stricter enforcement
of the provisions of the PCR Act 1955, and to deal with the cases of harassment and atrocities
against the persons belonging to Scheduled Castes and Scheduled Tribes. The functions of this
Unit were further expanded during the year 1975 through a Government Order, which stipulated
that this Unit shall collect intelligence and the investigate into cases of :-
1) Violation of Government Orders pertaining to reservation of 18% posts,
2) Violation of Government Order pertaining to earmarking and utilisation of funds;
3) Violation of the provisions of Karnataka Land Grant Rules;
4) Violation of Government directions, relating to eviction from Gomal lands;
5) Violation of rules pertaining to grant of sites;
6) Wrongful alienation of the inam land and house sites;
7) Wrongful eviction of SCs/STs by the landlords;
8) Wrongful eviction of SC/STs by other communities and Government agencies;
9) Cases of production of false caste certificates;
10) Offences under Bonded Labour System Ordinance 1975;
11) Offences under Karnataka Debt Relief Order 1975;

12) All instances of mis-managements and misuse of grants pertaining to Social Welfare
Department;
13) Any other matters pertaining to violation of Constitutional Safeguards and protection to
SCs/STs and;
14) Any matter pertaining to violation of any law or rule aimed at the Welfare of the SCs/STs.
15) The implementation of Karnataka Scheduled Castes and Scheduled Tribes (Prohibition of
Transfer of certain lands) Act, 1978 which came into force on 1st January, 1979 was entrusted to
CRE Cell.
With the enactment of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act,
1989 the Constitutional provisions for the eradication of social disabilities and preventing
discrimination against the SC/ST were further buttressed and the Cell was entrusted with its
enforcement.
ORGANISATION
2093 The Directorate is headed by an Additional Director General of Police under whose overall
control an Inspector General of Police, a Deputy Inspector General of Police, a Superintendent of
Police, a Deputy Superintendent of Police and other ranks drawn from the civil Police function. The
Regional centres at the divisional headquarters are headed by Officers of the rank of
Superintendents of Police who function with the assistance of the required supporting staff.
DUTIES OF OFFICERS
ADDL.DIRECTOR GENERAL OF POLICE
2094 He will be in overall charge of the Directorate and implement all the schemes for which the
Directorate has been created. He will be responsible for assessing the functioning and proposing
reorganisation as and when it is required and formulating the policies that will be in tune with the
time and in conformity with the needs.
INSPECTOR GENERAL OF POLICE
2095 He will assist the Addl. Director General of Police in the functioning of the DCRE and
supervise the work of the DIG and other officers of the Directorate. He will visit the places of
important cases and ensure that there is perfect coordination between the Directorate and the
Unit Officers.
2096 DEPUTY INSPECTOR GENERAL OF POLICE AND SUPERINTENDENT OF POLICE
They will assist the Inspector General of Police and the Director in their work
2097 DEPUTY SUPERINTENDENT OF POLICE/ASST.SUPERINTENDENT OF POLICE
He will assist the Superintendent of Police in the functioning of the Directorate both in the office
and in the field. He will personally visit the scenes of occurrence in more important cases and
assist the district police. He will also take up cases for personal investigation/enquiry whenever
directed to do so.
2098. POLICE INSPECTORS
They will take up for personal investigation, cases entrusted to them and will conduct enquiries

into the petitions referred to them. They will submit case diaries promptly in cases entrusted to
them for investigation and such other returns as are prescribed from time to time by
Superintendent of Police/Deputy Inspector General of Police/Inspector General of Police and the
Director of the Directorate of Civil Rights Enforcement. They will carry out all other work assigned
to them for the effective enforcement of the Acts.
2099 SUB-INSPECTORS
The Sub-Inspectors will assist the Police Inspectors in investigation/enquiry conducted by
them. They will also be given cases for personal investigation. They will be deputed for
conducting enquiries into petitions and also for making confidential enquirie s. They will submit
their case diaries in cases personally investigated by them promptly to the Deputy
Superintendent of Police, Directorate of Civil Rights Enforcement. They will submit their reports of
enquiry into the petitions to the Director, Directorate of Civil Rights Enforcement through proper
channel.
2100 HEAD CONSTABLES/POLICE CONSTABLES
Head Constables and Police Constables of the Directorate will be utilised by the Officers of the
Directorate for normal field work like locating witnesses, intelligence duties, execution of process
and such other duties. They are part of the Directorate and should not be utilised as personal
orderlies.
DIARIES
2101. The Superintendent of Police will submit his monthly diary through the Deputy Inspector
General of Police to the Director of the Direactorate of Civil Rights Enforcement.
2102. The Deputy Superintendents of Police will submit their weekly diaries to the Deputy
Inspector General of Police through the Superintendent of Police of the Directorate of Civil Rights
Enforcement.
2103. The Police Inspectors/Sub-Inspectors will write weekly diaries and send a copy to the
Deputy Inspector General of Police, Directorate of Civil Rights Enforcement through the
Superintendent of Police, whether in headquarters or out in the field for investigation. The
remarks of the Deputy Inspector General of Police, Directorate of Civil Rights Enforcement on the
weekly diary will be communicated to the concerned Police Inspectors/Sub-Inspectors in the
memo form and compliance report obtained.
HEAD CONSTABLES AND POLICE CONSTALES NOTE BOOKS
2104. Head Constables and Police Constables will maintain note books to indicate the duties
performed by them each day and produce them for check by the Supervisory Officers.
POSTING OF OFFICERS TO THE CELL
2105. Posting of Police Officers and men to the Directorate will be made by the Director General
and Inspector General of Police and the internal postings will be effected by the Director of the
Directorate.
GENERAL
2106. 1) In major cases of atrocities on the persons belonging to the Scheduled
Castes/Scheduled Tribes and in such of those cases of serious nature under the P.C.R. Act, the

Director General and Inspector General of Police will entrust the investigation to the Directorate
of Civil Rights Enforcement.
2) The Officers of the Directorate have powers to investigate offences against the members of
Scheduled Castes and Scheduled Tribes made over to it by the State Government or the DG &
IGP on selective basis.
3) The Directorate of Civil Rights Enforcement should expeditiously investigate such cases and
finalise them, and if charge sheeted pursue them in the court of law vigorously.
4) The investigation will be under the supervision of the Inspector General of Police, Directorate
of Civil Rights Enforcement and under over all supervision of the Director of the Directorate.
5) In all cases where officers of the Cell take up investigation of cases from the local Police, they
will conduct investigation in toto, write case diaries, and send it to their the Deputy Inspector
General of Police, who will in turn transmit it to the Inspector General of Police/ Directorate of Civil
Rights Enforcement with his remarks. Copies of the case diaries will also be sent to the
jurisdictional Police and others as is done by the C.I.D. Officers.
6) Fortnightly reports on investigation of such cases should be put up to the Director.
7) In all cases of unnatural death of members of Scheduled Castes/Scheduled Tribes where the
complainant alleges murder and there is strong suspicion of homicide, the body should be
subjected to post-mortem examination by two Government Medical Officers.
8) Such cases also will be handed over to Directorate of Civil Rights Enforcement for investigation.
9) The Directorate of Civil Rights Enforcement will supervise and co-ordinate the work of all
agencies entrusted with the task of taking action on complaints of harassment, ill-treatment,
social boycott and atrocities, on the members of the Scheduled Castes/Scheduled Tribes and
enforcement of the Protection of the Civil Rights Act.
10) The jurisdiction of the Directorate will not only be confined to the complaints of cases coming
within the purview of the PCR Act as well as the Karnataka Scheduled Castes & Scheduled Tribes
(Prevention of Atrocities) Act, but will include all other complaints which fall under one or more of
the Acts and Laws mentioned in Order 2092.
11) The Directorate will take up for enquiry such complaints of harassment or atrocity against the
Scheduled Castes and the Scheduled Tribes or such complaints of this type wherein inaction by
the local Police is alleged as are referred to it by the Government/Director General and Inspector
General of Police/Inspector General of Police, Directorate of Civil Rights Enforcement.
12) The Directorate will call for reports of enquiry into complaints of harassment or atrocity
against the Schedule Castes and the Scheduled Tribes received by the Cell.
13) The Directorate will keep a watch over the cases under P.C.R. Act and SCs and STs
(Prevention of Atrocities) Act registered and investigated in the districts and give necessary
instructions in this connection. Further, the reports/ Radio messages/ T.P.Messages/ Fax
messages/ Grave Crime Reports and progress Reports will be sent by the Unit officers to the
Directorate. However, a copy of such reports and messages should be sent to the Chief Office
also.
14) The Directorate will review the judgements in the cases referred to above and take further
action as contemplated in order No.1576 of the Police Manual, Volume - II.

15) The Directorate will compile statistics relating to the cases registered under the P.C.R.Act and
the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Further, the Unit
Officers will send the monthly statements to the Cell and will send such other particulars or
reports as may be called for by the Addl. Director General of Police, Directorate of Civil Rights
Enforcement.
16) The Directorate will compile monthly review relating to the cases referred to in clause (13)
above and put up the same for information to the Director General of Police and the Government
and communicate their remarks or instructions to the Unit Officers.
17) The Directorate will keep a watch on officers and others who do not respect and execute the
laws and rules and who abet the offenders against the Scheduled Castes and the Scheduled
Tribes.
18) The Superintendent of Police of the Districts and the officers of the Directorate will co-
ordinate their efforts in such a manner as to avoid any friction or difficulty in their smooth
functioning.
19) For the purpose of investigation, enquiry or enforcement of the P.C.R. Act and Prevention of
Atrocities Act, all the Superintendents of Police will give full co-operations and provide all facilities
to the officers of the Directorate.
20) The creation of the Directorate in no way absolves the local police of their responsibility
regarding the enforcement of the PCR Act or taking action on the complaints of harassment or
atrocities against the Scheduled Castes and the Scheduled Tribes, and the local Police will
continue to attend to this work with all alertness, promptness and diligence.

  • 1. 7/18/13 Karnataka State Police www.ksp.gov.in/home/policemanual/ch54.php 1/5 Chapter 54 DIRECTORATE OF CIVIL RIGHTS ENFORCEMENT INTRODUCTION 2089 The Civil Rights Enforcement Cell was created in Karnataka during the year 1974 with a Superintendent of Police heading the same. Later in view of the importance of the Cell, the post of a Deputy Inspector General of Police was created in order No.SWL 355 SSC 77 dated 4th February, 1978 to head the Cell for the effective implementation of the provisions of the PCR Act and also to achieve better overall control over the Superintendents of Police of the districts. 2090 The Cell was again expanded in G.O. No.SWC 154 SSC 79, dated 16th October 1980 by creating Regional C.R.E. Cells at Bangalore, Mysore, Gulbarga and Belgaum for each of the four Revenue Divisions. Subsequently, in G.O.No. HD 297 PEG 88 dated 4.1.1989 the Government created the post of Inspector General of Police, C.R.E. Cell. 2091 Later the post of the Inspector General of Police was upgraded to the rank of Additional Director General of Police and further during the year 1992 in Government Notification No. DPAR 175 SPS 92 dated 18-8-92 the post was further upgraded to the rank of Director General of Police and the CRE Cell was redesignated as the Directorate of Civil Rights Enforcement. However the post was reverted subsequently and currently this Unit is headed by an Officer of the rank of Additional Director General of Police. (Appendix - XLIII) After reorganisation the Directorate comprises of six regions each region being placed under the charge of a Superintendent of Police. FUNCTIONS 2092 The object behind the creation of this Unit originally was to bring about stricter enforcement of the provisions of the PCR Act 1955, and to deal with the cases of harassment and atrocities against the persons belonging to Scheduled Castes and Scheduled Tribes. The functions of this Unit were further expanded during the year 1975 through a Government Order, which stipulated that this Unit shall collect intelligence and the investigate into cases of :- 1) Violation of Government Orders pertaining to reservation of 18% posts, 2) Violation of Government Order pertaining to earmarking and utilisation of funds; 3) Violation of the provisions of Karnataka Land Grant Rules; 4) Violation of Government directions, relating to eviction from Gomal lands; 5) Violation of rules pertaining to grant of sites; 6) Wrongful alienation of the inam land and house sites; 7) Wrongful eviction of SCs/STs by the landlords; 8) Wrongful eviction of SC/STs by other communities and Government agencies; 9) Cases of production of false caste certificates; 10) Offences under Bonded Labour System Ordinance 1975; 11) Offences under Karnataka Debt Relief Order 1975;
  • 2. 7/18/13 Karnataka State Police www.ksp.gov.in/home/policemanual/ch54.php 2/5 12) All instances of mis-managements and misuse of grants pertaining to Social Welfare Department; 13) Any other matters pertaining to violation of Constitutional Safeguards and protection to SCs/STs and; 14) Any matter pertaining to violation of any law or rule aimed at the Welfare of the SCs/STs. 15) The implementation of Karnataka Scheduled Castes and Scheduled Tribes (Prohibition of Transfer of certain lands) Act, 1978 which came into force on 1st January, 1979 was entrusted to CRE Cell. With the enactment of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 the Constitutional provisions for the eradication of social disabilities and preventing discrimination against the SC/ST were further buttressed and the Cell was entrusted with its enforcement. ORGANISATION 2093 The Directorate is headed by an Additional Director General of Police under whose overall control an Inspector General of Police, a Deputy Inspector General of Police, a Superintendent of Police, a Deputy Superintendent of Police and other ranks drawn from the civil Police function. The Regional centres at the divisional headquarters are headed by Officers of the rank of Superintendents of Police who function with the assistance of the required supporting staff. DUTIES OF OFFICERS ADDL.DIRECTOR GENERAL OF POLICE 2094 He will be in overall charge of the Directorate and implement all the schemes for which the Directorate has been created. He will be responsible for assessing the functioning and proposing reorganisation as and when it is required and formulating the policies that will be in tune with the time and in conformity with the needs. INSPECTOR GENERAL OF POLICE 2095 He will assist the Addl. Director General of Police in the functioning of the DCRE and supervise the work of the DIG and other officers of the Directorate. He will visit the places of important cases and ensure that there is perfect coordination between the Directorate and the Unit Officers. 2096 DEPUTY INSPECTOR GENERAL OF POLICE AND SUPERINTENDENT OF POLICE They will assist the Inspector General of Police and the Director in their work 2097 DEPUTY SUPERINTENDENT OF POLICE/ASST.SUPERINTENDENT OF POLICE He will assist the Superintendent of Police in the functioning of the Directorate both in the office and in the field. He will personally visit the scenes of occurrence in more important cases and assist the district police. He will also take up cases for personal investigation/enquiry whenever directed to do so. 2098. POLICE INSPECTORS They will take up for personal investigation, cases entrusted to them and will conduct enquiries

They will submit case diaries promptly in cases entrusted to them for investigation and such other returns as are prescribed from time to time by Superintendent of Police/Deputy Inspector General of Police/Inspector General of Police and the Director of the Directorate of Civil Rights Enforcement. They will carry out all other work assigned to them for the effective enforcement of the Acts. 2099 SUB-INSPECTORS The Sub-Inspectors will assist the Police Inspectors in investigation/enquiry conducted by them. They will also be given cases for personal investigation. They will be deputed for conducting enquiries into petitions and also for making confidential enquirie s. They will submit their case diaries in cases personally investigated by them promptly to the Deputy Superintendent of Police, Directorate of Civil Rights Enforcement. They will submit their reports of enquiry into the petitions to the Director, Directorate of Civil Rights Enforcement through proper channel. 2100 HEAD CONSTABLES/POLICE CONSTABLES Head Constables and Police Constables of the Directorate will be utilised by the Officers of the Directorate for normal field work like locating witnesses, intelligence duties, execution of process and such other duties. They are part of the Directorate and should not be utilised as personal orderlies. DIARIES 2101. The Superintendent of Police will submit his monthly diary through the Deputy Inspector General of Police to the Director of the Direactorate of Civil Rights Enforcement. 2102. The Deputy Superintendents of Police will submit their weekly diaries to the Deputy Inspector General of Police through the Superintendent of Police of the Directorate of Civil Rights Enforcement. 2103. The Police Inspectors/Sub-Inspectors will write weekly diaries and send a copy to the Deputy Inspector General of Police, Directorate of Civil Rights Enforcement through the Superintendent of Police, whether in headquarters or out in the field for investigation. The remarks of the Deputy Inspector General of Police, Directorate of Civil Rights Enforcement on the weekly diary will be communicated to the concerned Police Inspectors/Sub-Inspectors in the memo form and compliance report obtained. HEAD CONSTABLES AND POLICE CONSTALES NOTE BOOKS 2104. Head Constables and Police Constables will maintain note books to indicate the duties performed by them each day and produce them for check by the Supervisory Officers. POSTING OF OFFICERS TO THE CELL 2105. Posting of Police Officers and men to the Directorate will be made by the Director General and Inspector General of Police and the internal postings will be effected by the Director of the Directorate. GENERAL 2106. 1) In major cases of atrocities on the persons belonging to the Scheduled Castes/Scheduled Tribes and in such of those cases of serious nature under the P.C.R. Act, the
  • 4. 7/18/13 Karnataka State Police www.ksp.gov.in/home/policemanual/ch54.php 4/5 Director General and Inspector General of Police will entrust the investigation to the Directorate of Civil Rights Enforcement. 2) The Officers of the Directorate have powers to investigate offences against the members of Scheduled Castes and Scheduled Tribes made over to it by the State Government or the DG & IGP on selective basis. 3) The Directorate of Civil Rights Enforcement should expeditiously investigate such cases and finalise them, and if charge sheeted pursue them in the court of law vigorously. 4) The investigation will be under the supervision of the Inspector General of Police, Directorate of Civil Rights Enforcement and under over all supervision of the Director of the Directorate. 5) In all cases where officers of the Cell take up investigation of cases from the local Police, they will conduct investigation in toto, write case diaries, and send it to their the Deputy Inspector General of Police, who will in turn transmit it to the Inspector General of Police/ Directorate of Civil Rights Enforcement with his remarks. Copies of the case diaries will also be sent to the jurisdictional Police and others as is done by the C.I.D. Officers. 6) Fortnightly reports on investigation of such cases should be put up to the Director. 7) In all cases of unnatural death of members of Scheduled Castes/Scheduled Tribes where the complainant alleges murder and there is strong suspicion of homicide, the body should be subjected to post-mortem examination by two Government Medical Officers. 8) Such cases also will be handed over to Directorate of Civil Rights Enforcement for investigation. 9) The Directorate of Civil Rights Enforcement will supervise and co-ordinate the work of all agencies entrusted with the task of taking action on complaints of harassment, ill-treatment, social boycott and atrocities, on the members of the Scheduled Castes/Scheduled Tribes and enforcement of the Protection of the Civil Rights Act. 10) The jurisdiction of the Directorate will not only be confined to the complaints of cases coming within the purview of the PCR Act as well as the Karnataka Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, but will include all other complaints which fall under one or more of the Acts and Laws mentioned in Order 2092. 11) The Directorate will take up for enquiry such complaints of harassment or atrocity against the Scheduled Castes and the Scheduled Tribes or such complaints of this type wherein inaction by the local Police is alleged as are referred to it by the Government/Director General and Inspector General of Police/Inspector General of Police, Directorate of Civil Rights Enforcement. 12) The Directorate will call for reports of enquiry into complaints of harassment or atrocity against the Schedule Castes and the Scheduled Tribes received by the Cell. 13) The Directorate will keep a watch over the cases under P.C.R. Act and SCs and STs (Prevention of Atrocities) Act registered and investigated in the districts and give necessary instructions in this connection. Further, the reports/ Radio messages/ T.P.Messages/ Fax messages/ Grave Crime Reports and progress Reports will be sent by the Unit officers to the Directorate. However, a copy of such reports and messages should be sent to the Chief Office also. 14) The Directorate will review the judgements in the cases referred to above and take further action as contemplated in order No.1576 of the Police Manual, Volume - II.

Further, the Unit Officers will send the monthly statements to the Cell and will send such other particulars or reports as may be called for by the Addl. Director General of Police, Directorate of Civil Rights Enforcement. 16) The Directorate will compile monthly review relating to the cases referred to in clause (13) above and put up the same for information to the Director General of Police and the Government and communicate their remarks or instructions to the Unit Officers. 17) The Directorate will keep a watch on officers and others who do not respect and execute the laws and rules and who abet the offenders against the Scheduled Castes and the Scheduled Tribes. 18) The Superintendent of Police of the Districts and the officers of the Directorate will co- ordinate their efforts in such a manner as to avoid any friction or difficulty in their smooth functioning. 19) For the purpose of investigation, enquiry or enforcement of the P.C.R. Act and Prevention of Atrocities Act, all the Superintendents of Police will give full co-operations and provide all facilities to the officers of the Directorate. 20) The creation of the Directorate in no way absolves the local police of their responsibility regarding the enforcement of the PCR Act or taking action on the complaints of harassment or atrocities against the Scheduled Castes and the Scheduled Tribes, and the local Police will continue to attend to this work with all alertness, promptness and diligence.
