Example
During the first hearing day, it becomes evident
that the respondent has trouble with memory
and presenting evidence over long periods of
time. Sometimes she appears to have difficulty
keeping on track when responding to questions.
The complainant’s counsel suggests that
because of this, the respondent’s evidence is
not credible.

Example continued
After the first hearing date, the respondent
advises that due to an anxiety disorder and
depression, she cannot be present in the same
room with other parties and key witnesses
without exacerbating her symptoms, to the
point where she will no longer be able to
participate in the process. She also indicates
that she cannot participate in any event that
lasts for more than two hours or is scheduled
for two or more consecutive days.

Example continued
The respondent wants to be involved in
the hearing process and present her
evidence in person, taking these needs
into account.
The complainant’s lawyer raises
objections to this request, indicating
that this would be an abuse of the Tribunal’s
process, especially given that the respondent
did not make this request before the hearing
started.
