Public Law 100-656, the Business Opportunity Development Reform Act of 1988, requires the Department of
Treasury (Treasury) to publish a Forecast of Contract Opportunities (Forecast) that includes projections of
anticipated contracts above the simplified acquisition threshold that small businesses, small disadvantaged
businesses, women-owned small businesses, HUBZone small businesses, and service-disabled veteran-owned small
businesses may be able to perform under direct contracts with the Department, or through subcontracting
opportunities. The annual Forecast of contract opportunities expands upon individual efforts already implemented
at Treasury aimed at enhancing competition in contracting by consolidating anticipated procurements at various
Bureau acquisition activities. Forecast data is for planning purposes only and is not a commitment by the
government to purchase the described products and services.

The point of contact can answer questions about the specific opportunity, validate the data that is on
the Small Business Dynamic Forecast, and provide information about the opportunity’s current status.
Generally, the point of contact is a Contracting or Agreement Officer (CO/AO) or a specialist.
What type of questions can a potential contractor ask the point of contact?
Partners are encouraged to ask questions about solicitations listed in the Small Business Dynamic
Forecast. However, please note there are some Forecast questions that the CO/AO will not be able to
answer.

contracting officer directly, stating your capabilities and your knowledge of other small businesses that are capable of
implementing the activities. Copy the Office of Small and Disadvantaged Business Utilization
(TreasuryOSDBU@Treasury.gov) on any requests for any Treasury bureaus to consider an activity for a small business set-
aside. Most importantly
, provide a brief capability statement that addresses the requirement. Do not send a general capability statement.

Unlike prime contractors, subcontractors do not work directly with the government. Subcontractors work for other
contractors and are part of the supply chain.

Large business contractors must ensure lower-tier subcontractors adhere to the requirements of
subcontracting-related contract clauses. This includes monitoring and enforcing compliance with flow-down
clauses, subcontracting plans, subcontract reporting, and subcontracting goals.
Prime contractors may be required to “flow down” some clauses of their contract to subcontractors. When
that’s the case, obtain an acceptable flow-down subcontracting plan from your commercial market

55. • Flow down clauses can be mandatory or discretionary!
• In the case of discretionary clauses, the subcontractor should evaluate any risks and costs
associated with accepting the inapplicable clause(s) to determine whether these outweigh
the value of accepting the subcontract.
• Subcontractors should be clear on which clauses are mandatory and which are not and
should resist agreeing to flow-down clauses beyond those mandated by the FAR.
• If a subcontractor has no practical choice but to accept additional clauses, it should confirm
