2. IL DIFENSORE DAVANTI AL TAS: IL CONTESTO
• legge applicabile:
(i) procedura ordinaria: “the rules of law chosen by the parties or, in the absence of such a
choice, according to Swiss law. The parties may authorize the Panel to decide ex aequo et bono”
(R45)
(ii) procedura d’appello: “applicable regulations and, subsidiarily, to the rules of law chosen
by the parties or, in the absence of such a choice, according to the law of the country in which
the federation, association or sports-related body which has issued the challenged decision is
domiciled or according to the rules of law that the Panel deems appropriate” (R58)
• “giurisprudenza” del TAS:
• principi generali di valenza sia sostanziale che procedurale del diritto trasnazionale dello sport (tratti
da ordinamenti interni ma con essi non coincidenti).
• normativa:
Code of Sports-related Arbitration in forza dal

3. IL DIFENSORE DAVANTI AL TAS: IL LUOGO
• sede: Losanna (Svizzera)
“However, should circumstances so warrant, and after
consultation with all parties, the President of the Panel
may decide to hold a hearing in another place and may
issue the appropriate directions related to such hearing”
(R28)
• Ad hoc division:
di norma in un hotel presso il villaggio olimpico
• Lingua: francese, inglese e spagnolo
“In the absence of agreement between the parties, the President of the Panel or, if she/he has
not yet been appointed, the President of the relevant Division, shall select one of these three
languages as the language of the arbitration at the outset of the procedure, taking into account
all relevant circumstances. […] If a hearing is to be held, the Panel may allow a party to use a
language other than that chosen for the arbitration, on condition that it provides, at its own
cost, interpretation into and from the official language of the arbitration” (R29)

4. IL DIFENSORE DAVANTI AL TAS: LE NORME DI RIFERIMENTO
R30 - Representation and Assistance:
“The parties may be represented or assisted by persons of their
choice.
The names, addresses, electronic mail addresses, telephone and
facsimile numbers of the persons representing the parties shall be
communicated to the CAS Court Office, the other party and the
Panel after its formation.
Any party represented by an attorney or other person shall provide
written confirmation of such representation to the CAS Court
Office”.

5. IL DIFENSORE DAVANTI AL TAS: LE DECISIONI
«Come sopra precisato, le parti hanno la libertà di farsi assistere da
chiunque.
In tal senso quindi si ribadisce che non è necessaria l’assistenza di
un avvocato né di un laureato in legge.
Ad esempio, un atleta potrebbe tranquillamente essere assistito dal
proprio rappresentante legale, dal proprio allenatore, da un
compagno di squadro, un amico, un rappresentante della federazione
di appartenenza dell’atleta.
Tuttavia, ad onor del vero, l’attività davanti al TAS richiede un grado
di competenza e specializzazione sempre maggiore, di
conseguenza, in questi anni sono sempre più gli avvocati di diritto
sportivo che assistono i rispettivi clienti davanti al TAS»
CAS 2006/A/1162, F. vs FILA, decisione 19 febbraio 2007, parag.
1.1. In tal caso l’atleta, minorenne, era rappresentato dal proprio
padre.

6. IL DIFENSORE DAVANTI AL TAS: ALTRE NORME
Riservatezza
“Proceedings under these Procedural Rules are confidential. The parties, the arbitrators
and CAS undertake not to disclose to any third party any facts or other information
relating to the dispute or the proceedings without the permission of CAS” (R43)
Spese legali
“In the arbitral award, the Panel shall determine which party shall bear the
arbitration costs or in which proportion the parties shall share them. As a general
rule and without any specific request from the parties, the Panel has discretion to
grant the prevailing party a contribution towards its legal fees and other
expenses incurred in connection with the proceedings and, in particular, the costs of
witnesses and interpreters” (R64.5)

7. IL DIFENSORE DAVANTI AL TAS
Decorrenza del tempo
“The time limits fixed under this Code shall begin from the day after that on which
notification by the CAS is received. Official holidays and non-working days are
included in the calculation of time limits. The time limits fixed under this Code are
respected if the communications by the parties are sent before midnight, time of the
location of their own domicile or, if represented, of the domicile of their main legal
representative, on the last day on which such time limits expire. If the last day of the
time limit is an official holiday or a non-business day in the location from where the
document is to be sent, the time limit shall expire at the end of the first subsequent
business day.” (R32)

8. IL DIFENSORE DAVANTI AL TAS
Incompatibilità/Ricusazione
“The President of either Division may be challenged if circumstances exist that give rise
to legitimate doubts with regard to her/his independence vis-à-vis one of the parties to
an arbitration assigned to her/his Division. She/he shall pre-emptively disqualify
herself/himself if, in arbitration proceedings assigned to her/his Division, one of the
parties is a sports-related body to which she/he belongs, or if a member of the law firm
to which she/he belongs is acting as arbitrator or counsel.” (S21)
“CAS arbitrators and mediators may not act as counsel for a party before the CAS” (S18)

9. IL DIFENSORE DAVANTI AL TAS: ALTRE NORME
“Selon le requérant, l’arbitre L. F. était associé dans un cabinet d’avocats représentant les intérêts du
propriétaire du club Chelsea et il ne pouvait donc pas passer pour indépendant et impartial envers ce
club.
La Cour note que, par un arrêt longuement motivé et ne révélant aucune trace d’arbitraire, le Tribunal
fédéral a conclu que le requérant n’avait pas apporté la preuve de ses allégations. Le requérant l’a d’ailleurs
reconnu lui-même devant cette haute juridiction, et il ne soutient pas le contraire devant la Cour.
La Cour n’aperçoit donc aucune raison sérieuse de substituer son propre avis à celui du Tribunal fédéral sur
ce point et conclut qu’il n’y a pas eu violation de l’article 6 § 1 de la Convention en raison d’un défaut
d’impartialité de l’arbitre L. F..” (Sentenza CEDU 2 ottobre 2018, Affaire Mutu ed Pechstein c. Suisse)

10. IL DIFENSORE DAVANTI AL TAS: AD HOC DIVISION
