Ayodhya: The wait of
centuries has ended,
Prime Minister Naren-
dra Modi said after per-
forming the ground-
breaking ceremony in
AyodhyaforRamMandir.
Returning to the tem-
ple town of Ayodhya
after nearly 30 years,
Prime Minister Modi,
clad in a traditional
golden coloured dhoti-
kurta, performed the
‘bhoomi pujan’ of the
proposed Ram Mandir.
Sending out the mes-
sage that “Ram is every-
where, Ram belongs to
all”, Modi said the tem-
ple symbolises India’s
rich heritage and will
be an inspiration to all
of humanity.
Across the country,
people remained glued
to their television sets as
Modi performed rituals
at the Ram Janmabhoo-
mi, the site of a bitter
Hindu-Muslim conflict
that lasted decades be-
fore being settled by the
SupremeCourtlastyear.
Beginning his speech
with Jai Siya Ram, the
PM told the gathering
that a grand temple will
now be built for Ram La-
lla, the infant Ram, who
had been living in a tem-
porary tent for years.
“Many people made
sacrifices for the Ram
temple. I pay my re-
spects to all of them,”
he said in the speech
that followed the laying
of the foundation for
the Ram temple. “Ram
Mandir will become the
modern symbol of our
traditions. It’ll become
a symbol of our devo-
tion, our national senti-
ment. This temple will
also symbolise the pow-
er of the collective reso-
lution of crores of peo-
ple. It will keep inspir-
ing the future genera-
tions,” Modi said.
He also released a
postage stamp to mark
the event, an occasion
which is also being seen
as an ideological victory
of theBJPoveritsrivals.
Some of the leaders
of the Ram Janmabhoo-
mi movement, includ-
ing former deputy
prime minister LK Ad-
vani were not at among
the 175 people invited to
the venue, with the or-
ganisers keeping the
guest list short because
of the threat of COV-

a set of appeals filed by

quite happy with the
Ram temple Bhumi Pu-
jan performed in Ayod-
hya as the long-held
dreams of the people
are finally taking shape.
"I am very happy to-
day. We were committed
to building the temple
and today our commit-
ment is being fulfilled.
We had imagined that a
grand temple for Mary-
ada Purushottam Ram
shall be constructed
one day and today we
can see our imagina-
tion and dreams taking
final shape," the Gover-
nor said.
"We always wanted
India's magnanimity to
increase many times in
the world with the con-
struction of the grand
Ram temple. Now, on
this historic day, I pray
that this temple will
emerge as a symbol of
cultural and national
unity which will go
along with the princi-
ples of ‘Vasudhaiva Ku-
tumbakam'. This work
is being done in accord-
ance with the court's
decision, general con-
sensus and public sen-
timents. I congratulate
and greet all the saints
and citizens who
were part of the Ram
Mandir movement.

and thank the Prime
Minister," he said.
Meanwhile, Gover-
nor recited Sundar
Kand with Satyavati
Mishra, the first lady
of the state at Raj
Bhavan. On this occa-
sion, the family of the
governor and some of-
ficials were also pre-
sent. The Governor
garlanded the picture
of Ram and offered
prayers and wished for
prosperity in the coun-
try and the state.

minister Pratap Singh

orientation programme

the election department
conducted an orienta-
tion program for its of-
ficials and staff on the
NVSP portal and mo-
bile app on Wednesday.
Chief electoral offic-
er Praveen Gupta asked
officers and employees
to help first-time voters
in registration and reg-
ister online at least five
new voters in the age
group of 18-19 years and
share information
about voter registration
at the individual level.
“The election depart-
ment employees must
have a thorough knowl-
edge of including and
removing names from
the voter list so that
they can provide infor-
mation to a voter who
has not made voter ID
card,” he said.
Additional chief elec-
toral officer (ACEO)
Krishna Kunal in-
formed about the
amendment in the card
on the portal. He said
that during coronavi-
rus problems common
man can use facilities
provided on the portal
and mobile app and
there is a need to create
awareness about these
facilities.

joined the ground-
breaking ceremony of
the construction of
Ram temple by PM
Modi in Ayodhya. The
BJP headquarters was
decorated and was
thronged by BJP work-
ers. Many of the senior
workers and leaders
from the party had par-
ticipated in the cam-
paign for the Ram tem-
ple, others had gone till
jail during the course
of agitation while some
were even subjected to
physical torture.
The function at the C-

started with Ramdhuni
and then everyone was
engrossed to the TV
screens to listen to the
addresses by RSS chief
Dr Mohan Bhagwat and
UP CM Yogi Adity-
anath. State BJP chief
Satish Poonia couldn’t
control his emotions
and used the occasion
to take a dig at the Con-
gress. He said it was
overwhelming to chant
them ‘Jai Shri Ram’ as
lord Ram isn’t an im-
aginary figure. Poonia
said that even Rahul
Gandhi is a witness to
the historical event. He
said the day isn’t simply
auspicious for the be-
ginning of the construc-
tion of the temple but
also a gateway to a gold-
en future as lord Ram
belongs to all.

Jaipur: HC on Wednes-
day directed the JDA to
formulate a plan so that
people can get entire de-
tails and information
related to land, while
purchasing.
Hearing a suo moto
petition on housing so-
cieties which issues
dual patta, the division
bench chief justice In-
drajit Mahanty and jus-
tice Prakash Gupta ob-
served that people
spend their hard earned
money for house con-
struction but they are
left with a piece of pa-
per in hand. The court
said that JDA should
make a plan so that peo-
ple can get all details
related with lands.
A committee set up in
the chairmanship of
additional chief secre-
tary (home) also sub-
mitted an affidavit in
the court in connection
with the matter.
Jaipur police com-
missioner Anand Sriv-
astava and additional
commissioner Ajaypal
Lamba appear in the
court during the hear-
ing. Advocate Vimal
Chaudhary expressed
dissatisfaction over the
police action against
such housing societies.
Srivastava said that
most of the cases are
subjudice and there are
181 cases related to dual
patta which are being
probed. The court asked
the police to expedite
the investigation.
HC on 6 February,
2017 took suo moto cog-
nisance and sought a
report of irregularities
by the housing society.
The court sought report
on various points from
cooperative and police
departments.
State government
has formed a coordina-
tion committee which
submits the reports in
the court.

Jodhpur: Chief
Minister Ashok Ge-
hlot has been empha-
sizing on use of plas-
ma therapy to treat
critical coronavirus
infected patients.
Accordingly, the
district administra-
tion and health de-
partment has been
augmenting plasma
therapy and patients
who have recovered
from Covid have
been asked to donate
plasma.
Chief medical &
health officer
(CMHO) Dr Balwant
Manda said that the
state government
has been emphasiz-
ing on using plasma
therapy and a plas-
ma bank has been
set up in Jaipur.
He said that other
medical colleges in
the state have also
been given sanction
to set up plasma
bank.
The CMHO also
said that many seri-
ous patients have
been successfully
treated with plasma
therapy; therefore,
people have been en-
couraged to donate
plasma.
“Those in a par-
ticular age category
who have been re-
covered from corona-
virus and have com-
pleted their isolation
period are being en-
courage to donate
plasma,” Dr Manda
said.
The health depart-
ment has been con-
tacting them for the
same.

Jaipur: Stern action
will be taken if laxity is
found in executing
door-to-door garbage
collection system in the
city. The commissioner
of Jaipur Municipal
Corporation (Jaipur
Greater) Dinesh Yadav
gave the directions in a
review meeting held on
Wednesday in the JMC
office.
Saying that keeping
the city clean is a pri-
mary responsibility, Ya-
dav said that no care-
lessness will be tolerat-
ed and action will be
taken against the em-
ployees if heap of gar-
bage is found in the city.
He also directed offi-
cials to make sure that
the door-to-door gar-
bage collection system
runs well.
Showing displeasure
for delay in delivering
notices to recover due
taxes, the commission-
er instructed officials to
ensure delivery of the
notices in time. He also
said that file should be
moved for attaching the
properties of those who
are not paying urban
development and other
taxes. In the meeting,
deputy commissioners
of all zones were asked
to take action on illegal
constructions. He also
asked them to take dis-
ciplinary action on the
personnel who come to
the office late. Taking
up the issue of penden-
cy on various grievanc-
es registered on PMO,
CMO, Sampark portal
and helplines, Yadav
said that the grievances
should be redressed in
next three days.
Also, instructions
were given to officials
for sending replies to
assembly questions and
clear the pendency of
matters related to hu-
man rights commission
and RTI. He also sug-

lice has made an unex-
pected revelation re-
garding the culprits of
the double murder of
mother and son in the
Surya Nagar colony a
few days ago. The prime
accused Anil Kumar
Sharma told the police
that the death of his fa-
ther in law six years ago
under suspicious cir-
cumstances was in fact
a murder. Accused An-
il’s father in law ajnai
Kumar was found dead
in a water tank in his
house, Police closed the
case considering it to be
suicide. Family had
complaints about it.

ment accepting bribe

500-year-old dispute finally
ended on August 5 with Prime
Minister Narendra Modi per-
forming a ground-breaking cer-
emony to mark the start of a
grand Ram temple in Ayodhya. For mil-
lions of Hindus across the globe the mo-
ment filled with religious fervour was
historic and memorable. After abrogation
of Article 370 ending special status en-
joyed by Jammu & Kashmir, Ram temple
construction has been a major poll plank
of the Bharatiya Janata Party and the
Vishwa Hindu Parishad, an adjunct of the
Rashtriya Swayam Sewak Sangh. “Not
only is history being written with this
temple, but history is also being repeat-
ed,” the prime minister said. It indeed is.
Wednesday’s grand ceremony came after a
lot of blood was spilled on the streets of Ayod-
hya and the country before and after the demo-
lition of the Babri Masjid. Supreme Court de-
scribeditas“anegregiousviolationof therule
of law. A five-judge bench headed by Chief
Justice of India Justice Ranjan Gogoi said,
“The destruction of the mosque took place in
breach of the order of status quo and an assur-
ance given to this court.” As a remedy the
court ordered five acres of land to be given to
Muslims “at a prominent place in Ayodhya”.
The land has been allocated and temple
construction is set to begin, one would
hope that the country will move ahead
putting the long and bloody history be-
hind. A faction of Muslims has accepted
the judgment and also the land but All-
India Muslim Personal Law Board (AIM-
PLB) has neither accepted the SC verdict
nor reconciled to the idea of Ram temple
where the Babri mosque once stood. In a
tweet on the eve of bhoomi pujan the
BMAC issued a statement drawing paral-
lel with the Hagia Sophia, a 1500 years
old cathedral which has been converted
into a mosque in Turkey. #BabriMasjid
was and will always be a Masjid. #Hagia-
Sophia is a great example for us. Usurpa-
tion of the land by an unjust, oppressive,
shameful and majority appeasing judg-
ment can’t change its status. No need to
be heart-broken. Situations don’t last for-
ever. #ItsPolitics,” the tweet said. The
majority community has so far refrained
from firing a riposte and, hopefully, will
exercise restraint in their response.
Politics today is majoritarian. Modi, Amit
Shah and Yogi Adityanath are strong leaders
who stand firm in their faith. They do realize
that peace and harmony are prerequisites for
country’s development but won’t give any
quarter to those disturbing peace. While deal-
ing with minorities India should take a few
lessons from Indonesia which has biggest
Muslim population. The prime minister men-
tioned Indonesia’s different Ramayans to say
that Ram is worshipped in several countries.
Lord Ganesh and Bali’s famous temple have
figured on the currency of Indonesia. Central
to these features is peace and harmony.

enced much of life from the

Its title, a reference to
the 4chan-originated
phrase “that feel when no
girlfriend,” reveals the es-
sence of its subjects’ griev-
ances described in the
South by Southwest
(SXSW) film festival pro-
gram as first a “lack of ro-
mantic companionship,”
then evolving to “a greater
state of existence defined
by isolation, rejection and
alienation.” As one of the
film’s subjects remarks
early on: “Everyone my
age kinda just grows up on
the internet … 4chan was
the only place that seemed
real… I realized there were
other people going through
the same shit.”
What does this level of
alienationtellusaboutsoci-
ety today? And how seri-
ously should we take the
contentfoundonthisonline
patchwork of messaging
boards and forums, each
with its own language and
visual culture that may at
first seem humorous or
ironic, but often disguises
misogyny, racism and vio-
lence? These are difficult
and urgent questions, par-
ticularly given the emer-
gent incel phenomenon —
“incel” being a portman-
teau of “involuntary celi-
bate”—whichappearstobe
gaining in strength online.
VIRTUAL
EXPRESSIONS
The idea of virtual expres-
sionsof alienationandrage
translating to actual vio-
lence remains a real and
present danger, as we were
reminded of this May when
a teenager became the first
Canadian to be charged
with incel-inspired terror-
ism.Thedocumentary,how-
ever, avoids confronting the
violence that this subcul-
ture often glorifies, and the
director has since stated
that the film was never sup-
posed to be about incels but
that it had become impos-
sible to discuss it without
the term coming up.
As it turns out, the men
we meet in “TFW No GF”
appear to be largely harm-
less — except perhaps to
themselves — and despite
the documentary’s lack of
narrative voice, it takes a
patently empathetic
stance. Set against the
backdrop of industrial
landscapes and empty de-
serts, this is a United States
in decline. Here, role mod-
els and opportunities lie
thin on the ground, and the
closest thing to “commu-
nity” exists in virtual
realms. Each self-described
NEET — slang for “not in

tale of alienation: of alco-
holic parents, dead friends
or a disenfranchisement
with the school system.
For those who study in-
ternet subcultures, the

Wojak explored in the film

good man,” and “smug/an-
gry/sad Pepe” and, al-
though not created to have
racist connotations, is fre-

depicted as a bald man with
a depressed expression.
One of the documenta-
ry’s subjects, “Kantbot,”
explains that you “can’t
have one without the other
… that’s the duality of
man.” For these men, Pepe
represents the troll self, a
public persona that embod-
ies their smug and cocky
traits. Wojak denotes a
more private and vulnera-
ble self, typified by inade-
quacy, unfulfillment and
sadness.

These days, the merger of
all the six MLAs of Bahujan
Samaj Party (BSP) with the
Indian National Congress is
a hot topic in Rajasthan. The
merger had taken place
somewhere in the month of
September in 2019.
All the six members of BSP
moved an application before
the Speaker for getting them-
selves merged with the Indian
National Congress and the
Speaker agreed and passed or-
der accordingly.
We will scan here the legal
provisions of the merger and
relevant case law.
Para 4 of Tenth Schedule
reads as under-
“4.Disqualificationonground
of defection not to apply in case
of merger-
(1)A member of a House
shall not be disqualified under
sub paragraph (1) of paragraph
2 where his original political
party merges with another po-
litical party and he claims that
he and any other members of
his original political party-
(a) have become members of
such other political party or, as
the case may be, of a new po-
litical party formed by such
merger; or
(b) have not accepted the
merger and opted to function
as a separate group;
and from the time of such
merger, such other political
party or new political party or
group, as the case may be, shall
be deemed to be the political
party to which he belongs for
the purposes of sub-paragraph
(1) of paragraph 2 and to be his
original party for the purposes
of this sub-paragraph.
(2) For the purposes of sub-
paragraph (1) of this para-
graph, the merger of the origi-
nal political party of a member
of a House shall be deemed to
have taken place if, and only if,
and less than two-thirds of the
members of the legislature
party concerned have agreed to
such merger.”
The question is, whether
the merger of all the six
members of BSP legislative
party in Rajasthan with the
Congress party comes with-
in sub-para (2) of paragraph
4 since more than two-third
MLAs had agreed to merge
with congress party.
The merger had taken
place in the month of Sep-
tember 2019, wide publicity
was given in prominent
newspapers/channels but
till more than 10 months
later, neither State Unit nor
National Unit raised any ob-
jection to such a merger.
Can it not be presumed that
implied consent was given to
such a merger?
Jagjeet Singh Vs. State of
Haryana (2006) 11 SCC 1 and
Rajendra Singh Rana Vs. Swa-
my Prasad Morya (2007) 4 SCC
270 are the relevant case law.
However, there is a distin-
guishable feature in these au-

During the earlier tenure of
congress party in Rajasthan
(2008-2013), all the six MLA’s of
BSP got themselves merged
with congress party but no ob-
jection was ever raised by BSP.
It is a talk of the town that

done at a belated stage. Inter-

were laid down as part
of the ‘bhoomi pujan’ at
the site for Ram Janma-
bhoomi temple in Ayod-
hya on Wednesday.
During the ‘bhoomi
pujan’, a priest had ex-
plained the significance
of the nine bricks
which were to be laid
down to mark the begin-
ning of the construc-
tion process. “Nine
bricks are kept here...
these were sent by devo-
tees of Lord Ram from
around the world in
1989. There are 2,75,000
such bricks, out of
which 100 bricks with
‘Jai Shri Ram’ engrav-
ing have been taken,”
the priest said.
Soil from more than
2,000 pilgrimage sites
and water from more
than 100 sacred rivers
were brought to be used
for purification and
other rituals. After lay-
ing the foundation
stone for the Ram tem-
ple, PM Modi had
termed the event as an
“emotional moment”
for the country and add-
ed that “every heart is
illuminated today”.
“Every heart is illu-
minated; it is an emo-
tional moment for the
entire country... A long
wait ends today... A
grand temple will now

2019, saying that the
economic criterion can-

reservation. The Centre
had earlier defended its

that the Constitution
(103 amendments) Act,
2019 granting 10 per
cent reservation to
EWS is intended to up-
lift around 200 million
people who are still be-
low the poverty line.
Referring to the nine-
judge bench decision

cise department seemed

gest sources of revenue,

within a month of Dr
Jogaram taking over as
theexcisecommissioner.
In the recent bureau-
craticreshuffle,Dr.Joga-
ram was appointed ex-
cise commissioner and
he took over on July 2.
He was given the charge
of this crucial depart-
ment at a time when the
government has been
facing financial crunch
during corona triggered
lockdown and desper-
ately looking for ways to
increase its income.
The lockdown caused
havoc on state’s finance
as wheels of economy
came to abrupt halt. The
excise department re-
ceived just a fifth of
what it used to earn in
the month of April. In-
stead of Rs 600-crore
revenue the excise de-
partment received a pal-
try Rs 145-crore in the
first month of new fi-
nancial year.
However, Dr. Jogaram
with his administrative
and financial skills
managed to turn the
wheel within a month as
the excise department
created a record by net-
ting Rs 844-crore in July.
Bikaner district has
generated Rs 304-crore
revenue in first four
months of the current
financial year.
The turnaround was
made possible by the
new excise commission-
er’s aggressive strategy
as he made it clear to of-
ficersthattheymustpull
up socks to increase ex-
cise revenue.

now be able to put their
bid or auction proposals
till 4 pm on Thursday

ing at 4.30 pm.
Arora said that the

the comforts of their
home or can ap-
proach any help desk
in any RHB office or
e-Mitra kiosk. He said

CM Gehlot hails corona front

ter Ashok Gehlot ex-
pressed his gratitude
to the government and
non-government per-
sonnel who whole-
heartedly contributed

Covid-19. He said the

track so he appealed

CM Gehlot was ad-
dressing 151 employee

VC from CMR on
Wednesday. CM remind-
ed that the state govern-
ment has been working
with the twin motto of

‘Koi Bhukha na soye’
(Nobody sleeps hungry)
from day one of the out-
break of the pandemic.
The government
took along every sec-
tion of the society in-

against coronavirus

right from the state
capital to the pan-
chayat level which
earned its praise

Gehlot said that our
first priority has been

warriors from both

with an insurance cov-
er of Rs 50 lakh. He as-
sured that even the lo-
cal body corona warri-
ors across the state will

efit. CM said that so far
115 critical patients
have been treated with
plasma therapy and
now the employees
should motivate people
to donate plasma for
the critically ill.

that it was for the first

dered investigation

is said to be linked with
Shekhawat. Dakalia
had challenged the or-
der on the ground that
specific direction has
been given, without

Dakalia and asked to

ter. Whereas, Sid-
dharth Luthra, who
was representing the
government, objected
to the same.
Advocate AK Jain,
from the complain-
ant’s side, argued
that the net worth of
Navprabha build tech
pvt ltd is only Rs 15
crores but its 25per
cent shares were
transferred to Sanji-
vani Credit Coopera-
tive Society for Rs
100 crore, and inves-
tors were cheated. He
also submitted that
Dakalia is a proxy
litigant.
Justice Satish Ku-
mar Sharma, while ad-
mitting the case, passed
an interim order hold-
ing that till further or-
der, the SOG is free to
investigate the matter
under section 173 (8) of
CrPC. However, he
stayed the order on re-
vision of complainant,
passed by additional
session judge. In the
case now, the ball is
in the field of the
SOG, which is totally
free to take any ac-
tion in the matter.

Returning to the tem- ple town of Ayodhya after nearly 30 years, Prime Minister Modi, clad in a traditional golden coloured dhoti- kurta, performed the ‘bhoomi pujan’ of the proposed Ram Mandir. Sending out the mes- sage that “Ram is every- where, Ram belongs to all”, Modi said the tem- ple symbolises India’s rich heritage and will be an inspiration to all of humanity. Across the country, people remained glued to their television sets as Modi performed rituals at the Ram Janmabhoo- mi, the site of a bitter Hindu-Muslim conflict that lasted decades be- fore being settled by the SupremeCourtlastyear. Beginning his speech with Jai Siya Ram, the PM told the gathering that a grand temple will now be built for Ram La- lla, the infant Ram, who had been living in a tem- porary tent for years. “Many people made sacrifices for the Ram temple. I pay my re- spects to all of them,” he said in the speech that followed the laying of the foundation for the Ram temple. “Ram Mandir will become the modern symbol of our traditions. First India Bureau Jodhpur: Chief Minister Ashok Ge- hlot has been empha- sizing on use of plas- ma therapy to treat critical coronavirus infected patients. Accordingly, the district administra- tion and health de- partment has been augmenting plasma therapy and patients who have recovered from Covid have been asked to donate plasma. Chief medical & health officer (CMHO) Dr Balwant Manda said that the state government has been emphasiz- ing on using plasma therapy and a plas- ma bank has been set up in Jaipur. He said that other medical colleges in the state have also been given sanction to set up plasma bank. The CMHO also said that many seri- ous patients have been successfully treated with plasma therapy; therefore, people have been en- couraged to donate plasma. “Those in a par- ticular age category who have been re- covered from corona- virus and have com- pleted their isolation period are being en- courage to donate plasma,” Dr Manda said. The health depart- ment has been con- tacting them for the same. Bharat Dixit Jaipur: Stern action will be taken if laxity is found in executing door-to-door garbage collection system in the city. The commissioner of Jaipur Municipal Corporation (Jaipur Greater) Dinesh Yadav gave the directions in a review meeting held on Wednesday in the JMC office. Saying that keeping the city clean is a pri- mary responsibility, Ya- dav said that no care- lessness will be tolerat- ed and action will be taken against the em- ployees if heap of gar- bage is found in the city. He also directed offi- cials to make sure that the door-to-door gar- bage collection system runs well. Showing displeasure for delay in delivering notices to recover due taxes, the commission- er instructed officials to ensure delivery of the notices in time. He also said that file should be moved for attaching the properties of those who are not paying urban development and other taxes. In the meeting, deputy commissioners of all zones were asked to take action on illegal constructions. He also asked them to take dis- ciplinary action on the personnel who come to the office late. Taking up the issue of penden- cy on various grievanc- es registered on PMO, CMO, Sampark portal and helplines, Yadav said that the grievances should be redressed in next three days. Also, instructions were given to officials for sending replies to assembly questions and clear the pendency of matters related to hu- man rights commission and RTI. He also sug- gested the officers to spare at least half an hour to look into the cases so that there is no pendency. He gave instructions to expedite awareness campaign and publicise messages related with safety from coronavi- rus. First India Bureau Alwar: ACB team un- der CO Mahendra Mee- na made two more ar- rests in the corrupt CDPO Pradeep case of Bansur. These days, the merger of all the six MLAs of Bahujan Samaj Party (BSP) with the Indian National Congress is a hot topic in Rajasthan. The merger had taken place somewhere in the month of September in 2019. All the six members of BSP moved an application before the Speaker for getting them- selves merged with the Indian National Congress and the Speaker agreed and passed or- der accordingly. We will scan here the legal provisions of the merger and relevant case law. Para 4 of Tenth Schedule reads as under- “4.Disqualificationonground of defection not to apply in case of merger- (1)A member of a House shall not be disqualified under sub paragraph (1) of paragraph 2 where his original political party merges with another po- litical party and he claims that he and any other members of his original political party- (a) have become members of such other political party or, as the case may be, of a new po- litical party formed by such merger; or (b) have not accepted the merger and opted to function as a separate group; and from the time of such merger, such other political party or new political party or group, as the case may be, shall be deemed to be the political party to which he belongs for the purposes of sub-paragraph (1) of paragraph 2 and to be his original party for the purposes of this sub-paragraph. (2) For the purposes of sub- paragraph (1) of this para- graph, the merger of the origi- nal political party of a member of a House shall be deemed to have taken place if, and only if, and less than two-thirds of the members of the legislature party concerned have agreed to such merger.” The question is, whether the merger of all the six members of BSP legislative party in Rajasthan with the Congress party comes with- in sub-para (2) of paragraph 4 since more than two-third MLAs had agreed to merge with congress party. The merger had taken place in the month of Sep- tember 2019, wide publicity was given in prominent newspapers/channels but till more than 10 months later, neither State Unit nor National Unit raised any ob- jection to such a merger. Can it not be presumed that implied consent was given to such a merger? Jagjeet Singh Vs. State of Haryana (2006) 11 SCC 1 and Rajendra Singh Rana Vs. Swa- my Prasad Morya (2007) 4 SCC 270 are the relevant case law. However, there is a distin- guishable feature in these au- thorities.Theratioof thesecases relates to the split of the party. Speaker (1997)3 Punjab LR 374(FB) para8 indicated as under- “...thus it is clear that Parlia- ment intended to treat the State unit of a political party as a separate entity for the pur- pose of determining whether there is any disqualification of a member of the House of that State legislature belonging to that political party. Likewise for the purpose of merger within the meaning of para4, two-thirds of the members of State legislature party must have agreed to the merger. During the earlier tenure of congress party in Rajasthan (2008-2013), all the six MLA’s of BSP got themselves merged with congress party but no ob- jection was ever raised by BSP. Earlier today, Prime Minister Modi took part in ‘bhoomi pujan’ for the construction of Ram temple. —ANI Ayodhya: Nine bricks were laid down as part of the ‘bhoomi pujan’ at the site for Ram Janma- bhoomi temple in Ayod- hya on Wednesday. During the ‘bhoomi pujan’, a priest had ex- plained the significance of the nine bricks which were to be laid down to mark the begin- ning of the construc- tion process. “Nine bricks are kept here... these were sent by devo- tees of Lord Ram from around the world in 1989. There are 2,75,000 such bricks, out of which 100 bricks with ‘Jai Shri Ram’ engrav- ing have been taken,” the priest said. Soil from more than 2,000 pilgrimage sites and water from more than 100 sacred rivers were brought to be used for purification and other rituals. After lay- ing the foundation stone for the Ram tem- ple, PM Modi had termed the event as an “emotional moment” for the country and add- ed that “every heart is illuminated today”. “Every heart is illu- minated; it is an emo- tional moment for the entire country... A long wait ends today... A three-judge bench headed by Chief Justice Justice (CJI) Sharad Arvind Bobde said that a larger bench will de- cide the pleas filed by 35 petitioners challenging Centre’s decision. The petitions filed by NGOs ‘Janhit Abhiyan’ and ‘Youth For Equality’ along with 33 others sought directions to quash the Constitution (103 Amendment) Act, 2019, saying that the economic criterion can- not be the sole basis for reservation. The Centre had earlier defended its decision & contended that the Constitution (103 amendments) Act, 2019 granting 10 per cent reservation to EWS is intended to up- lift around 200 million people who are still be- low the poverty line. The lockdown caused havoc on state’s finance as wheels of economy came to abrupt halt. The excise department re- ceived just a fifth of what it used to earn in the month of April. In- stead of Rs 600-crore revenue the excise de- partment received a pal- try Rs 145-crore in the first month of new fi- nancial year. However, Dr. Jogaram with his administrative and financial skills managed to turn the wheel within a month as the excise department created a record by net- ting Rs 844-crore in July. Bikaner district has generated Rs 304-crore revenue in first four months of the current financial year. The earlier order was challenged by one Kewal Chand Dakalia who is shareholder di- rector of Navprabha Build tech pvt ltd which is said to be linked with Shekhawat. Dakalia had challenged the or- der on the ground that specific direction has been given, without hearing him. Senior Advocate Mahesh Jethmalani argued the case for Dakalia and asked to put stay in the mat- ter. Whereas, Sid- dharth Luthra, who was representing the government, objected to the same. Advocate AK Jain, from the complain- ant’s side, argued that the net worth of Navprabha build tech pvt ltd is only Rs 15 crores but its 25per cent shares were transferred to Sanji- vani Credit Coopera- tive Society for Rs 100 crore, and inves- tors were cheated. He also submitted that Dakalia is a proxy litigant. Justice Satish Ku- mar Sharma, while ad- mitting the case, passed an interim order hold- ing that till further or- der, the SOG is free to investigate the matter under section 173 (8) of CrPC. However, he stayed the order on re- vision of complainant, passed by additional session judge. In the case now, the ball is in the field of the SOG, which is totally free to take any ac- tion in the matter.
