6. Permit Process
 Permit application submitted to the TCEQ on June 3, 2011
 Permit under technical review for 9 months
 On January 20, 2012 the SWAC, in a unanimous vote, found the
application to be in non-conformance with the Regional Solid
Waste Management Plan (non-binding)
 TCEQ scheduled a July 19, 2012 public meeting on the proposed
permit application
 The meeting will take place at the Brazos County Expo Complex
Ballroom Building and will start at 7:00 PM

7. Public Meeting
 Informal Discussion Period: the public will be encouraged to
ask questions of the applicant and TCEQ staff concerning the
permit application
 Formal Comment Period: members of the public may state
their formal comments orally for the official record
 All formal comments will be considered before a decision is
reached regarding the permit application
 The formal comment period at the meeting will be the final
public comments accepted by the TCEQ for determining if
the application will be approved or subjected to a contested
case hearing

8. Contested Case Hearing
 The person requesting a hearing must demonstrate that they are an
“affected person” to be a party to the hearing
 Must affect interests specific to the requester that the public in general would not
share
○ Impairing the requester’s health or safety
○ Interfering with the requester’s use or enjoyment of their property
 Hearings are conducted by the State Office of Administrative Hearings
(SOAH)
 SOAH is an independent agency tasked with conducting hearings for state
agencies
 An administrative law judge will preside over the hearing and will consider
evidence in the form of sworn witness testimony and documents
 At the conclusion of the SOAH hearing, the judge will issue a proposal for
decision, which will be submitted to the TCEQ for formal consideration
