In Florida, you can be
charged with driving
under the influence
(DUI) if your blood
alcohol content (BAC)
is .08 or higher.

If you're stopped under suspicion of driving under the
influence, the police officer may ask you to perform one or
more tests to assess your level of intoxication. These may
include:
Field Sobriety
Test
Breathalyzer
Test
Blood Test

Field sobriety tests are performed to
provide a police officer with an initial
assessment as to whether you may be
intoxicated. You'll be asked to
perform a series of tests that require
you to do multiple tasks at once.
Field sobriety tests are voluntary.
You are not legally required to
perform them, and it's in your best
interest to politely decline. These
tests are highly subjective and are
designed in a manner that increases
the likelihood that you will exhibit
signs of intoxication.

A breathalyzer or blood test
is often used to determine
your exact blood alcohol
content (BAC). These tests
are mandatory, and it's
generally recommended that
you take them if a police
officer asks you to.
Failure to submit to a blood
or breath test can result in
an automatic driver's license
suspension for 12 months.

• Second DUI conviction within 5 years -- 18 month license
suspension
• Refusal of blood or breathalyzer test -- 12 month license
suspension for first offense, 18 month suspension for second
offense

8. A P P E A L I N G

S U S P E N S I O N
You have 10 days following your
arrest to file an application for a
formal review hearing to challenge
the suspension of your driver's
