                GENERAL PROVISIONS
      Regulation 13: ‘Nutrition Information Panel’


13 (1) : ‘No label shall contain any nutrition claim
unless it also includes a nutrition information panel
in the form specified in the Fourth Schedule or
in such other similar form as may be approved by
the Director, specifying the energy value,
the amounts of protein, carbohydrates, fat and
the amount of any other nutrients for which a
nutrition claim is made in respect of the food’

13 (3) : ’For the purpose of these Regulations, “nutrition claim” means a
representation that suggests or implies that a food has a nutritive property,
whether general or specific and whether expressed affirmatively or negatively,
and includes reference to –
 (a) energy
(b) salt, sodium or potassium;
(c) amino acids, carbohydrate, cholesterol, fat, fatty acids, fibre, protein, starch or
    sugars; or
(d) any other nutrients,

But does not include a statement of ingredients or a declaration or claim relating
to a vitamin or mineral

**differs from Codex Nutrition & Health Claims which include vitamins &
minerals
Part IV
                         GENERAL PROVISIONS
                 Regulation 14 : ‘Misleading Statements’

14(1): ‘…..No food should be described /presented in manner that is false, misleading
        indicating its nature/character in any respect’

14(2): ‘..no food to be described as ‘pure’ or any word of the same significance unless the food
         is free from other added substances………’

14 (3): ‘no therapeutic claims or prophylactic action claims on any food’

14 (4): ‘no claims which could be interpreted as advice of a medical nature from any persons
       whatsoever’

14 (5): ‘no implications that a food will prevent, alleviate or cure any disease/condition’

14 (6): ‘no words implying that health or an improved physical condition may be achieved by
         consuming any food’

14 (7): ‘no claims or suggestion re. a food is a source of energy ‘

            Regulation 14 : ‘Misleading Statements’


14(8)): ‘No claim or suggestion that a food is a source of protein

14 (9a): ‘No claims on the absence of beef or pork or lard or added
          alcohol, if the food does not contain such ingredients’

14 (9b): ‘ No claims on the absence of any food additive or nutrient
supplement which is prohibited by the Regulations’
Part IV
                       GENERAL PROVISIONS
                          Regulation 16 :
        ‘Claims as to the presence of vitamins & minerals’

16(1): ‘No claims/implications based on the presence of vitamin &
mineral in a food shall be made on the label unless reference quantity
as laid down in Table II contains at least one-sixth of the daily
allowance as laid down in Table I for the relevant vitamin or mineral


16 (2): ‘No claims that any food is enriched, fortified, vitaminised or in
any way imply that the food is a source of one or more vitamins or
minerals unless the reference quantity contains not less than one half
of the daily allowance as laid down in Table I.

Note: Table I and II refer to copies of The Public Health (FOOD)
Regulations (R1 Chapter 182)

  • 7. 13 (3) : ’For the purpose of these Regulations, “nutrition claim” means a representation that suggests or implies that a food has a nutritive property, whether general or specific and whether expressed affirmatively or negatively, and includes reference to – (a) energy (b) salt, sodium or potassium; (c) amino acids, carbohydrate, cholesterol, fat, fatty acids, fibre, protein, starch or sugars; or (d) any other nutrients, But does not include a statement of ingredients or a declaration or claim relating to a vitamin or mineral **differs from Codex Nutrition & Health Claims which include vitamins & minerals

Part IV GENERAL PROVISIONS Regulation 14 : ‘Misleading Statements’ 14(1): ‘…..No food should be described /presented in manner that is false, misleading indicating its nature/character in any respect’ 14(2): ‘..no food to be described as ‘pure’ or any word of the same significance unless the food is free from other added substances………’ 14 (3): ‘no therapeutic claims or prophylactic action claims on any food’ 14 (4): ‘no claims which could be interpreted as advice of a medical nature from any persons whatsoever’ 14 (5): ‘no implications that a food will prevent, alleviate or cure any disease/condition’ 14 (6): ‘no words implying that health or an improved physical condition may be achieved by consuming any food’ 14 (7): ‘no claims or suggestion re. a food is a source of energy ‘

Part IV GENERAL PROVISIONS Regulation 14 : ‘Misleading Statements’ 14(8)): ‘No claim or suggestion that a food is a source of protein 14 (9a): ‘No claims on the absence of beef or pork or lard or added alcohol, if the food does not contain such ingredients’ 14 (9b): ‘ No claims on the absence of any food additive or nutrient supplement which is prohibited by the Regulations’

Part IV GENERAL PROVISIONS Regulation 16 : ‘Claims as to the presence of vitamins & minerals’ 16(1): ‘No claims/implications based on the presence of vitamin & mineral in a food shall be made on the label unless reference quantity as laid down in Table II contains at least one-sixth of the daily allowance as laid down in Table I for the relevant vitamin or mineral 16 (2): ‘No claims that any food is enriched, fortified, vitaminised or in any way imply that the food is a source of one or more vitamins or minerals unless the reference quantity contains not less than one half of the daily allowance as laid down in Table I. Note: Table I and II refer to copies of The Public Health (FOOD) Regulations (R1 Chapter 182)
