But the CoA said… In rejecting their appeal, Smith LJ conceded that there might be times when a local authority could 'side-step' their duties in this manner and that a private arrangement need not involve them. However in this case the local authority had played a major role in the settling the child and so were exercising their duties under s 20 of the Children Act.
