Se adjunta información elaborada por AFIBA en colaboración con el Ministerio de Industria
y ha sido presentada en el congreso de ANCERA del 7 de junio.
Lo más relevante es informar que se están vendiendo elevadores que no cumplen la
normativa vigente. Sólo son legales los Elevadores que incluyan dentro del manual la
Declaración de conformidad CE y que explícitamente digan que cumplen:
 Normativa Específica de Elevadores. 1493:2010. (En breve se publicará en el BOE que
NO SON VÁLIDAS las anteriores, es decir, la 1493:1999 y tampoco su posteriores
aclaraciones A1 2008 + A1 2009).
 Directiva CE: 2006/42 CE (en vigor desde el 29/12/2009)
Recordar que la Ley:
· Los Elevadores están clasificados como Maquinaria de Riesgo
· La ley 21/1992 (Modificación Ley 25/2009) en su título V establece infracciones graves e
incluso muy graves en caso de accidentes, con lo que podría conllevar sanciones de hasta
600.000 € e incluso la suspensión de la actividad.
· Todo ello, sin perjuicio de las posibles aplicaciones de los códigos civil y/o penal,
dependiendo de los casos.
· Se contempla tanto responsable al COMPRADOR / INSTALADOR / VENDEDOR /
FABRICANTE
· Otras observaciones importantes:
0. Industria No dará la licencia de apertura si el equipamiento no cumple con la
normativa.
1. Denuncias por Inspecciones laborales.
2. Ante un accidente, el Seguro del taller no se hará responsable al no cumplir la
normativa.
