It is an act to make
provision for the licensing,
regulation and control of
certain commercial places
and activities and for

16. It shall be lawful for His Majesty the Sultan and Yang Di-
Pertuan in Council by regulations to provide for:
Licensing, regulations and control of any place, trade or business or
occupation specified in the Schedule.
Defining and classifying for the purpose of any place, trade,
business or occupation for which a license may be issued.
The form and conditions of any license granted under this Act, the
authority who may issue such license and the fees thereof, and the
period for which such license shall be issued.
Precautions to be taken against fire in any place.
17. Maintenance of peace and good order in any place.
Means of securing hygienic conditions and requiring the
maintenance of such conditions in any place.
Entry and inspection of any place licensed under this Act.
Exempting any place, trade, business or occupation situated or
carried on within specified areas; and specifying and varying the
boundaries of such areas.
Generally carrying into effect the provisions this Act.
18. No person shall
open or keep open
at any place, or
conduct any trade,
business or
occupation
specified in the
Schedule except
under and in
accordance with a
license issued
under this Act.
The licensing
authority may
revoke a license
granted to any
person on proof to
his satisfaction of
an offence against
this Act or other
misconduct by such
person.
19. Every person who contravenes any
provision or regulation of this Act
shall be deemed to commit an
offence against this Act and if one
of them who commits or attempts to
commit any offence against this Act
shall be guilty of an offence:

20. APPLICATION FOR A LICENCE
An application for a
licence shall be
made in writing in
the form set out in
the Second
Schedule and shall
be accompanied by a
sketch plan showing
the complete layout
and boundaries of
any place sought by
the application to be
a licensed place.
Such an application
form shall be
signed by the
applicant or his
duly constituted
attorney. Also it
can be signed by a
director or the
secretary.
21. Every signature
shall be witnessed
by a witness who
shall also sign the
application form.
Licensing authority
may require
applicant to furnish
information.
A licence shall be
signed by an
authorised officer
in the form of set
out in the Third
Schedule.
No licence shall be
issued except after
the payment to the
licensing authority
of the appropriate
annual fee specified
in the Fourth
Schedule.
Every licence shall
continue in force
unless suspended,
cancelled or revoked
for a period of 12
months from the
date of issue.
23. REGISTER OF LICENCES
A licensing authority shall cause a register
to be kept of all licences issued by such
authority and shall enter in such register
the number of the licence, the name of the
licensee, the purpose for which any
license is granted, the location of any
licensed place and the date of the issues
and expiry of the licence.
24. DISPLAY, PRODUCTION AND
SURRENDER OF LICENCES
Every licensee shall cause his
licence to be exhibited in a
conspicuous and accessible position
on his licensed place or stall.
Every licensee shall produce his
licence by the licensing authority or
an authorised officer.
Every licensee shall surrender his
licence to the licensing authority
upon the expiration of the period for
which the licence is granted or on
the cancellation of the licence.
25. Fire precautions in Licensed
Places
A licensee shall install
and maintain the
satisfaction of the
licensing authority such
as fire-fighting
equipment, fire alarm,
sign and such
staircases and exits as
the licensing authority
or an authorised officer
may from time to time
require.
A licensee and every
person employed shall
be instructed in the use
of such fire-fighting
equipment and fire
alarm.
26. A licensee shall
be tested the fire
alarm once a
week and shall
be conducted in
accordance that
have been given
by the licensing
authority.
A licensee shall
procure that all
staircases,
passages and
landings in and
exits shall be kept
clear of all
obstructions and
that every door
shall be so
constructed and
fitted as to be
readily opened.
27. Maintenance of Peace and Good Order In
Licensed Places
A licensee shall
not permit any
gaming,
drunkenness, drug
abuse, prostitution
or disorderly
conduct of any
kind.
28. Hygiene and Maintenance of
Licensed Premises
A licensee shall
keep the place
clean and
maintained to
the satisfaction
of the licensing
authority.
A licensee shall
maintain the
structure of
any building in
good order and
repair.
A licensee shall provide and
maintain a clean and hygienic
condition such as bathroom,
water closets, wash basins
and other sanitary facilities.
29. Application For
Halal Certificate
Not consists of or contains any part or matter of an animal that a
Muslim is prohibited by Hukum Syara' to consume or that has not
been slaughtered in accordance with Hukum Syara’
Does not contain anything that is considered to be impure in
accordance with Hukum Syara’.
Has been prepared using an instrument that is free from anything
which is considered to be impure in accordance with Hukum Syara’.
30. Has not in the course of preparation or storage, been in contact
with or close proximity to any food that fails to satisfy and
anything that is considered to be impure in accordance with
Hukum Syara’
31. Any person who owns a business may apply to the
Majlis for a certificate in such form and shall comply
with such requirements, as the Majlis may determine.
The applicant shall be required to make one
application for:
Each type of business.
Each place of business in respect of any
business having more than one place of
business.
32. The Majlis may issue a Halal Certificate in the form
set out in the First Schedule to the applicant subject
to such conditions as the Majlis may think fit.
The certificate, unless sooner suspended or
revoked, shall be valid for one year from the date of
issue.
In the case of a breach of any of the conditions, the
Majlis may suspend or revoke the certificate and
order the certificate holder to remove the certificate
from exhibition.
33. Any person who makes use of the usage of the
expressions "Halal", "Ditanggung Halal" or
"Makanan Islam" or any other expression
indicating about Muslim food, other than the Halal
certificate, is guilty of an offence and liable on
conviction to a fine not exceeding $8000,
imprisonment for a term not exceeding 2 years or
both.
34. In case of expiry of the certificate,
the certificate holder shall apply
to renew his certificate not less
than 30 days prior to its expiry.
35. HALAL LABEL
The label shall be
in the form as set
out in the Second
Schedule and
shall be in the
form of a label,
tag, brand, mark,
pictorial or other
descriptive
matter, written,
printed,
stencilled,
marked, painted,
embossed,

form and shall
comply with such
requirements, as
the Majlis may
determine.
The applicant
shall be required

each type of food.
36. The Majlis may issue a
permit in the form set out
in the Third Schedule
authorising the applicant
to use the label on the
packages of the food
concerned, subject to
such conditions as the
Majlis may think fit.
In the case of a breach of
any of the conditions, the
Majlis may suspend or
revoke the permit and
order the permit holder to
remove or obliterate the
label used on the
packages of the food or to
dispose the food, in such
manner as the Majlis may
direct, and to discontinue
further use of the label.
Any person or business who makes use of
the usage of a label without a permit
authorising its use is guilty of an offence
and liable on conviction to a fine not
exceeding $8000, imprisonment for a term
not exceeding 2 years or both.
