HISTORY
• THIS CODE WAS DRAFTED IN 1860S ON THE
RECOMMENDATION OF FIRST LAW COMMISSION
OF INDIA ESTABLISHED IN 1834 UNDER GOVT OF
INDIA ACT 1833.
• THE CODE WAS NOT WELL ACTIVATED ON THE
PRINCELY STATES TILL 1940s.
• THE ELEMENTS ARE DERIEVED FROM NEPOLEON
CODE, EDWARD LIVINGSTON’S AND LOUISANA’S
CIVIL CODE.
OBJECTIVE
• THE OBJECTIVE OF THIS LAW IS TO MAKE A
GENERAL PENAL CODE FOR ALL OVER INDIA.
• THE INITIAL OBJECTIVE IS NOT SO. SINCE THIS LAW
CAN’T REPEAL THE EXISTING LAWS IN FORCE.
• THE CODE ALSO HAVE NOT ENOUGH OFFENCES
INCLUDED FOR IMPLEMENTING THE LAW.
