You must assess your proposed use on a case-by-case basis. • The NCU has guidelines to help you decide if your use falls under section 200AB.

Your use does not conflict with the normal exploitation of the material. • If you can buy the material in the format you need within a reasonable time, or obtain a licence for your proposed use on reasonable terms, then you must do so. Where you are copying an extract or portion of a work for a disabled student, you may be able to rely on the fair dealing for disability exception. You can rely on this exception regardless of whether the material that your student requires is commercially available.

  3. Copyright is a bunch of rights in certain creative works. Copyright protects a range of works. This includes musical works and sound recordings. A musical work can be the score, or both the score and lyrics. The copyright owner of the score may be different to the copyright owner of the lyrics. A sound recording might be a recording of the score only, or of both the score and lyrics. Examples of sound recordings are Apple or Spotify tracks, MP3 files, vinyl, CDs, audio cassettes, reel to reel tapes and any other method for recording and storing sounds. A sound recording generally comprises the sound recording as well as the musical work that has been recorded.
  4. Speaking note: Generally, the composer or music publisher owns copyright in the musical work, and the record label owns copyright in the sound recording. So when dealing with music, there may be more than one copyright owner eg if you use a CD it may be the record (record label plus composer/publisher of underlying musical work). For some songs, one person may own © in the lyrics and another in the music notations.

TAFEs are more likely to be able to rely on the exception to copy materials for practice exams, if: (a) the practice exam has a question and answer format; (b) students are asked to complete the practice exam either: (i) in class in a 'test' setting; or (ii) in a more informal setting either in or outside the classroom but with certain time restrictions (i.e. where students are told to complete the practice exam by the end of the class, or if they are taking it home by the end of the week); (c) a teacher is to review students' responses to the practice exam and provide some form of feedback or a mark to the student; and (d) the purpose of the practice exam is to inquire into or assess the students' performance/capabilities.

  12. When you use a sound recording, you need permission to use both the musical work and the sound recording of that musical work. If you are only reproducing or performing the musical work (eg by playing the music with an instrument or singing the song yourself), you only need permission from the owner of copyright in the musical work.
  13. Benefits of CC Cheaper: saves money on copyright fees and administrative costs of seeking permission. Education resources can be shared freely online with very low transaction costs. Equitable: offers equal access to knowledge for everyone and allows for education resources to be adapted for minorities and those with disabilities. Collaborative: encourages collaboration and creates communities based on sharing of education resources. Can share resources on public websites and social media. Adaptable: enables educators to reuse, remix and adapt resources since the copyright owner has already given permission to everyone (eg by translating or using local examples). Safer: free to reuse, remix, redistribute and adapt education resources without running the risk of breaching the complex copyright rules. Internet compatible: it is better adapted to the Internet and the freedom which the Internet provides to copy, distribute, adapt and remix resources. Accessible: over 2 billion Creative Commons licensed works. There are 4 licence elements which are mixed to create six CC licences:  Attribution – attribute the author Non-commercial – no commercial use No Derivative Works – no remixing ShareAlike – remix only if you let others remix

Sound recordings (eg podcasts): mention the name of the artist during the recording (like a radio announcement) and provide full attribution details in text near the podcast where it is being stored (eg blog, TAFE intranet, learning management system etc). Video works (eg YouTube clip): near the work as it appears on screen during the video.
