What is an ESD?
• ESDs are local political subdivisions that
may provide fire, rescue, EMS and other
emergency services
– Governed by 5 commissioners appointed by
County Commissioners Court - except in
Harris, Smith and Orange Counties and multicounty ESDs, where they are elected
– Primarily funded by property taxes not to
exceed $0.10

ESD Commissioners
• Board of five commissioners.
• Appointed by Commissioners Court for 2 years
– at least 18 years of age; and
– a resident citizen of the state that is:
• a qualified voter within district; or
• owner of land subject to taxation in the district.

• Commissioners of Multi-County and Harris
County ESDs are elected at-large for 4 years
• Commissioners of Smith and Orange Counties
are now elected, but the law requires singlemember districts (SB 1265 from 2013

Open Government Training
• Effective January 1, 2006, elected and appointed
public officials are required by a state law to receive
training in Texas open government laws.
• The law requires at least two hours of open
government training, consisting of:
– a one-hour educational course on the Open Meetings Act
and
– one-hour educational course on the Texas Public
Information Act.

• Recording by Others
– A person in attendance may record all or any part of
an open meeting of a governmental body by means of
a tape recorder, video camera, or other means of aural
or visual reproduction.
– A governmental body may adopt reasonable rules to
maintain order at a meeting, including rules relating to:
• the location of recording equipment; and
• the manner in which the recording is conducted.

– The rules may not prevent or unreasonably impair a
person from exercising a right granted to record.

• A district located wholly in one county shall
prepare and file with the commissioners court of
the county on or before June 1 of each year an
audit report of the district's fiscal accounts and
records. *
• The person who performs the audit and issues
the report must be an independent certified
public accountant or firm of certified public
accountants licensed in this state.
*except Harris County - 30 days after receipt.

• If a district (not in Harris County) fails to
complete and file the required audit report by
September 1st and a county auditor is not
ordered to prepare the report, the board
president and treasurer are automatically
removed and the commissioners’ court is
required to fill the vacancies.

• Failure to perform audit in Harris County ESDs
may be grounds for removal from Board.

• ESD may only have to prepare compiled
financial statements if:
– No more than $250,000 in revenues in prior
year
– No more than $250,000 in cash and
investments in previous year; and
– No outstanding debt or liabilities with term of
more than one year.

Payment of District Funds
• District funds may be disbursed only by check
signed by the treasurer and countersigned by
the president.
• If the treasurer or president is absent or
unavailable, checks must be signed by at least
three board members.

Depositories
• The board shall designate one or more banks
to serve as depositories for district funds.
• The board shall deposit all district funds in a
depository bank, except that the board: (1)
may deposit funds pledged to pay bonds or
notes with banks named in the trust indenture
or in the bond or note resolution; and (2) shall
remit funds for the payment of the principal of
and interest on bonds and notes to the bank
of payment.

Depositories
• The district may not deposit funds in a
depository or trustee bank in an amount that
exceeds the maximum amount secured by the
Federal Deposit Insurance Corporation unless
the excess funds are secured in the manner
provided by law for the security of county
funds. (Currently $250,000)
• The resolution or trust indenture securing the
bonds or notes may require that any or all of
the funds must be secured by obligations of or
unconditionally guaranteed by the federal

• A local public official commits an offense if the official
knowingly:
– violates Local Government Code Section 171.004 (Next

– both positions must be “offices”
– the relationship between the positions creates
conflict
• if authorized to contract with each other
• if both have the power of taxation
– even if one district imposes an ad valorem property tax and the
other imposes a sales tax that must be approved by the voters.

– incompetency
– official misconduct
– misconduct

• Removal deliberation subject to 551.0745, Government

personnel matters).

cause why the board member should not be removed.

– No training as required
– Definition in Chapter 87 of Local Gov’t Code:
• gross ignorance of official duties;
• gross carelessness in the discharge of those
duties; or

time of the officer's election.
