Assignment 3b

  1. 1. Assignment3b I have beenbespokentowrite areportonthe differenttypesof legislationswithintelevisionand filmindustries. The mainpurpose of thisreportistocomprehendthe type of legislationsandhow each employermustfamiliarisethemselveswiththe lawsthathave beenputintoplace andthe ethical issues. There are twokeylawsthat I am willingexpandmyknowledge on, theyinclude; healthandsafetylegislations, equalopportunities, employmentliabilities, rightsandemployment equalityregulations. Iamalso willingtounderstandthe differencesbetweencopyrightandtrade mark and I will illustrate eachpointbygivinganexample. The employmentlegislationstates the legal rightsbetweenemployersandemployees.Thishasbeen introducedin1996 by the Housesof Parliament, toensure the lawsare usedmycompaniesto protecttheirworkers. The reasonwhythe Houses of Parliamentinitiatedthisrule wasthatpeople livinginurbanareaswere The Healthand SafetyAct1974 statesthat everyemployerof anybusinessmustbe givenabrief account of a company’s healthandsafetylegislation. The purposeof healthandsafetypoliciesisto ensure thatan employerobeysandunderstandthe HealthandSafetyActandits legislation.Every companyinthe worldhasto provide basicguidelinesforimplementingthe regulationsthatwill ensure all hazardsare decreasedandprotectthe livesof employers.Iwantto developmy understandingof the basicregulationsthe BBChaspublishedinorderfortheirworkerstoobey. It will wouldverybeneficialforcompaniestoproduce adetailedyeteasyforpeopletocomprehend, so everyworkerisclearaboutthe rulesand nothingismislead.Onthe otherhand, thiswill ensure no accidentsorany workrelatedmisfortuneshappen, andacompanywill have more time on focusingontheirproductivity. Goingbackthe pointaboutthe HealthandSafetyAct,companies have to ensure theyunderstandthe purpose of the OccupationalSafetyandHealthAct,whichstates that employersorcompanymanagershave tomake theiremployeesaware of the safetystandards of theircompany.Thisisveryimportantbecause itwill allowthe companytopractise fire drillsto eradicate the potential riskstoemployees.Personally, thislegislationallowsacompanyto be ready for anylife ordeathsituationsthatcouldoccur. Due to this, thiswill make employeesaware of fire escapesandtheycomprehend thisforthe future. Equal opportunitiesare alegislationthathasbeenbroughtinbythe governmenttostopemployers beingdiscriminated.Discriminationinthe workplace caneitherbe due torace, gender, sexuality, disabilityandage.Itisa veryimportantlegislationbecauseitwill allow peoplewhoworkfull-time, part-time oron a fixedtermcontractto be treatedwithintegrityandrespect.Eachindividualwill be betterat mosttasks thanotherworkersand thiswill increase productivityandefficiencyof a company. If an employerfeelsdeprivedorintimidatedbyothers, thenitisessential forthemto reportthe concernsbecause itwould butthe companyunderpressure of failingtomeetthisrule set out bythe governmentanditwill leadtodisciplinaryproceedings.Todevelopmyunderstandingof thismatter,I have decidedtoinvestigate the equal opportunitieslegislationsetoutbythe BBC. For any organisation, like the BBC,itisveryessential togetas many diverse people aspossible inorder not to create programmesportrayingacertainrace. My comprehensionof the BBC’sequal opportunitiesisthatcreatinga motivatedworkplaceenvironmentthatwill allow people toshow theirpotential andthrive in theirjobroles.Equallyvaluingandrespectingwhateachindividual will bringto the BBC is veryimportantandtheydo not tolerate people beingdisadvantaged.Thisshows
  2. 2. that the BBC has compliedwiththe legislationthateverycompanyhastocomplywith.Ihave mentionedinthe previousassignmentthatthe BBC have doesnotcondemnthistype of behaviour.I have foundseveral articlesregardingthismatterandthe BBC publishedanarticle regardingafemale boxerwhocomplainedtothe sportinggoverning bodiesaboutherequalityandhumanrightscase. Her argumentwasthat manyfemale boxersare notgiventhe opportunitiestoshowcase theirskills or to aspire theirdreams. Furthermore, the femaleboxersfiledacomplaintbywritingaletterand statedtheirintentionsthatthere wasa lackof financial investmentintraining campsor tournamentsforthemto enter. The nextlegislationIwantto focuson isEmploymentliability. Employmentequalityregulationon age wasfirsttookplace on 1st October2006, and it wasestablishedtostoppeoplebeing differentiatedfromotherpeople.Thisregardspeople whoare jobtrainingwithinanorganisationor full time orpart time employers. There are twotypesof discriminationthislaw covers direct discriminationandindirectdiscrimination.Directdiscriminationisaboutbeingbiasedorshowing more favouritismtootherperson, possiblyof yourownage.Thismay involve someonedecidingnot to take on someone because of theirage, orpeople withinaspecificage groupdo notlookphysically up fora certainjob.Whereas, indirectdiscriminationoccurswhenanorganisationsetsoutcertain conditionsorrulesthatcan have an impact ona small groupof people.Mostof the time, thisform of discriminationisusuallyunintentional butpeopledosee itasdiscrimination. If youwere goingto applyfora specificjobrole thatrequiresyoutohave experiencewithinthisjobrole ordepartment youngerpeople, especiallygraduates, are ata disadvantage. There are otherimportantfactorsof thislaw, victimisationandharassment, butthese two(directandindirectdiscrimination)are easier to understandandiseasierforme to elaborate mypoints. The problemwiththisisthatcertain organisationsdon’tstate the numberof yearsexperience neededtofittheirjobvacancy. My honest opinionisthatthislegislationisvital because hadthisnothave beenintroducedbefore, many people todaymayface bothdirectand indirectdiscriminationbecause of theirage. Each individual will bringsomethingdifferenttoacompany;it doesnot matterabouttheirage.Going intothe last sentence inmore detail, youngeroroldercandidatesthatare lookeduponmaypossessqualities that experiencedpeople have suchasenthusiasmorthe willingnesstolearn. Whenit comes to operatingyourbusiness, there are situationsthatyouremployeesare likelyto come across such as gettinginjuredcarryingequipment. There isonlyone type of insurance thatwill save your companymoneyandgive compensationtothe injuredpersonanditis employer’sliability. Employer’sliabilityis atype of insurance thateverybusinesshastoensure thattheyhave. The purpose of thisinsurance isto getcoverif people workingatthe businesssufferinjurieswithinthe workplace. Foreverydeathorinjurythathappens, youwill be able topaycompensationtothe personsuffering.Inthe televisionindustry, youmaybe filmingatelevisionprogramme andone of the workersfallsoverequipmentleftlyingonthe floor.Theywill be entitledtoclaimcompensation and thisinsurance will coverall the costs. Icannot findanyinformationthatpublishedbythe BBC regardingthismatter. An employmentrightis alawthat came intoplace on22nd August1996, and the reasonfor thiswas to setout the rightsemployeeshave. If companiesbreachthislaw, thenthe Employmenttribunals are obligatedtotell the companytogive itsemployeescompensation. Thislegislationallowspeople to understandwhatrightshave theyandI will bulletpointoutliningthismatter.
  3. 3.  Employeesgettingthe national minimumwage. The currentrate ispeople whoare 21 and overwill receive £6.31,18-20 yearoldreceive £5.03, people under18 receive £3.72 and apprentices willearn£2.68.  Employeeswill receiveprotectionfromanydecrease fromtheirwages  A brief accountof the amountof moneyemployeeswill receiveduringthe holidays  Receive protectionfromany formof discrimination, whichIhave explainedinthisreport  Employeesworkingonapart-time basisshouldbe treatedaspeople workingonafull time basis.Thisformof discriminationisnotacceptable inanyorganisation. The BBC have publishedavideoaboutaman whowas workingasa paperroundboy wasdismissed fromhis vacancywhenhe wenton holidaywithhisfamily. The teenageboywasdismissedwithno apparentreasonand he thenwentto fighthisclaimforunfairdismissal.Afterthat, the boynamed Christopherwoniscase and claimedhiscompensationfromthe paperroundcompany. Inmy opinion,Iunderstandthatthislegislationisveryimportantanditcoversa range of different scenarios.Itwill be difficultforme togo trougheach one to geta basicunderstanding, butIknow that everyorganisationhastohave a certainlevel of comprehensionof thislaw. Followingupfrom the paperround situation, ayoungmanwho workpart-time wasdiscriminatedagainst.Noone shouldgothroughany formof discriminationwithinthe workplace. Trade unioncanbe definedasagroup of people whoare withinaparticularsector, whowishto negotiate adeal withemployeesabouttheirwages, workinghoursandjobsecurity. Majorityof trade unionsare usuallyindependent, sotheywillworkandoperate ontheirownwithoutany assistance fromelsewhere. Te basicfundamentalsof trade unionsare todiscussthe changeswithin the business, provideanexplanationonlegal andfinancial recommendationtotheiremployees.Itis importantforcompaniestobe in a unionbecause itwill allow themtobuildarelationshipwith people inthe workplace sothere isgoodcommunicationstogetmessagesacrossthe hierarchy. Ensuringa safe workingenvironmentisveryimportant, asitwill decrease the average percentage of injurieswithinthe workplace.Personally, the nextbenefitisveryimportantthateverytrade union shouldensure.Trade unionsshouldpromote the businesstoshow there isnoform of discrimination and eachindividual istreatedwithintegrityandrespect. There are onlyasmall numberof trade unionsthatsupporttelevisionindustries, andthe one Iwill be usingisPACT.ThisunionisUK organisationthatrepresentsandpromotesparticularindependentcompaniesthat have vested interestinfilmorcreative contents. There twobenefitsof companiesbelongingtoa union, they include:  Employeeswill understandthatthe organisationtheyworkforwillallow themtoincrease theirwages.  Theyensure thateach employeeisprotectedfromanyharmsuchas discrimination, exploitationandhealthandsafety. Everybusiness, whethertheyare inthe televisionindustryorotherindustrieshave toconsider makingtheirbusinessname orthe type of service youwill provide toyourpotential customers. The Intellectual Property isalegal documentthatisessential foranybusinessshoulduse sothatinthe future theymaynot be breachinganyrules. If a new televisioncompanywasintroduced, youwill wantyour name to be safe.Once you have registeredyourbusinessname noone isauthorisedto use your businessname.Letme lookatthisfurtherfromthe televisionindustry, butmore into
  4. 4. business.Manyentrepreneursatmarketslike CamdenLockMarketsell productsthathave brand namesthat donot belongtothem. If theywere to be caught, theywill be facinga lotof consequenceswiththe governmentandthe companyitself. Thatiswhyyoudon’t see many companiescomplainbecausetheywill getthose thievesfacingahuge penalty, whichwilltake them several yearstopay off and go throughcourt cases. Like Isay, as soonas you are willingtostart-up your ownbusinessandyouhave a goof businessname, getthatname registeredassoonas possible before someone usesthatname. Copyright, onthe otherhand,is completelydifferenttointellectual propertyalthoughitispartof the intellectual property.Copyrightisatype of ownershipthatisestablishedtoprotectnotyour companybut the workyou produce.Thismeansif Iwere to create a reportof the typesof funding withinthe televisionandfilmindustry, noone isallowedtocopymy workwithoutanyone getting consentfromme.Nowadays, yougetmanyschool childrenyouare strugglingtofindout informationforaparticularhomeworkorresearchtask andthe internetisthe easiestwaytoget creditfor somethingthatdoesnotbelow toyou.Anotherexample isthatIam producingmyown musicvideofora school project.Ican use musicthat isownedbysomeone else, butIhave to ensure that my musicvideoisnotpublishedanywhere thatwill getme penalisedbythe authorities. If Iwas to getcopyrightfor mywork, there are a few advantagesof this, theyinclude  No registrationprocessrequired,soIdon’thave to worryabout goingthroughso many stages  It preventsanyindividual’sworkbeingstolensoyoudon’thave toworryabout protection. Like I said,if I wasgoingto copy workoff the internet, there are manyplagiarismsoftware’s that detectwhetherapiece of workisstolen.  The protectionwill lastfora substantial periodof time Lastly, trade mark is usedbybusinesstoplace a small signonparticularproductsand itwill reinforce that yourcompetitorswill notbe allowedtocreate yourproduct. This type f protectionmaynot be 100%, butit doesensure to scare awaycompetitors. If youbeleive thatyourideaorinventionisat risk, thenimportantthatyou ensure thatitcannot otherscannotcreate theirversionof your inventionorproduct. There are a fewadvantagesof companiesusingthe trade arksymbol toscare away competitor, theyinclude:  It isveryeasyand quickfor people toregistertheirproductsthroughlegal processes  Notonlywill thistype of protectionblockothersinthe UKdevelopingyourinventionor product, othercompaniesaroundthe worldwill be barredfromcopyingyourinvention,so youwon’thave to worry.  You will be allowedtotake the companyor individualtocourtfor infringingthe legislation on trade marks.
