THE EMPLOYMENT EXCHANGES

(COMPULSORY NOTIFICATION OF VACANCIES)

ACT,1959

ACCORDING TO ITS PREAMBLE, THIS ACT PROVIDES FOR
THE COMPULSORY NOTIFICATION OF VACANCIES TO
EMPLOYMENT EXCHANGE.
Objectives of the Act 1959

To help the unemployed persons ,both skilled
and unskilled and semi-skilled, to seek suitable
employment



To enable government to formulate its policy
of training in technical education



To access the employment potential in various
categories of establishments and to have a
better appreciation of the labor market.

Application of the Act

The Act covers the employers in establishments both in public and
private sectors .It is applicable to establishments which are
engaged in non-agricultural activities and employing 25 or more
workers.
This act shall not apply in relation to vacancies(Section 3):

In any employment in agriculture ( including horticulture) in any
establishment in private sector other than employment as
agricultural or farm machinery operatives;



In any employment in domestic service;



In any employment the total duration of which is less than three
months;



In any employment to do unskilled office work;



In any employment connected with the staff of Parliament.

EMPLOYMENT EXCHANGES

It means any office or place established and maintained
By the Government for the collection and furnishing of
information, either by the keeping of registers or otherwise,

in respect of :


persons who seek to engage employees.



persons who seek employment, and



vacancies to which persons seeking employment, may
be appointed .

Establishment

Establishment means any office, or any place where any industry,
trade, business or occupation is carried on. The presence or
absence of profit motive is not relevant in determining whether a
particular organization Is An establishment as understood under the
act. Establishment in public sector means an establishment owned,

controlled or managed by --•

The Government or a department of the Government

•

A Government Company

•

A corporation established by or under a Central, Provincial or
State Act, which is owned, controlled or managed by the
Government

•

A local authority

Establishment in Private Sector

Establishment in private sector means an establishment which
is not an establishment in public sector and where ordinarily
twenty-five or more persons are employed to work for
remuneration.
Unskilled Office Work means work done in an establishment
by any of the following categories of employees namely:
 Peon
 Dusting man
 Bundle or record lifter
 Watchman
 Sweeper

Notification of Vacancies to
employment exchanges (Section 4)
•

Before filling up any vacancy as prescribed.

•

Employer not obliged to recruit the person through
employment exchange.

•

To notify the vacancies to such employment exchanges as
may be prescribed

Time limit for the notification of Vacancies. Vacancies
required to be notified to the local employment exchange
,shall be notified at least one week before the date on which
applicants may be interviewed, Vacancies required to be
notified to Central employment exchange shall be notified 3
weeks before the date .

Furnishing information and
returns(section 5)

After the commencement of this Act in any State or area thereof,
the employers in every establishment in public sector in that State
or area shall furnish such information or return as may be
prescribed in relation to vacancies that have occurred or are
about to occur in that establishment, to such employment
exchanges as may be prescribed.
 The appropriate Government may, be notification in the Official
Gazette, require that from such date as may be specified in the
notification, the employer in every establishment in private sector
or every establishment pertaining to any class or category of
establishments in private sector shall furnish such information or
return as may be prescribed in relation to vacancies that have
occurred or are about to occur in that establishment to such
employment exchanges as may be prescribed, and the
employer shall thereupon comply with such requisition.
 The form in which, and the intervals of time at which, such
information or return shall be furnished and the particulars which
they shall contain shall be such as may be prescribed.


Right of access to records or
documents (section 6)


Such Officer of Government as may be prescribed
in this behalf, or any person authorized by him in
writing, shall have access to any relevant record or
document in the possession of any employer
required to furnish any information or returns under
Section 5 and may enter at any reasonable time
any premises where he believes such record or
document to be and inspect or take copies of
relevant records or documents or ask any question
necessary for obtaining any information required
under that section.

Penalties (section 7)


If any employer fails to notify to the employment
exchanges prescribed for the purpose any vacancy
in contravention of provisions, he shall be punishable
for the first offence with fine which may extend to
Rs500 and for every subsequent offence with fine
which may extend to Rs 1000



In case of non –compliance with the provisions of
section 5 and 6 ,he shall be punishable for the first
offence with fine which may extend to two hundred
and fifty rupees and for every subsequent offence
with fine which may extend to five hundred rupees.

Power to make rules(section 10)









The Central Government may, by notification in the Official
Gazette and subject to the condition of previous publication,
make rules for carrying out the purposes of this Act.
The employment exchange or exchanges to which, the form
and manner in which, and the time within which, vacancies
shall be notified, and the particulars of employments in which
such vacancies have occurred or are about to occur;
The form and manner in which and the intervals at which,
information and returns required under Section 5 shall be
furnished, and the particulars which they shall contain;
The officers by whom and the manner in which the right of
access to documents and the right of entry conferred by
Section 6 may be exercised;
Any other matter which is to be, or may be, prescribed under
this Act.

  • 1. 1 THE EMPLOYMENT EXCHANGES (COMPULSORY NOTIFICATION OF VACANCIES) ACT,1959 ACCORDING TO ITS PREAMBLE, THIS ACT PROVIDES FOR THE COMPULSORY NOTIFICATION OF VACANCIES TO EMPLOYMENT EXCHANGE.

Objectives of the Act 1959 2  To help the unemployed persons ,both skilled and unskilled and semi-skilled, to seek suitable employment  To enable government to formulate its policy of training in technical education  To access the employment potential in various categories of establishments and to have a better appreciation of the labor market. www.universestuff.com

Application of the Act 3 The Act covers the employers in establishments both in public and private sectors .It is applicable to establishments which are engaged in non-agricultural activities and employing 25 or more workers. This act shall not apply in relation to vacancies(Section 3): In any employment in agriculture ( including horticulture) in any establishment in private sector other than employment as agricultural or farm machinery operatives;  In any employment in domestic service;  In any employment the total duration of which is less than three months;  In any employment to do unskilled office work;  In any employment connected with the staff of Parliament. www.universestuff.com

EMPLOYMENT EXCHANGES 4 It means any office or place established and maintained By the Government for the collection and furnishing of information, either by the keeping of registers or otherwise, in respect of :  persons who seek to engage employees.  persons who seek employment, and  vacancies to which persons seeking employment, may be appointed . www.universestuff.com
  • 5. 5 Establishment Establishment means any office, or any place where any industry, trade, business or occupation is carried on. The presence or absence of profit motive is not relevant in determining whether a particular organization Is An establishment as understood under the act. Establishment in public sector means an establishment owned, controlled or managed by --• The Government or a department of the Government • A Government Company • A corporation established by or under a Central, Provincial or State Act, which is owned, controlled or managed by the Government • A local authority www.universestuff.com

Establishment in Private Sector 6 Establishment in private sector means an establishment which is not an establishment in public sector and where ordinarily twenty-five or more persons are employed to work for remuneration. Unskilled Office Work means work done in an establishment by any of the following categories of employees namely:  Peon  Dusting man  Bundle or record lifter  Watchman  Sweeper www.universestuff.com
  • 7. 7 Notification of Vacancies to employment exchanges (Section 4) • Before filling up any vacancy as prescribed. • Employer not obliged to recruit the person through employment exchange. • To notify the vacancies to such employment exchanges as may be prescribed Time limit for the notification of Vacancies. Vacancies required to be notified to the local employment exchange ,shall be notified at least one week before the date on which applicants may be interviewed, Vacancies required to be notified to Central employment exchange shall be notified 3 weeks before the date . www.universestuff.com

Furnishing information and returns(section 5) 8 After the commencement of this Act in any State or area thereof, the employers in every establishment in public sector in that State or area shall furnish such information or return as may be prescribed in relation to vacancies that have occurred or are about to occur in that establishment, to such employment exchanges as may be prescribed.  The appropriate Government may, be notification in the Official Gazette, require that from such date as may be specified in the notification, the employer in every establishment in private sector or every establishment pertaining to any class or category of establishments in private sector shall furnish such information or return as may be prescribed in relation to vacancies that have occurred or are about to occur in that establishment to such employment exchanges as may be prescribed, and the employer shall thereupon comply with such requisition.  The form in which, and the intervals of time at which, such information or return shall be furnished and the particulars which they shall contain shall be such as may be prescribed.  www.universestuff.com
  • 9. Right of access to records or documents (section 6)  9 Such Officer of Government as may be prescribed in this behalf, or any person authorized by him in writing, shall have access to any relevant record or document in the possession of any employer required to furnish any information or returns under Section 5 and may enter at any reasonable time any premises where he believes such record or document to be and inspect or take copies of relevant records or documents or ask any question necessary for obtaining any information required under that section. www.universestuff.com
  • 10. 10 Penalties (section 7)  If any employer fails to notify to the employment exchanges prescribed for the purpose any vacancy in contravention of provisions, he shall be punishable for the first offence with fine which may extend to Rs500 and for every subsequent offence with fine which may extend to Rs 1000  In case of non –compliance with the provisions of section 5 and 6 ,he shall be punishable for the first offence with fine which may extend to two hundred and fifty rupees and for every subsequent offence with fine which may extend to five hundred rupees. www.universestuff.com
  • 11. Power to make rules(section 10)     11 The Central Government may, by notification in the Official Gazette and subject to the condition of previous publication, make rules for carrying out the purposes of this Act. The employment exchange or exchanges to which, the form and manner in which, and the time within which, vacancies shall be notified, and the particulars of employments in which such vacancies have occurred or are about to occur; The form and manner in which and the intervals at which, information and returns required under Section 5 shall be furnished, and the particulars which they shall contain; The officers by whom and the manner in which the right of access to documents and the right of entry conferred by Section 6 may be exercised; Any other matter which is to be, or may be, prescribed under this Act. www.universestuff.com
