SUBJECT: An Ordinance Declaring Unopposed Candidates in the May 7, 2022 General
Election, Elected to Office; Cancelling the Election; and Providing an Effective Date

SUMMARY
An Ordinance declaring unopposed candidates in the May 7, 2022 General Election elected to
office; cancelling the election; and providing an effective date.
BACKGROUND INFORMATION
This ordinance declares that the following candidates, who are unopposed in the May 7, 2022,
General Election, are elected to office and shall be issued Certificates of Election following the time
the election would have been canvassed.
Blake M. Bonner is declared elected Councilmember, Place Three.
Lynda Billa Burke is declared elected Councilmember, Place Four.
John Savage is declared elected Councilmember, Place Five.
The Ordinance also directs the City Secretary to post a copy of this ordinance on Election Day at
each polling place that would have been used in the election.
POLICY ANALYSIS
The City Secretary has certified in writing that no person has made a declaration of write-in
candidacy, and that each candidate on the ballot is unopposed for election to office. Under these
circumstances, Election Code Chapter 2, Section 2.053(a) authorizes the City Council to declare the
candidates elected to office and cancel the election.
FISCAL IMPACT
There is no additional cost for this election.

AN ORDINANCE DECLARING UNOPPOSED CANDIDATES FOR
THE OFFICES OF CITY COUNCILMEMBER PLACE #3,
COUNCILMEMBER PLACE #4, AND COUNCILMEMBER PLACE
#5 IN THE MAY 7, 2022 GENERAL ELECTION ELECTED TO
OFFICE; CANCELLING THE ELECTION; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE
WHEREAS, City Council adopted an Ordinance on February 14, 2022 ordering a
general election to be held on May 7, 2022, for the purpose of electing City Councilmember
Place #3, City Councilmember Place #4, and City Councilmember Place #5, to the City Council;
and
WHEREAS, pursuant to Sections 143.007 and 146.054, Texas Election Code, the
deadlines for filing applications for a place on the ballot and declaration of write-in candidacy
for the City’s general election have expired; and
WHEREAS, the City Secretary has certified in writing that no person has made a
declaration of write-in candidacy, and that each candidate on the ballot is unopposed for election
to office; and
WHEREAS, the City Secretary, the person responsible for having the official ballot
prepared, certifies that the following candidates are unopposed for election to office for the
election scheduled to be held on May 7, 2022:
FOR COUNCILMEMBER PLACE 3: BLAKE M. BONNER
FOR COUNCILMEMBER PLACE 4: LYNDA BILLA BURKE
FOR COUNCILMEMBER PLACE 5: JOHN SAVAGE
WHEREAS, under these circumstances, Subchapter C, Chapter 2, Section 2.052, Texas
Election Code, authorizes the City Council to declare the candidates are unopposed and cancel
the General election;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ALAMO HEIGHTS THAT
SECTION 1. The following candidates, who are unopposed in the May 7, 2022 general
election, are declared elected to office pursuant to Subchapter C, Chapter 2, Section 2.053(a),
Texas Election Code and shall be issued Certificates of Election following the time the election
would have been canvassed:
Blake M. Bonner is declared elected Councilmember, Place Three.
Lynda Billa Burke is declared elected Councilmember, Place Four.
John Savage is declared elected Councilmember, Place Five.

SECTION 2. The May 7, 2022, general election is cancelled, and the City Secretary is
directed to cause a copy of this ordinance to be posted on Election Day at each polling place that
would have been used in the election.
SECTION 3. The City Secretary is hereby directed to post an Order notifying the citizens
of the cancellation of the General Election at City Hall and on the City’s website.
SECTION 4. Term of office for the unopposed Councilmembers shall commence on May
9, 2022 after the Oath of Office has been administered and executed.
SECTION 5. It is declared to be the intent of the City Council that the phrases, clauses,
sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause,
sentence, paragraph, or section of this ordinance is declared invalid by the judgment or decree of
a court of competent jurisdiction, the invalidity shall not affect any of the remaining phrases,
clauses, sentences, paragraphs, or sections of this ordinance since the City Council would have
enacted them without the invalid portion.
SECTION 6. This ordinance shall take effect upon its final passage, and it is so ordained.
