2. The CAN-Spam Act in a nutshell
The CAN-Spam Act applies to any commercial electronic
mail message and states:
• Do not use misleading subject lines or from lines - be
direct, honest and open.
• Don’t use false header information- identify yourself
clearly.
• Do not send to harvested email addresses or through an
open relay.
• State your legitimate physical address.
• Include a clear ‘opt-out’ system.
• Process any ‘opt-outs’ you receive promptly (within
10 days.

• The USA’s 2003 CAN-Spam Act is considered the
industry benchmark for e-mail marketing best
practice.
• CANSPAM applies to all commercial messages-
whether to an individual or a business.
4. More about the UK Law
• Many of the UK’s E-mail Marketing Regulations come
from the 2002 E-Commerce Regulations and the
2003 Privacy and Electronic Communications
Regulations (Both EU Directives).
• Businesses cannot send e-mail marketing
communications to unsolicited individuals unless
they have opted in or are a pre-existing customer.
• You can e-mail other businesses as long as you
include an ‘opt-out’ clause.

Marketing by email to individuals and companies must
clearly identify:
• That it is a commercial communication.
• The person who is sending it and, where appropriate,
that the communication is a promotional offer.
• Failure to comply with the regulations could result in
a fine of up to £5,000.
