6. Conditions to use Cashna
Cashna – Seller Terms & Conditions
1. Cashna (cashna.com) provides services as an Internet Payment Service Provider. Cashna services are
provided to registered Sellers who sell products and services online. Seller hereby appoints CASHNA as
a payment method to process the Seller’s online payments and offer other services as provided under
this Agreement. Seller may use CASHNA payment services to allow their Customers to purchase
products or services using their Cashna Points. Seller agrees to promptly deliver to its own Customers
all sold products and services thru CASHNA.
2. Standard Commission. CASHNA's transaction commission is based on the Payment Plan Offer the Seller
has signed to.
3. Integration of CASHNA. Seller will develop and maintain their Web site(s), which will advertise and
describe the products services that will be charged through CASHNA. After receipt of each valid
customer order, CASHNA will send the Seller a Transaction Receipt via E-mail, and CASHNA will also
post the order on the Seller’s User Interface screen. Seller will deliver the ordered product(s) and
service(s) to the Customer, and if requested by Buyer, CASHNA will promptly acknowledge the
shipment or Service Delivery using CASHNA’s Follow-Up Process. Seller agrees to deliver all
merchandise to Customers without any delay. Seller will not offer back ordered or out-of-stock products
for sale unless another agreement signed by CASHNA and the Seller. If Seller is unable to ship any part
of any Customer order within 30 business days, Seller will cancel and Refund the Customer in that case.
There will be no partial shipments made by Seller unless agreed upon with Cashna in a separate written
agreement.
4. Cashout from CASHNA to Seller. CASHNA agrees to pay Seller for all products and services charged by
CASHNA as described in this agreement. CASHNA will charge Buyer's Cashna card upon the completion
of the order and pay amount minus commission and if applicable transaction fees to the Seller. The
payment due Seller is equal to the sum of all Customer Charges for products that have been delivered
within the specified time period LESS: (I) All disputes, inquiries, and/or refunds processed on account of
Seller's Customer Charges during the payment period. (ii) The CASHNA commission fee and any
applicable per transaction charges.
5. Seller's Cancellation of the service. The Seller may cancel this Agreement with 30 days notice given to
CASHNA. CASHNA shall terminate this Agreement and shall no longer charge for Seller's products or
services to Customers after notice of cancellation is received. Any previous transactions will be paid as
scheduled. The Seller is obligated to fulfill or cancel any Customer Orders submitted before the
cancellation.
6. General Terms and Conditions for the service. a. Cash Advances. CASHNA will not make cash advances
to anybody. b. Losses by either party. Seller shall not hold CASHNA responsible for any claims,
expenses, and losses that may have occurred for any reason in connection with the charge of sale of
Seller's Product(s) to Customers by CASHNA. This will include the costs and expenses of Customer
refunds and/or returns as well as any cost that may have occurred during the order fulfillment or after
the fulfillment. c. Limits on transactions CASHNA keeps the right to limit any sale of products or services
and to refuse to process transactions to any Customers for any reason. CASHNA also keeps right to set
the limit of the amount that can be charged using CASHNA services. CASHNA keeps the right to put any
other limitations on transactions. CASHNA is not responsible for any of Seller's losses, including claims
for profit losses. d. Return and Refund Policy. Seller will accept returns, and will agree to refund the
Customers who have initiated an inquiry or a complaint either with CASHNA and will use its best efforts
and skills to resolve inquiries and complaints from the Customer's side in such a manner that would be
acceptable to both Sellers and Customers. CASHNA keeps the right to issue a refund without the
consent or knowledge of Seller in any case that it seems appropriate. e. Customer Support. Seller will at
anytime be able to respond quickly to all inquiries from the Customer's side. In addition, CASHNA keeps
the right to bill Seller reasonable fees and recover its expenses on account of excessive customer
inquiries, refunds, or charge backs. Prior to charging such CASHNA will try to make an agreement with
the Seller. If CASHNA and Seller are unable to achieve mutually acceptable agreement, Seller will have
the option of continuing this Agreement subject to the additional fees and costs imposed by CASHNA or
of terminating this Agreement. f. Other Conditions and Terms. The conditions and terms described on
CASHNA's Services and other pages are incorporated into this agreement by referencing them. Seller
agrees to do all business activities in accordance with the requirements and rules described on the
Services and other pages. CASHNA keeps the right to refuse to do business with anyone for any reason.
7. Authorization of Regulation. Seller is responsible for all the products/services he/she is selling. Seller
must ensure he/she is in compliance with all applicable national, federal, state, and local laws, rules,
regulations, requirements and/or other standards established by any governmental authority having
jurisdiction to control such activities, including without limitation but only as applicable, the United
States Federal Trade Commission, and any national, state and local consumer protection agencies,

7. which are in effect prior to the Effective Date of this Agreement, or which become effective during the
term of this Agreement.
8. Taxes and related fees. All parties agree to report and pay its own taxes imposed on its income by any
jurisdiction, such as state and federal income taxes.
9. Limitations of Liability. CASHNA assumes no liability for malfunctions of its equipment or software for
any reason, including, but not limited to, vandalism, theft, phone service outages, Internet disruptions,
human error, extreme or severe weather conditions or any other causes in the nature of "Acts of God"
or any other force. CASHNA shall not be responsible for consequential damages or any other damages
under any circumstances. In no case shall Seller be entitled to recover damages from CASHNA, which
exceed the sum of the amounts of sales commissions and service fees retained by CASHNA under this
Agreement during the six months prior to event giving rise to the claim for damages.
10. Indemnification. Seller is completely responsible for the content of its Web site, related pages and for
the advertising and promotion of all of Seller's products. Seller represents to CASHNA that it is the
owner or that it has right and authority to use all information or other property which either forms a
part of its Web site, which is provided by Seller to Customers, or which is used by Seller in its
advertising and promotion and to sell and deliver products to Customers. CASHNA assumes no liability
of the Seller for anything but commission amount of money involved in transactions.
11. Term. The term of this Agreement shall continue until a notice of cancellation by either party is given,
or until termination is happened under other provisions of this Agreement. CASHNA reserves the right
to terminate this Agreement without cause upon notification to the Seller. CASHNA may further
terminate this Agreement immediately without notice at any time the Seller breaches any part of this
Agreement, or if any program or facility used by CASHNA to implement this Agreement is disrupted or
terminated for any reason.
12. Default. In the event Seller defaults in any provision or fails to perform pursuant to this Agreement,
CASHNA shall be entitled to damages, costs and attorney's fees from the Seller.
13. Invalid or Non-enforceable Provisions. The invalidity or non-enforceability of any provision of this
Agreement, as so determined by a court of competent jurisdiction, shall not affect the other provisions
hereof, and in any such occasion this Agreement shall be construed in all respects as if such invali d or
non-enforceable provision were omitted.
14. Choice of Law/Venue. This Agreement shall be construed and enforced in accordance with the laws of
Australia. The exclusive venue for any action, dispute or proceeding with respect to this Agreement
shall be the courts of Australia, without reference to its conflict of law principles. Seller consents to the
exclusive jurisdiction of such courts. Headings. The headings in this Agreement are for descriptive
purposes only and shall not be used in interpreting, construing, performing or enforcing this Agreement.
15. Amendments and Modifications. CASHNA may make amendments or modifications to this Agreement
from time to time. Whenever practical, CASHNA will give Seller advance notice of the changes to this
Agreement.
16. Trademarks. Cashna.com, Cashna, and all related logos, products and services described in this website
are either trademarks or registered trademarks of Cashna, or its licensors, may not be copied, imitated
or used, in whole or in part, without the prior written permission of Cashna. In addition, all page
headers, custom graphics, button icons, and scripts are service marks, trademarks, and/or trade dress
of Cashna and may not be copied, imitated, or used, in whole or in part, without the prior written
permission of Cashna.
Privacy Statement
1. All information collected on a site owned or operated by Cashna is kept strictly confidential. At no time is
this information ever given, sold or traded to any other group or individuals.
2. Cashna will do everything possible to safeguard the information collected on its web sites and keep it
from being accessed by unauthorized persons.
3. Cashna may, from time to time, release general demographic information about it's clients and/or
visitors to advertisers or potential investors. Such information will be statistical in nature about broad
categories of visitors and will never contain specific information about any individual user.
4. All activity on this server is logged and archived, including all access to utilities & member updates. This
information is used to provide statistical information about the use of the site, as well as to indicate
possible misuse or abuse of the services. General information such as browser types, country of origin
and number of clients and/or visitors may be made available to current or potential advertisers as
described in paragraph 3.

8. 5. If instructed to do so by court order or in compliance with existing laws, personal information about
registered users will be made available to law enforcement personnel. If a registered user is suspected
of conducting illegal activities, especially if using utilities from this service, information about such
activities will be turned over to the proper authorities for investigation.
6. At no other time will any information specific to a client be released without the user's express
permission.
