The Data Breach Notification Interim Final Rule has had the force of law since the fall of 2009. The United States Department of Health and Human Services (DHHS) issued the interim final breach notification regulations in August 2009 (45 CFR Parts 160 and 164 Breach Notification for Unsecured Protected Health Information; Interim Final Rule), in order to implement section 13402 of the Health Information Technology for Economic and Clinical Health (HITECH) Act. The regulation requires HIPAA Covered Entities to provide notification following a breach of unsecured PHI. Business Associates are required to investigate and immediately report incidents to Covered Entities. Similar breach notification provisions implemented and enforced by the Federal Trade Commission (FTC), apply to vendors of personal health records and their third party service providers. Similarly, various states have implemented their own data breach notification regulations. These regulations commonly subject any PII breaches of the states’ residents to specific notification requirements. Breach notification obligation is one of the significant changes that have been brought about by the HITECH Act. This change alone is important enough for Covered Entities (CEs) and Business Associates (BAs) to implement suitable security safeguards and at the same time implement appropriate Breach response and notification processes.
