3. Analysis based on pending criminal cases
In the following pages analysis based on pending criminal cases of MPs is presented.
Pending criminal cases of MPs- High Level summary
There are 162 newly elected MPs who have declared pending criminal cases according to their self declared
affidavits. Out of these, there are 76 MPs having serious cases against them. Here is the high level summary of the
new Lok Sabha:
• Affidavits available for MPs - 543
• MPs with pending criminal cases - 162 (29.83 %)
• MPs with serious pending criminal cases - 76 (14.00 %)
• Total pending criminal cases against MPs - 522
• Total serious IPC sections against MPs - 275
As compared to 2004, the number of MPs with pending criminal cases has gone up. There were 128 MPs with
pending criminal cases against them in 2004 Lok Sabha out of which 58 had serious pending criminal cases. There
is an increase of about 26% in MPs with pending criminal cases and 31% increase in the number of MPs with
serious pending criminal cases. There however is a decrease of about 7% in the number of serious pending criminal
cases on these MPs.

Comparison of serious cases between Lok Sabha 2004 & 2009
Comparison of nature of serious crime between Lok Sabha 2004 & 2009 shows that number of serious cases has
reduced from 2004 to 2009. There has been reduction in number of violent crimes (cases related to murder,
dacoity, kidnapping etc), forgery, theft and cheating. There has been an increase in number of other crimes like
false statements under oath, promoting enmity between different groups, false evidence etc. The complete

Given below is the party wise analysis of MPs with pending criminal cases. More the number of MPs of a party in
Lok Sabha; means more the number of MPs with pending criminal cases. Out of 206 MPs of INC 44 have pending
criminal cases and out of 116 MPs of BJP 44 have pending criminal cases against them.

from UP where 31 out of 80 candidates have pending criminal cases against them.

6. Tainted constituency analysis
There were 450 tainted constituencies where at least one tainted candidate (candidate having criminal
background) contested. As the following analysis shows, if voters have a choice, they prefer a clean and capable
candidate. In the constituencies where there was only 1 candidate with pending criminal cases, voters chose 83%
of the clean candidates and rejected most candidates with pending criminal cases. In the constituencies where
there were 2 candidates with pending criminal cases, they chose clean candidates in 67% constituencies. The
percentage of clean candidates however has gone down to around 35% in constituencies with more than 5
candidates. Given below is the analysis of the tainted constituencies for all candidates and all type of criminal
cases.

Since several independent candidates are non serious ones, if we remove them from the analysis, and if we
consider only the serious nature of criminal cases, the trend of choosing clean & honest candidates is even more
strongly visible.
In the constituencies where there was only 1 party candidate with serious pending case, voters chose clean
candidates 67% of the times. However with limited choice in constituencies where more than 4 party candidates
had serious pending criminal case only 17% time was a clean candidate elected by voters.

7. Candidates with pending criminal cases who have lost
Given below is a list of candidates who had serious pending criminal cases against them and were rejected by
voters.
Dinesh Rathour had 52 pending criminal cases against him which included 16 cases related to murder and
kidnapping and 25 related to theft, robbery and dacoity. Jawahir from UP had 39 cases related to murder and
kidnapping pending against him. Similarly Atiq Ahmad had 41 pending criminal cases against him which included
15 cases related to murder and kidnapping. All these and many more similar people were largely rejected by the
electorate.

9. Analysis based on assets
In the following pages analysis for MPs based on their assets has been given. A comparison of number of crorepati
MPs in 2004 & 2009 Lok Sabha shows that the number of crorepati MPs has increased 102% this time. Similarly the
average wealth of a MP of Lok Sabha 2009 is 186% more than their counterparts in Lok Sabha 2004.

There was a huge increase in the assets of the MPs of 2004 as reflected by their own declarations in the affidavits
that they submitted during 2004 and 2009. The following table summarises these findinings:

Chances of winning based on assets of candidates
As can be seen from the table, the higher the assets the more are the chances of winning of a candidate. In the
2009 Lok Sabha elections, 33% of the candidates who declared assets more than 5 crore and above won. On the
other hand less than 0.5% of candidates with assets less than 10 lakh won. The election results seemed to be
highly influenced by the money power of the candidates.

Maximum number of crorepati MPs are from Uttar Pradesh (52, i.e. 65%) followed by Maharashtra (38, i.e. 79%).
