Truth & Accuracy Viewers trust is taken very seriously by all channels, like channel 4 and 5 . When audience watch a programme from these channels they expect it to be as truthful, precise and reliable as possible, they cannot project false or misleading material and this requirement applies to every type of Factual programming. This includes entertainment programmes with factual elements. Every single aspect in a portrayal of an event whether in factual entertainment, features, Documentary, drama or any other programme, which the viewer is entitled to take at face value has to respect accuracy, honesty and fairness. This Obligation is evident in such documentaries as ‘Super Size Me’ and ‘Aileen Wournos The Selling Of A Serial Killer’, in which the documentaries would discuss a subject then they would show and explain a variety of opinion, so that the stories they are discussing are not seen as bias or one-sided. Following this Obligation when making one of these programmes makes your work a lot more reasonable and trust-worthy, which is great because you want your audience to believe what you say so that they can obtain the information your trying to put across and make what they want of it, which is what documentaries should do.
Secret Filming Individuals shouldn’t normally be filmed without approval in advance by the producer, and the producer should have consent by the each Individual being filmed, especially if the individual makes a significant appearance in the programme. If any covert filming is to take place, the film maker must create a Justification for secret recording/filming, which must suit the provisions of section 8.13 of the code. In most of the documentaries and docudramas we have watched all the individuals seem to be aware that their being filmed as their either talking directly into the camera or looking at it. Though In ‘Aileen Wournos The Selling Of A Serial Killer’ there is a part where Aileen is unaware that the camera’s are still rolling (this is the part where she is asked by the interviewer if the murders were self defence or premeditated, she tells the interviewer that she is not willing to discuss that matter, but a few moments later in that scene, we can here Aileen confessing that the murders were self defence as she is oblivious to the fact the camera is still recording). If secret filming is not taken with all the necessary precaution like a written Justification, your film could be facing legal charges by individuals involved or rejection by the channels that air the programme.
Reconstruction When making a reconstruction to your work, you must make sure that the reconstructions are fair and accurate. The reconstructions of the programme must be labelled clearly in order to avoid confusion. If there is suspicion or risk of a reconstruction of actual events causing distress to anyone, this reconstruction must be informed to the correct party. In ‘Aileen Wournos The Selling Of A Serial Killer’ the reconstructions (like re-enactment of her on the roadside hitchhiking seem to be well thought out in terms of offence to audience as they do not seem to be over exaggerated from the facts of the event for entertainment value, which is the main cause of offence to another party. If you were to make reconstructions to your programme you have to take in consideration how it could cause offence. If you don’t it could affect the effect that the programme should have on the audience, for they might feel distressed or offended.
Payments Payments are not to be taken irresponsibly or lightly for you must not make any payment to individuals or contributors without the approval of the broadcaster. Of course this precaution does not need to take place if its modest (out of the pocket) money e.g. transport fares or meal coverage for this is unlikely to be problematic. Before making or promising a payment to a convicted or confessed criminal you must make sure you get advice from a programme lawyer. If you are dealing with any legal proceedings you cannot promise or make any payment to a defendant or witness. The Documentary ‘Exit Through The Gift Shop’ deals with crime, and after doing some research I found that some of the interviewees were paid in order to be filmed. But these payments were legal as non of the interviewees were convicted or confessed criminals. Not making payments the correct and legal way could potentially put you and your programme in an illegal/corruption case with the law by either an individual or party.
Fairness And Privacy One of the most important safety measures of making a factual programme, for you have to make sure you avoid any unfair action towards an individual, group or programme. You must seek advice from your programme lawyer if you believe that your documentary contains damaging allegations that could potentially harm another individual, organization or programme, and you must be warranted by the public if your programme contains any major breach in an individual, organization or programmes privacy. ‘ Super Size Me’ is a good example of a factual programme that consists of information and subjects that harm the reputation of another organization as it suggests a lot of the time that McDonald’s is place we should not be eating from. If Fairness and privacy is not taken seriously in a documentary it could be in breach of a lot of rules and rights both legally and morally which could lead you with either problem with the law, or problems with an upset individual or group, or even both .
Physical and emotional welfare and the dignity of people under 18 years who are involved in programmes must be taken with regard. You cannot cause redundant distress and anxiety. Individuals that are under 16 and will appear on the programme must have consent by a guardian, unless their contribution is minor Similar considerations must be had with regard to ‘vulnerable adults’ i.e. those unable to give informed consent. I have seen shows especially from BBC three such as ‘Worlds Strictest Parents’ in which some teenagers have had to have their faces blurred whilst they are shown participating in Inappropriate events as an extra precaution of not distressing or upsetting any of them. When dealing with people under 18 you are dealing with the most sensitive group of people in factual programming so you have to be fair and careful with the way their portrayed or showed. If you misrepresent and upset or air a programme publicly without proper consent, you are in breach of moral and illegal rights and your programme could be rejected by programme lawyers or distributors Under 18
If a programme involves criminality or criminals there is extra care that must be taken and a alert attitude must be carried out. If there are under 18’s that are involved in criminality or legal proceedings featured in your programme you must refer to your programme lawyer as soon as possible (you would also need to refer to the programme lawyer if the your feature criminality or legal proceedings of anyone over 18). If the identification of an individual or group is prohibited by the law, you must make sure that your film doesn’t show any identification of the involved party whatsoever. Criminality is taken very seriously in factual programmes, like ‘Crime Watch’ as in these show, they would reveal the case and subject matter, but for some individuals who are or have been a convicted or confessed criminal, their identity is kept completely hidden (e.g. blurred face, name is edited out or voice is dubbed). Criminality is another important risk that must be taken very seriously as it is another factor that can put your film in breach of the law. Criminality
Potentially Offensive Material ,[object Object],[object Object],[object Object],[object Object],[object Object],[object Object],[object Object]
Commercial References Programmes shouldn’t falsely advertise or mislead audience with undue prominence in order to draw in a wider audience. You must seek advice from your programme lawyer if your programme contains a competition of some sort in which the audience participate, you must also do this if there is a number they must call at a standard rate. If your programme is sponsored it cannot contained the sponsors product or promotional references. When making a trailer or advert for your factual programme, a lot of editing will need to take place in, which you will need to referrer to your programme lawyer. Most adverts for factual programmes don’t use celebrities or tactical advertising schemes (unless its based on it), because a factual programme need to be formal and precise unlike fictional programmes, they must advertise exactly what the programme contains. Commercialising your programme is important if you want an audience but if your not careful of the rules and precaution above you could falsely advertise your programme which looses audience trust and interest
My Documentary Truth And Accuracy- In our documentary we cannot lie, our information cannot be misleading, bias or one-sided. We will undergo an investigation in which, one participant will create an online account and meet up with someone to explore the subject matter (like in supersize me) this would increase truth and accuracy as it is evidence. Secret Filming- We will not use the method of secret filming in our documentary for its unnecessary. Reconstruction – We will use the method of re-enactment for reconstruction. But before we do we must make sure our re-enactments are as close to the truth as possible, we cannot excaudate or alter the event for entertainment purposes and we must be fair and take the subject matter with a sensitive attitude as we have to be careful not to offend anyone. Payment- We will not be paid or make any contractual, conditional or premeditated payment in our documentary or in the construction of our documentary unless it a minor modest spend or payment. Fairness and Privacy- We will make sure to provide privacy and fairness to any participant in our documentary by making sure that we show more that one side to every story, not editing out information that could leave misleading information, making sure that significant participants are aware of what will be filmed and approve. Under 18- We will make sure that all participants under the age of 18 have consent and approve of their role in the documentary. And we will make sure that we don’t offend anyone by making sure that we maintain emotional and physical welfare for the under 18 contributors

  • 9. If you misrepresent and upset or air a programme publicly without proper consent, you are in breach of moral and illegal rights and your programme could be rejected by programme lawyers or distributors Under 18
  • 10. Criminality
