INDONESIA DAN MALAYSIA ADALAH DUA NEGARA
YANG TELAH DITAKDIRKAN BERTETANGGA DEKAT,
SATU RUMPUN, SATU SAUDARA DAN SATU
AGAMA, KARENA MAYORITAS PENDUDUKNYA
BERAGAMA ISLAM. PADA MULANYA BERMUKIM
DALAM KAWASAN YANG SAMA.

DIPRAKARSAI INGGRIS DAN BELANDA, TELAH
MEMBAHAGI KAWASAN ITU MENJADI DUA.
PERTAMA, DAERAH-DAERAH SEMENANJUNG

DAERAH-DAERAH YANG DIKUASAI OLEH BELANDA.

KEMBALI DIGELORAKAN DI INDONESIA DENGAN
MENAMPILKAN GAMBAR-GAMBAR BUNG KARNO KETIKA
BERPIDATO YANG MENYERUKAN RAKYAT INDONESIA UNTUK
BERSATU MENGGANYANG MALAYSIA. INI DILAKUKAN UNTUK
MERESPON MUNCULNYA BERBAGAI KASUS YANG
DIPANDANG MELECEHKAN INDONESIA. SALAH SATU KASUS
YANG BANYAK MEMICU KEMARAHAN MASYARAKAT
INDONESIA TERHADAP MALAYSIA, IALAH PENYIKSAAN
TERHADAP DOMESTIC WORKERS IN MALAYSIA YANG TERUS-
MENERUS DILAKUKAN.

9. INDICATORS:
- THE NUMBER OF CASES OF HARASSMENT AND
MISTREATMENT TO THE DOMESTIC WORKER IS OVER
INCREASING.
- A LOT OF CASES ARE FOUND OUT AFTER THE
CONDITIONS HAS ALREADY BEEN IN CRITICAL STAGES
EVEN LEADING TO DEATH DUE TO VIOLENT
MISTREATMENT BY THE EMPLOYERS .
C. HOW TO SOLVE THE PROBLEM
UNTUK MEMECAHKAN MASALAH TKI YANG SELAMA INI
SANGAT SERING MENGGANGGU HUBUNGAN BAIK DAN
KEAMANAN DALAM NEGERI KEDUA NEGARA, MAKA
DIUSULKAN ADANYA MONITORING CENTER (MC) FOR
INDONESIAN DEMOSTIC WORKERS IN MALAYSIA .
10. IA MERUPAKAN UPAYA DETEKSI DINI DALAM BENTUK
PENCEGAHAN KARENA MENCEGAH LEBIH BAIK
DARIPADA MENGOBATI.
TUJUAN ANTARA LAIN:
1. TO PREVENT CASES THAT CAN POTENTIALLY LEAD
TO SERIOUSLY FATAL ACCIDENTS DUE TO VIOLENT
MISTREATMENTS.
2. TO HARMONIZE THE RELATIONSHIP BETWEEN
DOMESTIC WORKER AND EMPLOYER WITH
COUNSELING METHOD.
3. UNTUK MEWUJUDKAN KEAMANAN DAN
HUBUNGAN HARMONIS KEDUA NEGARA.
11. PLANNED OPERATION]
WORKING MECHANISM
THE MONITORING CENTER (MC) HAS A FUNCTION
OF PROACTIVELY MONITORING AND SUPERVISING
THE RELATIONSHIP BETWEEN DOMESTIC WORKER
AND EMPLOYER IN ORDER TO PREVENT AND SOLVE
PROBLEM THAT OCCUR IN THE RELATIONSHIP
BETWEEN DOMESTIC WOKER AND EMPLOYER. AS
THE MOST CRITICAL TIME IN THE RELATIONSHIP
BETWEEN DOMESTIC WORKER AND EMPLOYER IS IN
THE SIX MONTH, THE MC HAS TO CONTACT
DOMESTIC WORKER AND EMPLOYER ONCE A MONTH.
DURING THIS CONTACT, THE MC CAN QUESTION
THE CONDITION OF THE DOMESTIC WORKER AND
HIS/HER RELATION WITH EMPLOYER, SO THAT THE
POTENCIAL DISHARMONY CA BE DETECTED AS EARLY
AS POSSIBLE.
12. 1. If the MC finds that there is a problem in the
relationship between DW and Employer but without
violence than the Center can conduct a home visit to
the employer’s place. Home visit is carried out by
counselor to ensure wehter a further action is
necessarily required. The counseling is required to
improve the relationship between DW and Employer.
2. If the MC finds that there is a serious problem in the
relationship between DW and Employer with violence
then the Center in cooperation with Local Police and
Lawyer ca perform a necessarily rercue to the DW by
placing the DW in the shelter as a temporary sttlement
for the DW. In the shelter, the DW is expected to
recover wilst waiting for the legal settlement.
13. The frequency of calling can then be reduced after
this period. Efforts to contact employers after six
month period are at least once in the three months.
They are carried out in order ro ensure that the
relationship between DW and Employer is in
harmony.
ONE STOP CENTER
The MC will become One Stop center which will act
procatively to protect the welfare of the Indonesian
DW as contactually agreed within them respectively.
14. 1. OBLIGATION OF THE AGENCY
a. To report, registers and pays for the DW to
participate the the program provided by the MC
and gives data such as copy of passport and
employer’s data.
b. Proper explanation for those DW before
accepting the worker description.
c. The agency need to make arrangement with the
WD family members in the event any wrong doing
by the WD
d. To conduct any couses as required by the
authority.
15. 2. OBLIGATION OF THE EMPLOYER
a. To ensure that the employer must abide to all
rules and regulations in relations to the WD.
b. To give proper care and attention to the welfare
of the WD (TKI).
c. Frequenst contact to the MC must be allowable
by the WD.
3.OBLIGATION OF WD (TKI)
To abide the rules and regulations in relation to
their working permit.
16. STANDAR OPERATIONAL PROCEDURES
1. Permission and cooperation between the Malysian
Autorities namely Kementerian Hal Ehwal Dalam
Negeri (KGEDN) and Kementerian Sumber Manusia of
Malaysia with BNP2TKI (Badan Nasional Penempatan
dan Perlindungan TKI di Luar Negeri/National Authority
for the Placement and Protection of Indonesian
Overseas Workers).
2. BNP2TKI shall provide proper database on the issues
of TKI leaving Indonesia to the MC.
3. The Monitoring Center shall provide adequate
information by way of electronic media, mass media
and others that deemed fit.
4. To provide a standard universal agreement between
the agent, employers and TKI.
17. 5. Monitoring Officers will act with due diligent and
proactively in contacts with the TKI as provided in the
database system by BNP2TKI.
6. Call Center for TKI who will inform their problems will
also be integrated wit MC, in this case the MC is acting
passively.
7. For any problems wether found out proactively or
passively, the MC shall be assisted by various
consultnats may it be legal, social workers, medical and
etc.
8. The MC shall coordinate with Indonesian
Embassy/Consulate and BNP2TKI .
9. The MC is also expected to give regular reports to
Kementerian Hal-Ehwal Dalam Negeri Malaysia and
BNP2TKI which can be used to improve the
environment that will lead to a better improvement in
the relationship between TKI and Employer.
18. FINANCING
To finance its activities, the MC will be funded by
end users/employers.
The fund will be seen as serious commitment by end
users in hiring Indonesian Domestic Workers (DW).
Collection of the Monitoring Center’s fee shall be
appropriate at the time the Indonesia Domestic
Workers (TKI) recieve or obtain their international
passport at the relevant Malaysian Consulate in
Indonesia. The amount that is suitable for the
operation of the Monitoring Center in Malaysia
shall be around USD 30.00 per person on biyearly
basis (subject to be discussed).
19. KESIMPULAN

BERLANGSUNG BAIK. INI HARUS TERUS DIPELIHARA DENGAN BERUSAHA
MEMBANGUN HUBUNGAN YANG HARMONIS DAN BERSAHABAT YANG
SALING MEMBERI KEMAJUAN ANTARA P-TO-P, DENGAN KONSEP
DUDUK SAMA RENDAH DAN BERDIRI SAMA TINGGI.
UNTUK MEWUJUDKAN HAL ITU, MAKA BERBAGAI PERSOALAN YANG
SELALU MENGGANGGU HUBUNGAN KEDUA NEGARA HARUS DIATASI,
DIANTARANYA ADALAH MASALAH TKI.
UNTUK ITU, DIUSULKAN ADANYA DETEKSI DINI BERUPA EARLY WARMING
SYSTEM DALAM WUJUD MONITORING CENTER (MC) SEBAGAI UPAYA
NYATA UNTUK MENCEGAH TERULANGNYA KASUS-KASUS TKI YANG
MENGAKIBATKAN TERGANGGUNYA HUBUNGAN BAIK KEDUA NEGARA.
SELAIN ITU, UNTUK MEWUJUDKAN HUBUNGAN HARMONIS ANTARA TKI
DAN PENGGUNA, DAN MENCIPTAKAN KEAMANAN DALAM NEGERI
KEDUA NEGARA.
DEMIKIAN PESENTASI INI, SEMOGA MENDAPAT RESPON POSITIF UNTUK
KEBAIKAN KEDUA MASYARAKAT DAN BANGSA SERUMPUN YANG
