This document is a complaint filed in court by Manjinder Singh Dhillon, a government food inspector, against Teja Singh, a milk vendor. The complaint alleges that on March 20, 2008, Dhillon intercepted Teja Singh selling adulterated cow milk without a valid license. Samples were taken and found to contain lower than the minimum prescribed levels of milk fat and solids. Government Food Inspector and also notified through Punjab Government vide
Gazette notification� o.FD(2)PB,98/14766 dated 15/10/1998 to seize samples

20/3/2008 I the complainant intercepted Teja Singh carrying cow milk in silver can
mounted on� a two wheeler vehicle i.e Moped Panther no. PB19-B5304 to sale the
public for human consumption at Dhanola-Barnala road opposite the petrol pump.
4.That I disclosed my Identity to the accused� as Government Food Inspector and asked him to
show the valid License for sale of milk and milk products as required under provisions of law
under Rule 24 of P.F.A Rules,1955 but he failed to show the

a silver����� can�� f That a request was made to the persons present� for joining the

7. That I purchased 1500 ml of cow Milk from the silver can containing approx. 20Kg of cow Milk
after stirring the bulk quantity of cow Milk with help of neat clean & dry glass rod stirrer 5 time
clockwise and 5 time anticiockwise from top to bottom and vice versa .The purchased Quantity
1500 ml was taken into neat,clean & dry glass jar and added the prescribed quantity of
preservative and homogenesed properly payment of Rs.25/- Was made and a payment receipt
was prepared at the spot which was signed by me and by the

8. That the1500. of cow Milk divided into three equal parts approx. 500ml each into three neat
clean & dry glass bottles. A spot memo was prepared which was signed by me and by� the
accused

and wrapped in a strong thick paper .The edges of paper were pasted on the sides of each
sample portions and affixed with the help of Gum
10.That three paper slip issued by the State Health Athourity having same serial slip no.19823
duly signed by Local Health Athourity ,Barnala along with his code no.BS/ 67/ 08 written on the
slip itself.Each slip were pasted on the each sample portions with the help of gum covering the
mouth of each sample and were further secured by means of strong thread.The all the sample
portions were sealed at the spot on the five distinct places bearing the seal lmpressionMSD�
11.That the signature of the accused were taken on the each sample portion in a manner that
half the signature appears on wrappers of the sample portions and half on the paper slip
wrapped on the same sample portions.l� too signed in similar

the same day I prepared five copies ol Memorandum Form VII and three seal mpressions of the
Seal used to seal sample portions were affixed upon form VII� orignal copy is Annexured

sealed sample portion along with the copy of Form VII Bearing the three seal Impressions were
sent to Public Analyst Punjab Chandlgarh through special messenger Sh.Manjil Singh, of Civil
Surgeon office ,Barnala In the same day

�14 That a sealed envelop containing one copy of Form VII bearing the seal impression of the
seal used to seal the samples was sent separatly through same special messenger
3. 15. That the remaining sample portions and Form VII were deposited at the office ol LHA.
Barnala on the same day evening, which were seals intact
16. That on receiving the Report of the Public Analyst on Form III ,ln which the Public Analyst
Punjab Chandlgarh is of the opinion that
������� � the content of the sample contains 3.5 % Milk Fat and 8.1%
milk-solid-not-Fat against the minimum prescribe standard of 4.0 % and
8.5% respectively. The contents of the sample are therefore
Adulterated.

17. . That� the accused� Teja Singh s/o according tc law is fully responsible� day to
day,sale,work and conduct of business of the selling Milk� for human consumption.
18. That accused Teja Singh s/o Sh.Gurdev Singh (Milk vendor)r/o Village Pharwahi,
Barnala. ��has committed offence under the Prevention of Food Adulteration Act,1954
,action may kindly be taken against him under section 7/16 of PFA,Act,1954.and under rule 50
of PFA,Rules 1955 by stocking� cow Milk for sale to public for human consumption without any
valid license It is further prayed that since this offence facts under section 16 which shall be tried
In summary trial procedure as said under section 262-265 of Cr.PC.1973
