eLitigation Solutions, Inc. (eLit) was founded in April 2003 by Greg and Dave Arellano, in Silicon Valley, CA.  eLit provides business with complete, end to end electronic discovery and reprographics services that efficiently manage paper and digital information for document productions and strategic case analysis.  Four Locations: Mountain View, Ca; San Francisco, CA; Seattle, WA; Phoenix, AZ 2009 Revenue: $11.4M – 40% Growth over 2008 eLit Phoenix: Worked with ~ 70% of Top 25 firms in 2009 eLit Overview

Gregory Arellano – is the President and co-founder of eLit and his primary focus is on Sales and Marketing of the company.  He has worked in the legal industry for over 14 years and has successfully helped transition his clients into new technologies.  He is one of the most experienced and knowledgeable individuals in the field of litigation support and electronic discovery. Greg provides his clients with first rate service and solutions that demonstrate not only his expertise, but also his creative, innovative use of tools to accomplish the best results while containing costs on behalf of his clients. In addition to his excellent skills. He also has the ability to take difficult to understand concepts and explain them in a manner which is easy to understand by those not as knowledgeable in the area.  Greg received his B.A. from Humboldt State, and resides in Pleasanton with his wife, Theresa, and two children, Kaeli and Lukas.  Dave Arellano – is the Chief Financial Officer and co-founder of eLit with primary focus on operations and financials.  Dave has over 20 years experience in voluntary leadership roles and of overseeing operations of a mid-sized real estate company located in Palo Alto, CA.  Dave is responsible to insure all account receivables are collected timely and all account payables are paid timely. Dave’s primary focus has been on expansion of the Company, strategic planning, budgeting and financial reporting. Dave holds a BS degree in Business Administration from CSU, Sacramento and is a licensed California Real Estate Broker and resides in Pleasanton with his wife, Michelle and 4 children, Scott, Zachary, Eric, and Jennifer.  Ed Cruz – is the National Director of Client Services.  His primary responsibilities include the management and communication of digital projects produced through eLit’s data center.  He has worked with electronic data for over 5 years, in various capacities, and through his career has worked with both corporate counsel and outside counsel to advise, craft workflows, and fulfill requests on some of the largest litigation to hit the Bay Area.  Ed has built his reputation for working under the highest code of ethics by giving honest feedback, understanding a customer’s true need, and offering competent advice to meet any business challenge.  Ed is a graduate of the University of California at Berkeley, and resides in Brentwood with his wife, Heidi, and 4 children, Joseph, Elijah, Ashley and Anthony. Brent Kinzel – is the National Director of Operations.  In this capacity, he plans, directs and coordinates the operations for our 3 facilities.  Brent started his litigation support career in 1996 in New York.  He managed the largest domestic coding facility at the time.  Brent relocated to the west coast in 2000, taking over the largest Litigation Support production facility in the nation.  Brent moved on to become the National Director of Operations for a 12 location litigation support company before joining eLit in October, 2007.  Brent received his BA from Michigan University, and obtained his MBA from Stetson University in Deland, Florida and resides in Concord, California with his wife Joanna and 2 children, Tyler and Grant. Morgan Graham- is the Managing Principal for our Phoenix location. Morgan has over nine years of industry experience in both the sales and operations manager roles. In addition, Morgan has a combined twenty plus years as a successful manager in a variety of businesses.  Morgan has managed several offices in California, Florida and Arizona. He is a known in the industry as a trustworthy and honest businessman and is dedicated to providing superior customer satisfaction. Morgan lives in Phoenix and has three children:  Hayley, Alexandra and Megan Santiago Barrera– is the Technology Manager for the Phoenix Office. His responsibility is to work with our clients to ensure that there is a clear understanding of the project instructions and that we continuously keep our clients updated on the progress of their project. Santiago started with eLit in 2004 as a Project Manager for the Mountain View Office. In 2006 he moved to Phoenix and worked with IPRO Tech. He has now re-joined our team to lead the EDD Dept. Santiago’s experience covers programs such as Concordance, Summation, iConect and IPRO’s full line of software.    Paul McIlroy – is the senior Account Manager in our Phoenix location.  Paul has an extensive background in litigation support sales and project management after spending the past four years working for the competition in both Phoenix and Orange County, CA.  Paul has managed a variety of projects for large law firms, corporate legal, and government agencies.  Notable projects include; a document depository hosted via iConect involving 23 parties across seven states and converting 1M pages of regulatory documents to a digital database for a local pharmaceutical company.  Paul is responsible for establishing and growing the trusting relationships that make eLit successful.   Paul holds a Bachelor of Science from Northern Arizona University and resides in Phoenix with his wife and 2 dogs.   Sean McIlwain -is a senior Account Manager in our Phoenix office. He comes with 17+ years in the litigation support industry. He was in the San Diego market for 16 years and managed countless large document productions for firms like DLA Piper, Gordon & Rees, Duane Morris LLP, McKenna Long & Aldridge and Milberg Weiss. Sean prides himself on attention to detail and his ability to develop long standing relationships. His fun attitude and willingness to do whatever it takes for the client makes him a great addition to the team. Sean is married, has 2 kids, 1 dog and lives in the lovely town of Buckeye. Damon Meadows- is the Senior Electronic Discovery Manager and joined eLitigation Solutions in June 2008.  Damon’s career began at IKON Office Solutions in May 2002 as a senior technical associate where he provided technical support for Summation and Doculex at a coding and LDD facility.  In January 2003, he was promoted to shift supervisor and was responsible supervising all scanning and EDD projects for IKON in San Francisco. Damon’s strengths are his operational knowledge, business savvy and technical expertise.  He currently holds certifications in Discover-E (EDD process software), iConect, IPRO, and is a Certified Concordance Software Database Administrator.  Damon is a graduate from Indiana University, Kelley School of Business, and holds a B.S. in Computer Information Systems with a minor in Criminal Justice and resides in Dublin with his wife Shareeka and daughter Kendall. Jackie Huynh – is the project manager coordinator for the eLit Data Center.  She moved to the Bay Area and started working in litigation support in 2001 and has worked with electronic data for over 5 years.  She is very familiar with database programs such as Concordance and Summation, as well as web hosted solutions, like iConect.  Extremely detailed and client focused, Jackie is responsible for keeping track of the data received and delivered to Intel while keeping the teams updated with project reports on a weekly basis.  Furthermore, she prepares the monthly projected spends reports for Intel to support them in analyzing and managing their budgets efficiently.  Known for her eye for detail, and her commitment for her clients, Jackie is a highly valued member of our team.  She graduated from Cal Poly Pomona in 2000 with a BS degree in CIS (Computer Information Systems), and resides in San Jose with her son Kenneth.   Michael Wiggington- is a Senior Technical Manager with eLitigation Solutions Mountain View office. He has over 5 years direct experience in technical litigation support. He has worked in electronic discovery matters ranging in size up to 10 terabytes. Since joining eLit as a technical lead he has moved quickly into his current position as Senior Database Administrator supporting 8 technicians. He is a primary Project Manager for all eLit ediscovery projects.  Michael manages all iCONECT nxt™ activities from creating databases, maintaining our servers and providing technical support. He has completed all courses for certification in iCONECTnxt™ which requires an annual renewal. He serves as a resource to iCONECTnxt™ directly, as well as a consultant to end users in the Bay Area. He is Administrator and End User certified for Concordance.  Michael moved into the IT industry directly from high school, followed by his entry into the litigation support field. His intimate knowledge and experience with network management combined with his success in electronic discovery matters makes him uniquely qualified to support the expectations and requirements of our clients.      Christian Velasco -  is the Network Manager. His responsibilities are to implement and manage the network and server technology that would be required for the different aspects of the company as well as being technical support for all the current facilities. Christian has worked in Information Technology for over 12 years. He has configured and implemented different environments for companies in Asia, Europe and the United States. Christian is also experienced in Computer Forensics in which he worked as a Senior Consultant for one the Big 4 Professional Services firms. eLit will provide a web-based document repository eLit will create at least one ‘working’ database for each Plaintiff and Defendant Each ‘working’ database will allow the parties to review and tag both electronically created documents and images of hard copy originals (1) Master Database will be created for documents that are to be produced to all parties eLit will process all native data to be reviewed eLit will image all hard copy documents to be reviewed (Coding services to be provided by eLit’s sub-contractor) eLit will provide support services relating to the production and review of all documents (Blowbacks, Data Export) eLit will manage all user access rights and production of data/images into the Master Database Proposed Solution
Workflow Overview - ESI Data is collected from all sources Data is expanded from its compressed format A comprehensive index is created Search criteria is applied to data Duplicates are removed (if requested).  Metadata and text are extracted from files .  Files are processed and converted.  Resulting subset of data is loaded in to client database or hosed by eLit.   Docs are reviewed and submitted for production.

Account Teams are structured to afford each account the support required to manage day-to-day operations, provide large project management, and finally, develop long-term, strategically valuable relationships that are financially profitable for all parties Day-to-Day Operations (Needle and Pine Cones) are managed by the Account Manager/Managing Principal in each location. Large Project Management (Overall Health of the Tree) is supported through our Client Services Department   A Database Administrator would be assigned to this project to assist each of the parties involved with any questions relating to the web-hosted database Project Management

  5. For each individual database, we would image and perform ‘traditional’ services to prepare hard copy documents to be loaded into the database. If you are considering coding, we HIGHLY recommend that all parties use the same coding vendor to ensure that the fields are consistently formatted once the data is produced into the master database.Regarding ESI, eLit has the ability to process data both natively and through TIFF. This can be done pre- or post-review. We are committed to helping each party work through the discovery process in the most efficient manner possible.   6. The individual databases can be used to perform all of the prep work necessary to produce both electronic data and imaged documents. While both iConect and Relativity allow you to perform redactions, additional steps may be required if the document review is done natively, as opposed to TIFFing everything prior to review.

One phone call is all it takes for us to produce a data set to be loaded into your firm’s litigation support database or print a set of blowbacks for those of us who prefer hard copies.

  9. As you are all aware by this point in the day, there are many advantages to a web-hosted solution. The primary benefit is that this solution reduces the strain on your internal resources. There may be a voluminous amount of data to be produced in this data, which takes time to format, load, and manage on your internal servers. While we realize that a decision has not been made on the web-hosting platform, we would like to discuss the features and benefits of the two solutions that we think would be the best fit for this case. We would be more than happy to provide an in-depth demonstration of the platforms that we discuss this afternoon. Now we will provide a brief overview of the web-hosted solutions that we offer.
  10. kCura is a long-time partner of eLit’s and one which we have had considerable success, both as a web-repository and as a document review tool. Their product, Relativity, provides a stable, granular hosting environment. Granular in that almost every aspect of Relativity can be customized. Users will only see the features to which they have rights, including print features.
  11. Touch on this slide – We also want to discuss two tools that may assist with the culling of large amounts of ESI. CW is an early case assessment tool that is used to cull large amounts of email communications, especially if keyword and date filters were not used at the time of collection. CW is not a true review tool and it is not recommended that it be used as such. It is best used to test keywords and refine those searches. Equivio detects and groups like documents based upon a threshold setting. Equivio searches the text to ID similar files and group like documents. This is an optional service that we would recommend to those parties that have limited staff or large amounts of ESI to review. Equivio is also able to assign email threads for review, ensuring coherent review of email data. Users can bulk handle all the emails in a thread, reducing time and cost, while also ensuring that all the emails in the thread are treated consistently.
